<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id70230630-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142"><num value="142">§ 142.</num><heading> Chief Information Officer</heading><subsection style="-uslm-lc:I11" class="indent0" id="id70230631-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/a"><num value="a">(a)</num><content> There is a Chief Information Officer of the Department of Defense.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id70230632-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id70230633-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1"><num value="1">(1)</num><chapeau> The Chief Information Officer of the Department of Defense—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id70230634-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/A"><num value="A">(A)</num><content> is the Chief Information Officer of the Department of Defense for the purposes of sections 3506(a)(2) and 3544(a)(3) of title 44;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70230635-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/B"><num value="B">(B)</num><content> has the responsibilities and duties specified in <ref href="/us/usc/t40/s11315">section 11315 of title 40</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d46-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/C"><num value="C">(C)</num><content> has the responsibilities specified for the Chief Information Officer in sections 2222, 2223(a), and 2224 of this title;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d47-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/D"><num value="D">(D)</num><content> exercises authority, direction, and control over the Information Assurance Directorate of the National Security Agency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d48-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/E"><num value="E">(E)</num><content> exercises authority, direction, and control over the Defense Information Systems Agency, or any successor organization;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d49-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/F"><num value="F">(F)</num><content> has the responsibilities for policy, oversight, guidance, and coordination for all Department of Defense matters related to electromagnetic spectrum, including coordination with other Federal and industry agencies, coordination for classified programs, and in coordination with the Under Secretary for Personnel and Readiness, policies related to spectrum management workforce;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d4a-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/G"><num value="G">(G)</num><content> has the responsibilities for policy, oversight, guidance, and coordination for nuclear command and control systems;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d4b-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/H"><num value="H">(H)</num><content> has the responsibilities for policy, oversight, and guidance for matters related to precision navigation and timing; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id70232d4c-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/1/I"><num value="I">(I)</num><content> has the responsibilities for policy, oversight, and guidance for the architecture and programs related to the networking and cyber defense architecture of the Department.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id70232d4d-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/b/2"><num value="2">(2)</num><content> The Chief Information Officer shall perform such additional duties and exercise such powers as the Secretary of Defense may prescribe.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id70232d4e-aa92-11e7-bedb-b1289728442e" identifier="/us/usc/t10/s142/c"><num value="c">(c)</num><content> The Chief Information Officer takes precedence in the Department of Defense with the officials serving in positions specified in <ref href="/us/usc/t10/s131/b/4">section 131(b)(4) of this title</ref>. The officials serving in positions specified in section 131(b)(4) and the Chief Information Officer of the Department of Defense take precedence among themselves in the order prescribed by the Secretary of Defense.</content>
