<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id06ec0f7f-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652"><num value="652">§ 652.</num><heading> Notice to Congress of proposed changes in units, assignments, etc. to which female members may be assigned</heading><subsection style="-uslm-lc:I11" class="indent0" id="id06ec0f80-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a"><num value="a">(a)</num><heading> <inline class="small-caps">Rule for Ground Combat Personnel Policy</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id06ec0f81-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/1"><num value="1">(1)</num><content> If the Secretary of Defense proposes to make any change described in paragraph (2)(A) or (2)(B) to the ground combat exclusion policy or proposes to make a change described in paragraph (2)(C), the Secretary shall, not less than 30 calendar days before such change is implemented, submit to Congress a report providing notice of the proposed change.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id06ec0f82-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/2"><num value="2">(2)</num><chapeau> A change referred to in paragraph (1) is a change that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec0f83-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/2/A"><num value="A">(A)</num><content> closes to female members of the armed forces any category of unit or position that at that time is open to service by such members;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec0f84-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/2/B"><num value="B">(B)</num><content> opens to service by female members of the armed forces any category of unit or position that at that time is closed to service by such members; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec0f85-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/2/C"><num value="C">(C)</num><content> opens or closes to the assignment of female members of the armed forces any military career designator as described in paragraph (6).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id06ec0f86-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/3"><num value="3">(3)</num><chapeau> The Secretary shall include in any report under paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec0f87-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/3/A"><num value="A">(A)</num><content> a detailed description of, and justification for, the proposed change; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec0f88-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/3/B"><num value="B">(B)</num><content> a detailed analysis of legal implication of the proposed change with respect to the constitutionality of the application of the Military Selective Service Act (50 App. U.S.C. 451 et seq.) <ref class="footnoteRef" idref="fn002045">1</ref><note type="footnote" id="fn002045"><num>1</num> See References in Text note below.</note> to males only.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id06ec0f89-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/4"><num value="4">(4)</num><content> In this subsection, the term “ground combat exclusion policy” means the military personnel policies of the Department of Defense and the military departments, as in effect on <date date="1994-10-01">October 1, 1994</date>, by which female members of the armed forces are restricted from assignment to units and positions below brigade level whose primary mission is to engage in direct combat on the ground.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id06ec369b-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/6"><num value="6">(6)</num><chapeau> For purposes of this subsection, a military career designator is one that is related to military operations on the ground as of <date date="2005-05-18">May 18, 2005</date>, and applies—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec369c-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/6/A"><num value="A">(A)</num><content> for enlisted members and warrant officers, to military occupational specialties, specialty codes, enlisted designators, enlisted classification codes, additional skill identifiers, and special qualification identifiers; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec369d-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/a/6/B"><num value="B">(B)</num><content> for officers (other than warrant officers), to officer areas of concentration, occupational specialties, specialty codes, designators, additional skill identifiers, and special qualification identifiers.</content>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id06ec369e-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/b"><num value="b">(b)</num><heading> <inline class="small-caps">Other Personnel Policy Changes</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id06ec369f-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/b/1"><num value="1">(1)</num><content> Except in a case covered by <ref href="/us/usc/t10/s8225">section 8225 of this title</ref> or by subsection (a), whenever the Secretary of Defense proposes to make a change to military personnel policies described in paragraph (2), the Secretary shall, not less than 30 calendar days before such change is implemented, submit to the Committee on Armed Services of the Senate and the Committee on Armed Services of the House of Representatives notice, in writing, of the proposed change.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id06ec36a0-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/b/2"><num value="2">(2)</num><chapeau> Paragraph (1) applies to a proposed military personnel policy change, other than a policy change covered by subsection (a), that would make available to female members of the armed forces assignment to any of the following that, as of the date of the proposed change, is closed to such assignment:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec36a1-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/b/2/A"><num value="A">(A)</num><content> Any type of unit not covered by subsection (a).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id06ec36a2-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s652/b/2/B"><num value="B">(B)</num><content> Any class of combat vessel.</content>
</subparagraph>
