Courts-martial classified</heading>
<chapeau style="-uslm-lc:I11" class="indent0">The three kinds of courts-martial in each of the armed forces are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab568d99-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/1"><num value="1">(1)</num><chapeau> general courts-martial, consisting of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab568d9a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/1/A"><num value="A">(A)</num><content> a military judge and not less than five members or, in a case in which the accused may be sentenced to a penalty of death, the number of members determined under <ref href="/us/usc/t10/s825a">section 825a of this title</ref> (article 25a); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab568d9b-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/1/B"><num value="B">(B)</num><content> only a military judge, if before the court is assembled the accused, knowing the identity of the military judge and after consultation with defense counsel, requests orally on the record or in writing a court composed only of a military judge and the military judge approves;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idab568d9c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/2"><num value="2">(2)</num><chapeau> special courts-martial, consisting of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idab568d9d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/2/A"><num value="A">(A)</num><content> not less than three members; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab568d9e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/2/B"><num value="B">(B)</num><content> a military judge and not less than three members; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idab568d9f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s816/2/C"><num value="C">(C)</num><content> only a military judge, if one has been detailed to the court, and the accused under the same conditions as those prescribed in clause (1)(B) so requests; and</content>

<p style="-uslm-lc:I68" class="indent2 firstIndent-2 fontsize8 italic">§ 816. Art 16. Courts-martial classified</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) <inline class="small-caps">In General</inline>.—The three kinds of courts-martial in each of the armed forces are the following:</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) General courts-martial, as described in subsection (b).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) Special courts-martial, as described in subsection (c).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(3) Summary courts-martial, as described in subsection (d).</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) <inline class="small-caps">General Courts-martial</inline>.—General courts-martial are of the following three types:</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) A general court-martial consisting of a military judge and eight members, subject to sections 825(d)(3) and 829 of this title (articles 25(d)(3) and 29).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) In a capital case, a general court-martial consisting of a military judge and the number of members determined under <ref href="/us/usc/t10/s825a">section 825a of this title</ref> (article 25a), subject to sections 825(d)(3) and 829 of this title (articles 25(d)(3) and 29).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(3) A general court-martial consisting of a military judge alone, if, before the court is assembled, the accused, knowing the identity of the military judge and after consultation with defense counsel, requests, orally on the record or in writing, a court composed of a military judge alone and the military judge approves the request.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(c) <inline class="small-caps">Special Courts-martial</inline>.—Special courts-martial are of the following two types:</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) A special court-martial consisting of a military judge and four members, subject to sections 825(d)(3) and 829 of this title (articles 25(d)(3) and 29).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) A special court-martial consisting of a military judge alone—</p>
<p style="-uslm-lc:I13" class="indent2 fontsize8">(A) if the case is so referred by the convening authority, subject to <ref href="/us/usc/t10/s819">section 819 of this title</ref> (article 19) and such limitations as the President may prescribe by regulation; or</p>
<p style="-uslm-lc:I13" class="indent2 fontsize8">(B) if the case is referred under paragraph (1) and, before the court is assembled, the accused, knowing the identity of the military judge and after consultation with defense counsel, requests, orally on the record or in writing, a court composed of a military judge alone and the military judge approves the request.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(d) <inline class="small-caps">Summary Court-martial</inline>.—A summary court-martial consists of one commissioned officer.</p>
