</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id82a61aad-9cee-11e3-b26a-9f6497a1b321" identifier="/us/usc/t10/s201/b"><num value="b">(b)</num><heading> <inline class="small-caps">Concurrence in Appointment</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id82a61aae-9cee-11e3-b26a-9f6497a1b321" identifier="/us/usc/t10/s201/b/1"><num value="1">(1)</num><content> In the event of a vacancy in a position referred to in paragraph (2), before appointing an individual to fill the vacancy or recommending to the President an individual to be nominated to fill the vacancy, the Secretary of Defense shall obtain the concurrence of the Director of National Intelligence as provided in section 106(b) of the National Security Act of 1947 (<ref href="/us/usc/t50/s403–6/b">50 U.S.C. 403–6(b)</ref>).<ref class="footnoteRef" idref="fn002013">1</ref><note type="footnote" id="fn002013"><num>1</num> See References in Text note below.</note></content>
