<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id4d36ad3f-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012"><num value="2012">§ 2012.</num><heading> Support and services for eligible organizations and activities outside Department of Defense</heading><subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad40-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/a"><num value="a">(a)</num><heading> <inline class="small-caps">Authority To Provide Services and Support</inline>.—</heading><chapeau>Under regulations prescribed by the Secretary of Defense, the Secretary of a military department may in accordance with this section authorize units or individual members of the armed forces under that Secretary’s jurisdiction to provide support and services to non-Department of Defense organizations and activities specified in subsection (e), but only if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad41-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/a/1"><num value="1">(1)</num><content> such assistance is authorized by a provision of law (other than this section); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad42-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/a/2"><num value="2">(2)</num><content> the provision of such assistance is incidental to military training.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad43-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/b"><num value="b">(b)</num><heading> <inline class="small-caps">Scope of Covered Activities Subject to Section</inline>.—</heading><chapeau>This section does not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad44-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/b/1"><num value="1">(1)</num><content> apply to the provision by the Secretary concerned, under regulations prescribed by the Secretary of Defense, of customary community relations and public affairs activities conducted in accordance with Department of Defense policy; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad45-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/b/2"><num value="2">(2)</num><content> prohibit the Secretary concerned from encouraging members of the armed forces under the Secretary’s jurisdiction to provide volunteer support for community relations activities under regulations prescribed by the Secretary of Defense.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad46-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/c"><num value="c">(c)</num><heading> <inline class="small-caps">Requirement for Specific Request</inline>.—</heading><chapeau>Assistance under subsection (a) may only be provided if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad47-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/c/1"><num value="1">(1)</num><content> the assistance is requested by a responsible official of the organization to which the assistance is to be provided; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad48-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/c/2"><num value="2">(2)</num><content> the assistance is not reasonably available from a commercial entity or (if so available) the official submitting the request for assistance certifies that the commercial entity that would otherwise provide such services has agreed to the provision of such services by the armed forces.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad49-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d"><num value="d">(d)</num><heading> <inline class="small-caps">Relationship to Military Training</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad4a-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1"><num value="1">(1)</num><chapeau> Assistance under subsection (a) may only be provided if the following requirements are met:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4d36ad4b-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1/A"><num value="A">(A)</num><chapeau> The provision of such assistance—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id4d36ad4c-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1/A/i"><num value="i">(i)</num><content> in the case of assistance by a unit, will accomplish valid unit training requirements; and</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id4d36ad4d-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1/A/ii"><num value="ii">(ii)</num><content> in the case of assistance by an individual member, will involve tasks directly related to the specific military occupational specialty of the member.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4d36ad4e-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1/B"><num value="B">(B)</num><content> The provision of such assistance will not adversely affect the quality of training or otherwise interfere with the ability of a member or unit of the armed forces to perform the military functions of the member or unit.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4d36ad4f-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/1/C"><num value="C">(C)</num><content> The provision of such assistance will not result in a significant increase in the cost of the training.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad50-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/d/2"><num value="2">(2)</num><content> Subparagraph (A)(i) of paragraph (1) does not apply in a case in which the assistance to be provided consists primarily of military manpower and the total amount of such assistance in the case of a particular project does not exceed 100 man-hours.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad51-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/e"><num value="e">(e)</num><heading> <inline class="small-caps">Eligible Entities</inline>.—</heading><chapeau>The following organizations and activities are eligible for assistance under this section:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad52-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/e/1"><num value="1">(1)</num><content> Any Federal, regional, State, or local governmental entity.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad53-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/e/2"><num value="2">(2)</num><content> Youth and charitable organizations specified in <ref href="/us/usc/t32/s508">section 508 of title 32</ref>.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad54-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/e/3"><num value="3">(3)</num><content> Owners and operators of critical infrastructure (as such term is defined in <ref href="/us/pl/107/56/s1016/e">section 1016(e) of Public Law 107–56</ref> (<ref href="/us/usc/t42/s5195c/e">42 U.S.C. 5195c(e)</ref>)).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad55-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/e/4"><num value="4">(4)</num><content> Any other entity as may be approved by the Secretary of Defense on a case-by-case basis.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad56-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f"><num value="f">(f)</num><heading> <inline class="small-caps">Regulations</inline>.—</heading><chapeau>The Secretary of Defense shall prescribe regulations governing the provision of assistance under this section. The regulations shall include the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad57-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/1"><num value="1">(1)</num><content> Rules governing the types of assistance that may be provided.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad58-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/2"><num value="2">(2)</num><content> Procedures governing the delivery of assistance that ensure, to the maximum extent practicable, that such assistance is provided in conjunction with, rather than separate from, civilian efforts.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad59-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/3"><num value="3">(3)</num><chapeau> Procedures for appropriate coordination with civilian officials to ensure that the assistance—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4d36ad5a-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/3/A"><num value="A">(A)</num><content> meets a valid need; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4d36ad5b-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/3/B"><num value="B">(B)</num><content> does not duplicate other available public services.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad5c-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/4"><num value="4">(4)</num><content> Procedures to ensure that Department of Defense resources are not applied exclusively to the program receiving the assistance.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad5d-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/f/5"><num value="5">(5)</num><content> Procedures to ensure that assistance provided to an entity specified in subsection (e)(3) is provided in a manner that is consistent with similar assistance provided under authorities applicable to other Federal departments and agencies, including the authorities of the Cybersecurity and Infrastructure Security Agency of the Department of Homeland Security pursuant to title XXII of the Homeland Security Act of 2002 (<ref href="/us/usc/t6/s651">6 U.S.C. 651</ref> et seq.).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad5e-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/g"><num value="g">(g)</num><heading> <inline class="small-caps">Treatment of Member’s Participation in Provision of Support or Services</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad5f-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/g/1"><num value="1">(1)</num><content> The Secretary of a military department may not require or request a member of the armed forces to submit for consideration by a selection board (including a promotion board, command selection board, or any other kind of selection board) evidence of the member’s participation in the provision of support and services to non-Department of Defense organizations and activities under this section or the member’s involvement in, or support of, other community relations and public affairs activities of the armed forces.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad60-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/g/2"><num value="2">(2)</num><content> Paragraph (1) does not prevent a selection board from considering material submitted voluntarily by a member of the armed forces which provides evidence of the participation of that member or another member in activities described in that paragraph.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad61-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/h"><num value="h">(h)</num><heading> <inline class="small-caps">Advisory Councils</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad62-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/h/1"><num value="1">(1)</num><content> The Secretary of Defense shall encourage the establishment of advisory councils at regional, State, and local levels, as appropriate, in order to obtain recommendations and guidance concerning assistance under this section from persons who are knowledgeable about regional, State, and local conditions and needs.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad63-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/h/2"><num value="2">(2)</num><content> The advisory councils should include officials from relevant military organizations, representatives of appropriate local, State, and Federal agencies, representatives of civic and social service organizations, business representatives, and labor representatives.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad64-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/h/3"><num value="3">(3)</num><content> Chapter 10 of title 5 shall not apply to such councils.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad65-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/i"><num value="i">(i)</num><heading> <inline class="small-caps">Construction of Provision</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad66-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/i/1"><num value="1">(1)</num><chapeau> Nothing in this section shall be construed as authorizing—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id4d36ad67-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/i/1/A"><num value="A">(A)</num><content> the use of the armed forces for civilian law enforcement purposes or, except as provided in paragraph (2), for response to natural or manmade disasters; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id4d36ad68-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/i/1/B"><num value="B">(B)</num><content> the use of Department of Defense personnel or resources for any program, project, or activity that is prohibited by law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id4d36ad69-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/i/2"><num value="2">(2)</num><content> Funds available to the Secretary of a military department for operation and maintenance for the Innovative Readiness Training program (as established pursuant to this section) may be expended under this section, upon approval by the Secretary concerned, to assist in demolition, clearing of roads, infrastructure improvements, and military construction to restore an area after a natural disaster.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id4d36ad6a-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j"><num value="j">(j)</num><heading> <inline class="small-caps">Oversight and Cost Accounting</inline>.—</heading><chapeau>The Secretary of Defense shall establish a program to improve the oversight and cost accounting of training projects conducted in accordance with this section. The program shall include measures to accomplish the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad6b-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j/1"><num value="1">(1)</num><content> Ensure that each project that is proposed to be conducted in accordance with this section (regardless of whether additional funding from the Secretary of Defense is sought) is requested in writing, reviewed for full compliance with this section, and approved in advance of initiation by the Secretary of the military department concerned and, in the case of a project that seeks additional funding from the Secretary of Defense, by the Secretary of Defense.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad6c-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j/2"><num value="2">(2)</num><content> Ensure that each project that is conducted in accordance with this section is required to provide, within a specified period following completion of the project, an after-action report to the Secretary of Defense.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad6d-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j/3"><num value="3">(3)</num><content> Require that each application for a project to be conducted in accordance with this section include an analysis and certification that the proposed project would not result in a significant increase in the cost of training (as determined in accordance with procedures prescribed by the Secretary of Defense).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad6e-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j/4"><num value="4">(4)</num><content> Determine the total program cost for each project, including both those costs that are borne by the military departments from their own accounts and those costs that are borne by defense-wide accounts.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id4d36ad6f-cc51-11ee-9616-870a83730f9d" identifier="/us/usc/t10/s2012/j/5"><num value="5">(5)</num><content> Provide for oversight of project execution to ensure that a training project under this section is carried out in accordance with the proposal for that project as approved.</content>

A, title V, § 574</ref>, <date date="1996-02-10">Feb. 10, 1996</date>, <ref href="/us/stat/110/356">110 Stat. 356</ref>, provided that: <quotedContent origin="/us/pl/104/106/dA/tV/s574">“No funds may be obligated or expended after the date of the enactment of this Act [<date date="1996-02-10">Feb. 10, 1996</date>] (1) for the office that as of the date of the enactment of this Act is designated, within the Office of the Assistant Secretary of Defense for Reserve Affairs [now Assistant Secretary of Defense for Manpower and Reserve Affairs], as the Office of Civil-Military Programs, or (2) for any other entity within the Office of the Secretary of Defense that has an exclusive or principal mission of providing centralized direction for activities under <ref href="/us/usc/t10/s2012">section 2012 of title 10</ref>, United States Code, as added by section 572.”</quotedContent>
