<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab5b485d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a"><num value="830a">§ 830a.</num><heading> Art. 30a. Certain proceedings conducted before referral</heading><subsection style="-uslm-lc:I11" class="indent0" id="idab5b485e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idab5b485f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/1"><num value="1">(1)</num><chapeau> Proceedings may be conducted to review the following matters before referral of charges and specifications to court-martial for trial in accordance with regulations prescribed by the President:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idab5b4860-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/1/A"><num value="A">(A)</num><content> Pre-referral investigative subpoenas.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab5b4861-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/1/B"><num value="B">(B)</num><content> Pre-referral warrants or orders for electronic communications.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab5b4862-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/1/C"><num value="C">(C)</num><content> Pre-referral matters referred by an appellate court.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="idab5b4863-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/2"><num value="2">(2)</num><chapeau> The regulations prescribed under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idab5b4864-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/2/A"><num value="A">(A)</num><content> include procedures for the review of such rulings that may be ordered under this section as the President considers appropriate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab5b4865-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/2/B"><num value="B">(B)</num><content> provide such limitations on the relief that may be ordered under this section as the President considers appropriate.</content>
</subparagraph>

<paragraph style="-uslm-lc:I11" class="indent0" id="idab5b4866-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/a/3"><num value="3">(3)</num><content> If any matter in a proceeding under this section becomes a subject at issue with respect to charges that have been referred to a general or special court-martial, the matter shall be transferred to the military judge detailed to the court-martial.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab5b4867-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/b"><num value="b">(b)</num><heading> <inline class="small-caps">Detail of Military Judge</inline>.—</heading><content>The Secretary concerned shall prescribe regulations providing for the manner in which military judges are detailed to proceedings under subsection (a)(1).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab5b4868-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s830a/c"><num value="c">(c)</num><heading> <inline class="small-caps">Discretion to Designate Magistrate to Preside</inline>.—</heading><content>In accordance with regulations prescribed by the Secretary concerned, a military judge detailed to a proceeding under subsection (a)(1), other than a proceeding described in subparagraph (B) of that subsection, may designate a military magistrate to preside over the proceeding.</content>
