<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idad07c09d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802"><num value="2802">§ 2802.</num><heading> Military construction projects</heading><subsection style="-uslm-lc:I11" class="indent0" id="idad07c09e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/a"><num value="a">(a)</num><content> The Secretary of Defense and the Secretaries of the military departments may carry out such military construction projects, land acquisitions, and defense access road projects (as described under <ref href="/us/usc/t23/s210">section 210 of title 23</ref>) as are authorized by law.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idad07c09f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b"><num value="b">(b)</num><chapeau> Authority provided by law to carry out a military construction project includes authority for—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idad07c0a0-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b/1"><num value="1">(1)</num><content> surveys and site preparation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad07c0a1-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b/2"><num value="2">(2)</num><content> acquisition, conversion, rehabilitation, and installation of facilities;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad07c0a2-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b/3"><num value="3">(3)</num><content> acquisition and installation of equipment and appurtenances integral to the project;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad07c0a3-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b/4"><num value="4">(4)</num><content> acquisition and installation of supporting facilities (including utilities) and appurtenances incident to the project; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idad07c0a4-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/b/5"><num value="5">(5)</num><content> planning, supervision, administration, and overhead incident to the project.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idad07c0a5-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/c"><num value="c">(c)</num><content> In determining the scope of a proposed military construction project, the Secretary concerned shall submit to the President such recommendations as the Secretary considers to be appropriate regarding the incorporation and inclusion of life-cycle cost-effective practices as an element in the project documents submitted to Congress in connection with the budget submitted pursuant to <ref href="/us/usc/t31/s1105">section 1105 of title 31</ref> for the fiscal year in which a contract is proposed to be awarded for the project.</content>
</subsection>

<subsection style="-uslm-lc:I11" class="indent0" id="idad07c0a7-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e"><num value="e">(e)</num><paragraph style="-uslm-lc:I11" class="indent0" id="idad07c0a8-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/1"><num value="1">(1)</num><chapeau> If a construction project, land acquisition, or defense access road project described in paragraph (2) will be carried out pursuant to a provision of law other than a Military Construction Authorization Act, the Secretary concerned shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idad07c0a9-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/1/A"><num value="A">(A)</num><content> comply with the congressional notification requirement contained in the provision of law under which the construction project, land acquisition, or defense access road project will be carried out; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idad07c0aa-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/1/B"><num value="B">(B)</num><content> in the absence of such a congressional notification requirement, submit to the congressional defense committees, in an electronic medium pursuant to <ref href="/us/usc/t10/s480">section 480 of this title</ref>, a report describing the construction project, land acquisition, or defense access road project at least 15 days before commencing the construction project, land acquisition, or defense access road project.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idad07c0ab-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/2"><num value="2">(2)</num><chapeau> Except as provided in paragraph (3), a construction project, land acquisition, or defense access road project subject to the notification requirement imposed by paragraph (1) is a construction project, land acquisition, or defense access road project that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idad07c0ac-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/2/A"><num value="A">(A)</num><content> is not specifically authorized in a Military Construction Authorization Act;</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="idad07c0af-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s2802/e/3"><num value="3">(3)</num><content> This subsection does not apply to a construction project, land acquisition, or defense access road project described in paragraph (2) whose cost is less than or equal to the threshold amount specified in <ref href="/us/usc/t10/s2805/b">section 2805(b) of this title</ref>.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Unified Construction Standard for Military Construction and Repairs to Military Medical Centers</inline>.—</heading><chapeau>Not later than 180 days after the date of the enactment of this Act [<date date="2011-01-07">Jan. 7, 2011</date>], the Secretary of Defense shall establish a unified construction standard for military construction and repairs for military medical centers that provides a single standard of care. This standard shall also include—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> size standards for operating rooms and patient recovery rooms; and</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> Independent Review Panel.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Establishment; purpose</inline>.—</heading><chapeau>The Secretary of Defense shall establish an independent advisory panel for the purpose of—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> reviewing the unified construction standards established pursuant to subsection (a) to determine the standards consistency with industry practices and benchmarks for world class medical construction;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> reviewing ongoing construction programs within the Department of Defense to ensure medical construction standards are uniformly applied across applicable military medical centers;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><chapeau> assessing the approach of the Department of Defense approach to planning and programming facility improvements with specific emphasis on—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> facility selection criteria and proportional assessment system; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> facility programming responsibilities between the Assistant Secretary of Defense for Health Affairs and the Secretaries of the military departments;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> assessing whether the Comprehensive Master Plan for the National Capital Region Medical, dated April 2010, is adequate to fulfill statutory requirements, as required by section 2714 of the Military Construction Authorization Act for Fiscal Year 2010 (division B of <ref href="/us/pl/111/84">Public Law 111–84</ref>; <ref href="/us/stat/123/2656">123 Stat. 2656</ref>), to ensure that the facilities and organizational structure described in the plan result in world class military medical centers in the National Capital Region; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> making recommendations regarding any adjustments of the master plan referred to in subparagraph (D) that are needed to ensure the provision of world class military medical centers and delivery system in the National Capital Region.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> Members.—</heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">Appointments by secretary</inline>.—</heading><chapeau>The panel shall be composed of such members as determined by the Secretary of Defense, except that the Secretary shall include as members—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> medical facility design experts;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> military healthcare professionals;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> representatives of premier health care centers in the United States; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> former retired senior military officers with joint operational and budgetary experience.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Congressional appointments</inline>.—</heading><content>The chairmen and ranking members of the Committees on the Armed Services of the Senate and House of Representatives may each designate one member of the panel.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><heading> <inline class="small-caps">Term</inline>.—</heading><content>Members of the panel may serve on the panel until the termination date specified in paragraph (7).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><heading> <inline class="small-caps">Compensation</inline>.—</heading><content>While performing duties on behalf of the panel, a member and any adviser referred to in paragraph (4) shall be reimbursed under Government travel regulations for necessary travel expenses.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Meetings</inline>.—</heading><content>The panel shall meet not less than quarterly. The panel or its members may make other visits to military treatment centers and military headquarters in connection with the duties of the panel.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Staff and advisors</inline>.—</heading><content>The Secretary of Defense shall provide necessary administrative staff support to the panel. The panel may call in advisers for consultation.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> Reports.—</heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">Initial report</inline>.—</heading><chapeau>Not later than 120 days after the first meeting of the panel, the panel shall submit to the Secretary of Defense a written report containing—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> an assessment of the adequacy of the plan of the Department of Defense to address the items specified in subparagraphs (A) through (E) of paragraph (1) relating to the purposes of the panel; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> the recommendations of the panel to improve the plan.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Additional reports</inline>.—</heading><content>Not later than <date date="2011-02-01">February 1, 2011</date>, and each February 1 thereafter until termination of the panel, the panel shall submit to the Secretary of Defense a report on the findings and recommendations of the panel to address any deficiencies identified by the panel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><heading> <inline class="small-caps">Assessment of recommendations</inline>.—</heading><chapeau>Not later than 30 days after the date of the submission of each report under paragraph (5), the Secretary of Defense shall submit to the congressional defense committees [Committees on Armed Services and Appropriations of the Senate and the House of Representatives] a report including—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a copy of the panel’s assessment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> an assessment by the Secretary of the findings and recommendations of the panel; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> the plans of the Secretary for addressing such findings and recommendations.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><heading> <inline class="small-caps">Termination</inline>.—</heading><content>The panel shall terminate on <date date="2015-09-30">September 30, 2015</date>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">National capital region</inline>.—</heading><content>The term ‘National Capital Region’ has the meaning given the term in <ref href="/us/usc/t10/s2674/f">section 2674(f) of title 10</ref>, United States Code.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">World class military medical center</inline>.—</heading><content>The term ‘world class military medical center’ has the meaning given the term ‘world class military medical facility’ by the National Capital Region Base Realignment and Closure Health Systems Advisory Subcommittee of the Defense Health Board in appendix B of the report titled ‘Achieving World Class—An Independent Review of the Design Plans for the Walter Reed National Military Medical Center and the Fort Belvoir Community Hospital’ and published in May 2009, as required by section 2721 of the Military Construction Authorization Act for Fiscal Year 2009 (division B of <ref href="/us/pl/110/417">Public Law 110–417</ref>; <ref href="/us/stat/122/4716">122 Stat. 4716</ref>).”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Assessment of Damage and Prevention and Mitigation Technology</inline>.—</heading><chapeau>The Secretary of Defense shall require the Secretaries of the military departments to assess—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the damage caused to aviation facilities of the Armed Forces by alkali silica reactivity; and</content>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Evaluation of Technologies</inline>.—</heading><paragraph style="-uslm-lc:I21" class="indent0"><num value="1">(1)</num><content> Taking into consideration the assessment under subsection (a), the Secretary of each military department may conduct a demonstration project at a location selected by the Secretary concerned to test and evaluate the effectiveness of technologies intended to prevent, treat, or mitigate alkali silica reactivity in hardened concrete structures and pavements.</content>
</paragraph>
<paragraph style="-uslm-lc:I21" class="indent0"><num value="2">“(2)</num><content> The Secretary of Defense shall ensure that the locations selected for the demonstration projects represent the diverse operating environments of the Armed Forces.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">New Construction</inline>.—</heading><content>The Secretary of Defense shall develop specific guidelines for appropriate testing and use of lithium salts to prevent alkali silica reactivity in new construction of the Department of Defense.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Completion of Assessment and Demonstration</inline>.—</heading><content>The assessment conducted under subsection (a) and the demonstration projects, if any, conducted under subsection (b) shall be completed not later than <date date="2006-09-30">September 30, 2006</date>.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Delegation of Authority</inline>.—</heading><content>The authority to conduct the assessment under subsection (a) may be delegated only to the Chief of Engineers of the Army, the Commander of the Naval Facilities Engineering Command, and the Civil Engineer of the Air Force.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Limitation on Expenditures</inline>.—</heading><content>The Secretary of Defense and the Secretaries of the military departments may not expend more than a total of $5,000,000 to conduct both the assessment under subsection (a) and all of the demonstration projects under subsection (b).”</content>
