Persons subject to this chapter</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541c90-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a\"><num value=\"a\">(a)</num><chapeau> The following persons are subject to this chapter:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c91-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/1\"><num value=\"1\">(1)</num><content> Members of a regular component of the armed forces, including those awaiting discharge after expiration of their terms of enlistment; volunteers from the time of their muster or acceptance into the armed forces; inductees from the time of their actual induction into the armed forces; and other persons lawfully called or ordered into, or to duty in or for training in, the armed forces, from the dates when they are required by the terms of the call or order to obey it.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c92-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/2\"><num value=\"2\">(2)</num><content> Cadets, aviation cadets, and midshipmen.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c93-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/3\"><num value=\"3\">(3)</num><content> Members of a reserve component while on inactive-duty training, but in the case of members of the Army National Guard of the United States or the Air National Guard of the United States only when in Federal service.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c94-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/4\"><num value=\"4\">(4)</num><content> Retired members of a regular component of the armed forces who are entitled to pay.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c95-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/5\"><num value=\"5\">(5)</num><content> Retired members of a reserve component who are receiving hospitalization from an armed force.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c96-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/6\"><num value=\"6\">(6)</num><content> Members of the Fleet Reserve and Fleet Marine Corps Reserve.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c97-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/7\"><num value=\"7\">(7)</num><content> Persons in custody of the armed forces serving a sentence imposed by a court-martial.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c98-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/8\"><num value=\"8\">(8)</num><content> Members of the National Oceanic and Atmospheric Administration, Public Health Service, and other organizations, when assigned to and serving with the armed forces.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c99-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/9\"><num value=\"9\">(9)</num><content> Prisoners of war in custody of the armed forces.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c9a-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/10\"><num value=\"10\">(10)</num><content> In time of declared war or a contingency operation, persons serving with or accompanying an armed force in the field.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c9b-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/11\"><num value=\"11\">(11)</num><content> Subject to any treaty or agreement to which the United States is or may be a party or to any accepted rule of international law, persons serving with, employed by, or accompanying the armed forces outside the United States and outside the Commonwealth of Puerto Rico, Guam, and the Virgin Islands.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c9c-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/12\"><num value=\"12\">(12)</num><content> Subject to any treaty or agreement to which the United States is or may be a party or to any accepted rule of international law, persons within an area leased by or otherwise reserved or acquired for the use of the United States which is under the control of the Secretary concerned and which is outside the United States and outside the Commonwealth of Puerto Rico, Guam, and the Virgin Islands.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541c9d-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/a/13\"><num value=\"13\">(13)</num><content> Individuals belonging to one of the eight categories enumerated in Article 4 of the Convention Relative to the Treatment of Prisoners of War, done at Geneva <date date=\"1949-08-12\">August 12, 1949</date> (6 UST 3316), who violate the law of war.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541c9e-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/b\"><num value=\"b\">(b)</num><content> The voluntary enlistment of any person who has the capacity to understand the significance of enlisting in the armed forces shall be valid for purposes of jurisdiction under subsection (a) and a change of status from civilian to member of the armed forces shall be effective upon the taking of the oath of enlistment.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541c9f-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/c\"><num value=\"c\">(c)</num><chapeau> Notwithstanding any other provision of law, a person serving with an armed force who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca0-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/c/1\"><num value=\"1\">(1)</num><content> submitted voluntarily to military authority;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca1-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/c/2\"><num value=\"2\">(2)</num><content> met the mental competency and minimum age qualifications of sections 504 and 505 of this title at the time of voluntary submission to military authority;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca2-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/c/3\"><num value=\"3\">(3)</num><content> received military pay or allowances; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca3-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/c/4\"><num value=\"4\">(4)</num><content> performed military duties;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">is subject to this chapter until such person’s active service has been terminated in accordance with law or regulations promulgated by the Secretary concerned.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541ca4-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d\"><num value=\"d\">(d)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541ca5-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/1\"><num value=\"1\">(1)</num><chapeau> A member of a reserve component who is not on active duty and who is made the subject of proceedings under section 815 (article 15) or section 830 (article 30) with respect to an offense against this chapter may be ordered to active duty involuntarily for the purpose of—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca6-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/1/A\"><num value=\"A\">(A)</num><content> a preliminary hearing under <ref href=\"/us/usc/t10/s832\">section 832 of this title</ref> (article 32);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca7-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/1/B\"><num value=\"B\">(B)</num><content> trial by court-martial; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541ca8-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/1/C\"><num value=\"C\">(C)</num><content> nonjudicial punishment under <ref href=\"/us/usc/t10/s815\">section 815 of this title</ref> (article 15).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541ca9-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/2\"><num value=\"2\">(2)</num><chapeau> A member of a reserve component may not be ordered to active duty under paragraph (1) except with respect to an offense committed while the member was—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541caa-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/2/A\"><num value=\"A\">(A)</num><content> on active duty; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541cab-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/2/B\"><num value=\"B\">(B)</num><content> on inactive-duty training, but in the case of members of the Army National Guard of the United States or the Air National Guard of the United States only when in Federal service.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541cac-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/3\"><num value=\"3\">(3)</num><content> Authority to order a member to active duty under paragraph (1) shall be exercised under regulations prescribed by the President.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541cad-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/4\"><num value=\"4\">(4)</num><content> A member may be ordered to active duty under paragraph (1) only by a person empowered to convene general courts-martial in a regular component of the armed forces.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541cae-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/5\"><num value=\"5\">(5)</num><chapeau> A member ordered to active duty under paragraph (1), unless the order to active duty was approved by the Secretary concerned, may not—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541caf-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/5/A\"><num value=\"A\">(A)</num><content> be sentenced to confinement; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab541cb0-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/d/5/B\"><num value=\"B\">(B)</num><content> be required to serve a punishment consisting of any restriction on liberty during a period other than a period of inactive-duty training or active duty (other than active duty ordered under paragraph (1)).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab541cb1-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s802/e\"><num value=\"e\">(e)</num><content> The provisions of this section are subject to <ref href=\"/us/usc/t10/s876b/d/2\">section 876b(d)(2) of this title</ref> (article No. 13286, § 76, <date date=\"2003-02-28\">Feb. 28, 2003</date>, 68 F.R. 106231, provided:</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">By virtue of the authority vested in me as President of the United States, and as Commander in Chief of the armed forces of the United States, I hereby prescribe the Code of Conduct for Members of the Armed Forces of the United States which is attached to this order and hereby made a part thereof.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">All members of the Armed Forces of the United States are expected to measure up to the standards embodied in this Code of Conduct while in combat or in captivity. To ensure achievement of these standards, members of the armed forces liable to capture shall be provided with specific training and instruction designed to better equip them to counter and withstand all enemy efforts against them, and shall be fully instructed as to the behavior and obligations expected of them during combat or captivity.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">The Secretary of Defense (and the Secretary of Homeland Security with respect to the Coast Guard except when it is serving as part of the Navy) shall take such action as is deemed necessary to implement this order and to disseminate and make the said Code known to all members of the armed forces of the United States.</p>\n</note>\n<note style=\"-uslm-lc:I86\" topic=\"miscellaneous\" id=\"idab541cc3-0381-11e7-b712-ff538fc5bb63\">\n<heading class=\"centered smallCaps\">Code of Conduct for Members of the United States Armed Forces</heading>\n</note>\n<note style=\"-uslm-lc:I71\" topic=\"miscellaneous\" id=\"idab541cc4-0381-11e7-b712-ff538fc5bb63\"><heading class=\"centered\">I</heading><p style=\"-uslm-lc:I21\" class=\"indent0\">I am an American, fighting in the forces which guard my country and our way of life.
