Detail of trial counsel and defense counsel</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13d2a0f8-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s827/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13d2a0f9-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s827/a/1"><num value="1">(1)</num><content> Trial counsel and defense counsel shall be detailed for each general and special court-martial. Assistant trial counsel and assistant and associate defense counsel may be detailed for each general and special court-martial. The Secretary concerned shall prescribe regulations providing for the manner in which counsel are detailed for such courts-martial and for the persons who are authorized to detail counsel for such courts-martial.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id13d2a0fe-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s827/c"><num value="c">(c)</num><chapeau> In the case of a special court-martial—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13d2a0ff-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s827/c/1"><num value="1">(1)</num><content> the accused shall be afforded the opportunity to be represented at the trial by counsel having the qualifications prescribed under <ref href="/us/usc/t10/s827/b">section 827(b) of this title</ref> (article 27(b)) unless counsel having such qualifications cannot be obtained on account of physical conditions or military exigencies. If counsel having such qualifications cannot be obtained, the court may be convened and the trial held but the convening authority shall make a detailed written statement, to be appended to the record, stating why counsel with such qualifications could not be obtained;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13d2a100-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s827/c/2"><num value="2">(2)</num><content> if the trial counsel is qualified to act as counsel before a general court-martial, the defense counsel detailed by the convening authority must be a person similarly qualified; and</content>

<p style="-uslm-lc:I11" class="indent0 fontsize8">(a)(1) Trial counsel and defense counsel shall be detailed for each general and special court-martial. Assistant trial counsel and assistant and associate defense counsel may be detailed for each general and special court-martial. The Secretary concerned shall prescribe regulations providing for the manner in which counsel are detailed for such courts-martial and for the persons who are authorized to detail counsel for such courts-martial.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(2) No person who, with respect to a case, has served as a preliminary hearing officer, court member, military judge, military magistrate, or appellate judge, may later serve as trial counsel, assistant trial counsel, or, unless expressly requested by the accused, as defense counsel or assistant or associate defense counsel in the same case. No person who has acted for the prosecution may act later in the same case for the defense, nor may any person who has acted for the defense act later in the same case for the prosecution.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) Trial counsel, defense counsel, or assistant defense counsel detailed for a general court-martial—</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) must be a judge advocate who is a graduate of an accredited law school or is a member of the bar of a Federal court or of the highest court of a State; or must be a member of the bar of a Federal court or of the highest court of a State; and</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) must be certified as competent to perform such duties by the Judge Advocate General of the armed force of which he is a member.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(c)(1) Defense counsel and assistant defense counsel detailed for a special court-martial shall have the qualifications set forth in subsection (b).</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(2) Trial counsel and assistant trial counsel detailed for a special court-martial and assistant trial counsel detailed for a general court-martial must be determined to be competent to perform such duties by the Judge Advocate General, under such rules as the President may prescribe.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(d) To the greatest extent practicable, in any capital case, at least one defense counsel shall, as determined by the Judge Advocate General, be learned in the law applicable to such cases. If necessary, this counsel may be a civilian and, if so, may be compensated in accordance with regulations prescribed by the Secretary of Defense.</p>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Military Justice Experience Designators or Skill Identifiers</inline>.—</heading><content>The Secretary concerned shall establish and use a system of military justice experience designators or skill identifiers for purposes of identifying judge advocates with skill and experience in military justice proceedings in order to ensure that judge advocates with experience and skills identified through such experience designators or skill identifiers are assigned to develop less experienced judge advocates in the prosecution and defense in courts-martial under a program carried out pursuant to subsection (a).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> Pilot Programs on Professional Developmental Process for Judge Advocates.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Purpose</inline>.—</heading><content>The Secretary concerned shall carry out a pilot program to assess the feasibility and advisability of establishing a deliberate professional developmental process for judge advocates under the jurisdiction of the Secretary that leads to judge advocates with military justice expertise serving as military justice practitioners capable of prosecuting and defending complex cases in military courts-martial.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Additional matters</inline>.—</heading><content>A pilot program may also assess such other matters related to professional military justice development for judge advocates as the Secretary concerned considers appropriate.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Duration</inline>.—</heading><content>Each pilot program shall be for a period of five years.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Report</inline>.—</heading><chapeau>Not later than four years after the date of the enactment of this Act [<date date="2016-12-23">Dec. 23, 2016</date>], the Secretary concerned shall submit to the Committees on Armed Services of the Senate and the House of Representatives a report on the pilot programs conducted under this section. The report shall include the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> A description and assessment of each pilot program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> Such recommendations as the Secretary considers appropriate in light of the pilot programs, including whether any pilot program should be extended or made permanent.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Secretary Concerned Defined</inline>.—</heading><content>In this section, the term ‘Secretary concerned’ has the meaning given that term in <ref href="/us/usc/t10/s101/a/9">section 101(a)(9) of title 10</ref>, United States Code.”</content>
