</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e0-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/5/B"><num value="B">(B)</num><content> the commissioned corps of the National Oceanic and Atmospheric Administration; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e1-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/5/C"><num value="C">(C)</num><content> the commissioned corps of the Public Health Service.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962e2-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/6"><num value="6">(6)</num><content> The term “department”, when used with respect to a military department, means the executive part of the department and all field headquarters, forces, reserve components, installations, activities, and functions under the control or supervision of the Secretary of the department. When used with respect to the Department of Defense, such term means the executive part of the department, including the executive parts of the military departments, and all field headquarters, forces, reserve components, installations, activities, and functions under the control or supervision of the Secretary of Defense, including those of the military departments.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962e3-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/7"><num value="7">(7)</num><content> The term “executive part of the department” means the executive part of the Department of Defense, Department of the Army, Department of the Navy, or Department of the Air Force, as the case may be, at the seat of government.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962e4-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/8"><num value="8">(8)</num><content> The term “military departments” means the Department of the Army, the Department of the Navy, and the Department of the Air Force.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962e5-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/9"><num value="9">(9)</num><chapeau> The term “Secretary concerned” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e6-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/9/A"><num value="A">(A)</num><content> the Secretary of the Army, with respect to matters concerning the Army;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e7-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/9/B"><num value="B">(B)</num><content> the Secretary of the Navy, with respect to matters concerning the Navy, the Marine Corps, and the Coast Guard when it is operating as a service in the Department of the Navy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e8-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/9/C"><num value="C">(C)</num><content> the Secretary of the Air Force, with respect to matters concerning the Air Force; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962e9-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/9/D"><num value="D">(D)</num><content> the Secretary of Homeland Security, with respect to matters concerning the Coast Guard when it is not operating as a service in the Department of the Navy.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962ea-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/10"><num value="10">(10)</num><content> The term “service acquisition executive” means the civilian official within a military department who is designated as the service acquisition executive for purposes of regulations and procedures providing for a service acquisition executive for that military department.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962eb-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/11"><num value="11">(11)</num><chapeau> The term “Defense Agency” means an organizational entity of the Department of Defense—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962ec-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/11/A"><num value="A">(A)</num><content> that is established by the Secretary of Defense under <ref href="/us/usc/t10/s191">section 191 of this title</ref> (or under the second sentence of <ref href="/us/usc/t10/s125/d">section 125(d) of this title</ref> (as in effect before <date date="1986-10-01">October 1, 1986</date>)) to perform a supply or service activity common to more than one military department (other than such an entity that is designated by the Secretary as a Department of Defense Field Activity); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962ed-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/11/B"><num value="B">(B)</num><content> that is designated by the Secretary of Defense as a Defense Agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962ee-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/12"><num value="12">(12)</num><chapeau> The term “Department of Defense Field Activity” means an organizational entity of the Department of Defense—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962ef-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/12/A"><num value="A">(A)</num><content> that is established by the Secretary of Defense under <ref href="/us/usc/t10/s191">section 191 of this title</ref> (or under the second sentence of <ref href="/us/usc/t10/s125/d">section 125(d) of this title</ref> (as in effect before <date date="1986-10-01">October 1, 1986</date>)) to perform a supply or service activity common to more than one military department; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962f0-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/12/B"><num value="B">(B)</num><content> that is designated by the Secretary of Defense as a Department of Defense Field Activity.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962f1-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/13"><num value="13">(13)</num><chapeau> The term “contingency operation” means a military operation that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962f2-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/13/A"><num value="A">(A)</num><content> is designated by the Secretary of Defense as an operation in which members of the armed forces are or may become involved in military actions, operations, or hostilities against an enemy of the United States or against an opposing military force; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962f3-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/13/B"><num value="B">(B)</num><content> results in the call or order to, or retention on, active duty of members of the uniformed services under section 688, 12301(a), 12302, 12304, 12304a, 12305, or 12406 of this title, chapter 15 of this title, <ref href="/us/usc/t14/s712">section 712 of title 14</ref>, or any other provision of law during a war or during a national emergency declared by the President or Congress.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962f4-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/14"><num value="14">(14)</num><content> The term “supplies” includes material, equipment, and stores of all kinds.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962f5-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/15"><num value="15">(15)</num><content> The term “pay” includes basic pay, special pay, retainer pay, incentive pay, retired pay, and equivalent pay, but does not include allowances.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab962f6-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/16"><num value="16">(16)</num><chapeau> The term “congressional defense committees” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaab962f7-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/a/16/A"><num value="A">(A)</num><content> the Committee on Armed Services and the Committee on Appropriations of the Senate; and</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab96300-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/2"><num value="2">(2)</num><content> The term “commissioned officer” includes a commissioned warrant officer.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab96301-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/3"><num value="3">(3)</num><content> The term “warrant officer” means a person who holds a commission or warrant in a warrant officer grade.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab96302-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/4"><num value="4">(4)</num><content> The term “general officer” means an officer of the Army, Air Force, or Marine Corps serving in or having the grade of general, lieutenant general, major general, or brigadier general.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaab96303-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/5"><num value="5">(5)</num><content> The term “flag officer” means an officer of the Navy or Coast Guard serving in or having the grade of admiral, vice admiral, rear admiral, or rear admiral (lower half).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd404-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/6"><num value="6">(6)</num><content> The term “enlisted member” means a person in an enlisted grade.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd405-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/7"><num value="7">(7)</num><content> The term “grade” means a step or degree, in a graduated scale of office or military rank, that is established and designated as a grade by law or regulation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd406-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/8"><num value="8">(8)</num><content> The term “rank” means the order of precedence among members of the armed forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd407-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/9"><num value="9">(9)</num><content> The term “rating” means the name (such as “boatswain’s mate”) prescribed for members of an armed force in an occupational field. The term “rate” means the name (such as “chief boatswain’s mate”) prescribed for members in the same rating or other category who are in the same grade (such as chief petty officer or seaman apprentice).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd408-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/10"><num value="10">(10)</num><content> The term “original”, with respect to the appointment of a member of the armed forces in a regular or reserve component, refers to that member’s most recent appointment in that component that is neither a promotion nor a demotion.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd409-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/11"><num value="11">(11)</num><content> The term “authorized strength” means the largest number of members authorized to be in an armed force, a component, a branch, a grade, or any other category of the armed forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd40a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/12"><num value="12">(12)</num><content> The term “regular”, with respect to an enlistment, appointment, grade, or office, means enlistment, appointment, grade, or office in a regular component of an armed force.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd40b-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/13"><num value="13">(13)</num><content> The term “active-duty list” means a single list for the Army, Navy, Air Force, or Marine Corps (required to be maintained under <ref href="/us/usc/t10/s620">section 620 of this title</ref>) which contains the names of all officers of that armed force, other than officers described in <ref href="/us/usc/t10/s641">section 641 of this title</ref>, who are serving on active duty.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd40c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/14"><num value="14">(14)</num><content> The term “medical officer” means an officer of the Medical Corps of the Army, an officer of the Medical Corps of the Navy, or an officer in the Air Force designated as a medical officer.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd40d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/15"><num value="15">(15)</num><content> The term “dental officer” means an officer of the Dental Corps of the Army, an officer of the Dental Corps of the Navy, or an officer of the Air Force designated as a dental officer.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd40e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/b/16"><num value="16">(16)</num><content> The term “Active Guard and Reserve” means a member of a reserve component who is on active duty pursuant to <ref href="/us/usc/t10/s12301/d">section 12301(d) of this title</ref> or, if a member of the Army National Guard or Air National Guard, is on full-time National Guard duty pursuant to <ref href="/us/usc/t32/s502/f">section 502(f) of title 32</ref>, and who is performing Active Guard and Reserve duty.</content>
</paragraph>

<subsection style="-uslm-lc:I11" class="indent0" id="idaabbd40f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c"><num value="c">(c)</num><heading> <inline class="small-caps">Reserve Components</inline>.—</heading><chapeau>The following definitions relating to the reserve components apply in this title:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd410-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/1"><num value="1">(1)</num><content> The term “National Guard” means the Army National Guard and the Air National Guard.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd411-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/2"><num value="2">(2)</num><chapeau> The term “Army National Guard” means that part of the organized militia of the several States and Territories, Puerto Rico, and the District of Columbia, active and inactive, that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd412-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/2/A"><num value="A">(A)</num><content> is a land force;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd413-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/2/B"><num value="B">(B)</num><content> is trained, and has its officers appointed, under the sixteenth clause of section 8, article I, of the Constitution;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd414-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/2/C"><num value="C">(C)</num><content> is organized, armed, and equipped wholly or partly at Federal expense; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd415-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/2/D"><num value="D">(D)</num><content> is federally recognized.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd416-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/3"><num value="3">(3)</num><content> The term “Army National Guard of the United States” means the reserve component of the Army all of whose members are members of the Army National Guard.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd417-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/4"><num value="4">(4)</num><chapeau> The term “Air National Guard” means that part of the organized militia of the several States and Territories, Puerto Rico, and the District of Columbia, active and inactive, that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd418-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/4/A"><num value="A">(A)</num><content> is an air force;</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd41a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/4/C"><num value="C">(C)</num><content> is organized, armed, and equipped wholly or partly at Federal expense; and</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd41b-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/4/D"><num value="D">(D)</num><content> is federally recognized.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd41c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/5"><num value="5">(5)</num><content> The term “Air National Guard of the United States” means the reserve component of the Air Force all of whose members are members of the Air National Guard.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd41d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/6"><num value="6">(6)</num><content> The term “reserve”, with respect to an enlistment, appointment, grade, or office, means enlistment, appointment, grade, or office held as a Reserve of one of the armed forces.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd41e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/c/7"><num value="7">(7)</num><content> The term “reserve active-status list” means a single list for the Army, Navy, Air Force, or Marine Corps (required to be maintained under <ref href="/us/usc/t10/s14002">section 14002 of this title</ref>) that contains the names of all officers of that armed force except warrant officers (including commissioned warrant officers) who are in an active status in a reserve component of the Army, Navy, Air Force, or Marine Corps and are not on an active-duty list.</content>
</paragraph>

<subsection style="-uslm-lc:I11" class="indent0" id="idaabbd41f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d"><num value="d">(d)</num><heading> <inline class="small-caps">Duty Status</inline>.—</heading><chapeau>The following definitions relating to duty status apply in this title:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd420-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/1"><num value="1">(1)</num><content> The term “active duty” means full-time duty in the active military service of the United States. Such term includes full-time training duty, annual training duty, and attendance, while in the active military service, at a school designated as a service school by law or by the Secretary of the military department concerned. Such term does not include full-time National Guard duty.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd421-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/2"><num value="2">(2)</num><content> The term “active duty for a period of more than 30 days” means active duty under a call or order that does not specify a period of 30 days or less.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd422-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/3"><num value="3">(3)</num><content> The term “active service” means service on active duty or full-time National Guard duty.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd423-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/4"><num value="4">(4)</num><content> The term “active status” means the status of a member of a reserve component who is not in the inactive Army National Guard or inactive Air National Guard, on an inactive status list, or in the Retired Reserve.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd424-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/5"><num value="5">(5)</num><content> The term “full-time National Guard duty” means training or other duty, other than inactive duty, performed by a member of the Army National Guard of the United States or the Air National Guard of the United States in the member’s status as a member of the National Guard of a State or territory, the Commonwealth of Puerto Rico, or the District of Columbia under section 316, 502, 503, 504, or 505 of title 32 for which the member is entitled to pay from the United States or for which the member has waived pay from the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd425-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/6"><num value="6">(6)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="idaabbd426-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/6/A"><num value="A">(A)</num><content> The term “active Guard and Reserve duty” means active duty performed by a member of a reserve component of the Army, Navy, Air Force, or Marine Corps, or full-time National Guard duty performed by a member of the National Guard pursuant to an order to full-time National Guard duty, for a period of 180 consecutive days or more for the purpose of organizing, administering, recruiting, instructing, or training the reserve components.</content>
</subparagraph>

<clause style="-uslm-lc:I13" class="indent2" id="idaabbd429-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/6/B/ii"><num value="ii">(ii)</num><content> Duty performed as a property and fiscal officer under <ref href="/us/usc/t32/s708">section 708 of title 32</ref>.</content>

<clause style="-uslm-lc:I13" class="indent2" id="idaabbd42a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/6/B/iii"><num value="iii">(iii)</num><content> Duty performed for the purpose of interdiction and counter-drug activities for which funds have been provided under <ref href="/us/usc/t32/s112">section 112 of title 32</ref>.</content>

<clause style="-uslm-lc:I13" class="indent2" id="idaabbd42c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/6/B/v"><num value="v">(v)</num><content> Service as a State director of the Selective Service System under section 10(b)(2) of the Military Selective Service Act (<ref href="/us/usc/t50/s3809/b/2">50 U.S.C. 3809(b)(2)</ref>).</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd42d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/7"><num value="7">(7)</num><chapeau> The term “inactive-duty training” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd42e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/7/A"><num value="A">(A)</num><content> duty prescribed for Reserves by the Secretary concerned under <ref href="/us/usc/t37/s206">section 206 of title 37</ref> or any other provision of law; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd42f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/d/7/B"><num value="B">(B)</num><content> special additional duties authorized for Reserves by an authority designated by the Secretary concerned and performed by them on a voluntary basis in connection with the prescribed training or maintenance activities of the units to which they are assigned.</content>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">Such term includes those duties when performed by Reserves in their status as members of the National Guard.</continuation>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaabbd430-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e"><num value="e">(e)</num><heading> <inline class="small-caps">Facilities and Operations</inline>.—</heading><chapeau>The following definitions relating to facilities and operations apply in this title:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd431-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/1"><num value="1">(1)</num><heading> <inline class="small-caps">Range</inline>.—</heading><chapeau>The term “range”, when used in a geographic sense, means a designated land or water area that is set aside, managed, and used for range activities of the Department of Defense. Such term includes the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd432-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/1/A"><num value="A">(A)</num><content> Firing lines and positions, maneuver areas, firing lanes, test pads, detonation pads, impact areas, electronic scoring sites, buffer zones with restricted access, and exclusionary areas.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd433-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/1/B"><num value="B">(B)</num><content> Airspace areas designated for military use in accordance with regulations and procedures prescribed by the Administrator of the Federal Aviation Administration.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd434-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/2"><num value="2">(2)</num><heading> <inline class="small-caps">Range activities</inline>.—</heading><chapeau>The term “range activities” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd435-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/2/A"><num value="A">(A)</num><content> research, development, testing, and evaluation of military munitions, other ordnance, and weapons systems; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd436-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/2/B"><num value="B">(B)</num><content> the training of members of the armed forces in the use and handling of military munitions, other ordnance, and weapons systems.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd437-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/3"><num value="3">(3)</num><heading> <inline class="small-caps">Operational range</inline>.—</heading><chapeau>The term “operational range” means a range that is under the jurisdiction, custody, or control of the Secretary of a military department and—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd438-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/3/A"><num value="A">(A)</num><content> that is used for range activities, or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd439-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/3/B"><num value="B">(B)</num><content> although not currently being used for range activities, that is still considered by the Secretary to be a range and has not been put to a new use that is incompatible with range activities.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd43a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4"><num value="4">(4)</num><heading> <inline class="small-caps">Military munitions</inline>.—</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="idaabbd43b-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/A"><num value="A">(A)</num><content> The term “military munitions” means all ammunition products and components produced for or used by the armed forces for national defense and security, including ammunition products or components under the control of the Department of Defense, the Coast Guard, the Department of Energy, and the National Guard.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaabbd43c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/B"><num value="B">(B)</num><chapeau> Such term includes the following:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idaabbd43d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/B/i"><num value="i">(i)</num><content> Confined gaseous, liquid, and solid propellants.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaabbd43e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/B/ii"><num value="ii">(ii)</num><content> Explosives, pyrotechnics, chemical and riot control agents, smokes, and incendiaries, including bulk explosives and chemical warfare agents.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaabbd43f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/B/iii"><num value="iii">(iii)</num><content> Chemical munitions, rockets, guided and ballistic missiles, bombs, warheads, mortar rounds, artillery ammunition, small arms ammunition, grenades, mines, torpedoes, depth charges, cluster munitions and dispensers, and demolition charges.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaabbd440-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/B/iv"><num value="iv">(iv)</num><content> Devices and components of any item specified in clauses (i) through (iii).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idaabbd441-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/C"><num value="C">(C)</num><chapeau> Such term does not include the following:</chapeau><clause style="-uslm-lc:I13" class="indent2" id="idaabbd442-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/C/i"><num value="i">(i)</num><content> Wholly inert items.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaabbd443-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/C/ii"><num value="ii">(ii)</num><content> Improvised explosive devices.</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="idaabbd444-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/4/C/iii"><num value="iii">(iii)</num><content> Nuclear weapons, nuclear devices, and nuclear components, other than nonnuclear components of nuclear devices that are managed under the nuclear weapons program of the Department of Energy after all required sanitization operations under the Atomic Energy Act of 1954 (<ref href="/us/usc/t42/s2011">42 U.S.C. 2011</ref> et seq.) have been completed.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd445-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/5"><num value="5">(5)</num><heading> <inline class="small-caps">Unexploded ordnance</inline>.—</heading><chapeau>The term “unexploded ordnance” means military munitions that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd446-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/5/A"><num value="A">(A)</num><content> have been primed, fused, armed, or otherwise prepared for action;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd447-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/5/B"><num value="B">(B)</num><content> have been fired, dropped, launched, projected, or placed in such a manner as to constitute a hazard to operations, installations, personnel, or material; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idaabbd448-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/e/5/C"><num value="C">(C)</num><content> remain unexploded, whether by malfunction, design, or any other cause.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idaabbd449-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/f"><num value="f">(f)</num><heading> <inline class="small-caps">Rules of Construction</inline>.—</heading><chapeau>In this title—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idaabbd44a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s101/f/1"><num value="1">(1)</num><content> “shall” is used in an imperative sense;</content>

<p style="-uslm-lc:I21" class="indent0">The definitions in clauses (3), (15), (18)–(21), (23)–(30), and (31)–(33) reflect the adoption of terminology which, though undefined in the source statutes restated in this title, represents the closest practicable approximation of the ways in which the terms defined have been most commonly used. A choice has been made where established uses conflict.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (2), the definition of “Territory” in 32:4c is executed throughout this revised title by specific reference, where applicable, to the Territories, Puerto Rico and the Canal Zone.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (4), the definition of “armed forces” is based on the source statute instead of 50:551(2), which does not include an express reference to the Marine Corps. The words “including all components thereof” are omitted as surplusage.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (5), the term “Department” is defined to give it the broad sense of “Establishment”, to conform to the source statute and the usage preferred by the Department of Defense, instead of the more limited sense defined by 5:421g(a) and 423a(a), and 10:1a(d) and 1801(d).</p>
<p style="-uslm-lc:I21" class="indent0">In clause (6), the term “executive part of the department” is created for convenience in referring to what is described in the source statutes for this title as “department” in the limited sense of the executive part at the seat of government. This is required by the adoption of the word “department” in clause (5) to cover the broader concept of “establishment”.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (8), the term “Secretary concerned” is created and defined for legislative convenience.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (9), a definition of “National Guard” is inserted for clarity.</p>
<p>In clause (10)(A), the words “a land force” are substituted for 32:2 (as applicable to Army National Guard). The National Defense Act of 1916, § 117 (last 66 words), <ref href="/us/stat/39/212">39 Stat. 212</ref>, is not contained in 32:2. It is also omitted from the revised section as repealed by the <ref href="/us/act/1925-02-28/ch374">Act of February 28, 1925, ch. 374</ref>, § 3, <ref href="/us/stat/43/1081">43 Stat. 1081</ref>.</p>

<p style="-uslm-lc:I21" class="indent0">In clause (12)(A), the words “an air force” are substituted for the words “for which Federal responsibility has been vested in the Secretary of the Air Force or the Department of the Air Force pursuant to law”, in 10:1835, and for 32:2 (as applicable to Air National Guard), to make the definition of “Air National Guard” parallel with the definition of “Army National Guard”, and to make explicit the intent of Congress, in creating the Air National Guard, that the organized militia henceforth should consist of three mutually exhaustive classes comprising the Army, Air, and Naval militia.</p>
<p style="-uslm-lc:I21" class="indent0">In clause (14), the definition of “officer” is based on the source statutes instead of 50:551(5), which excludes warrant officers. The reference to appointment in 10:1a(b) (2d sentence and 10:1801(b) (2d sentence), and the words “commissioned warrant officer”, “flight officer”, and “either permanent or temporary”, in 37:231(c) (1st sentence), are omitted as surplusage. 5:181–3(b) (1st sentence), 10:1a(b) (1st sentence), and 10:1801(b) (1st sentence) are omitted as covered by the definitions in clauses (14) and (16) of the revised section and by section 3062(c) and <ref href="/us/usc/t10/s8062/d">section 8062(d) of this title</ref>.</p>
