<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab5b489e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834"><num value="834">§ 834.</num><heading> Art. 34. Advice of staff judge advocate and reference for trial</heading><subsection style="-uslm-lc:I11" class="indent0" id="idab5b489f-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/a"><num value="a">(a)</num><chapeau> Before directing the trial of any charge by general court-martial, the convening authority shall refer it to his staff judge advocate for consideration and advice. The convening authority may not refer a specification under a charge to a general court-martial for trial unless he has been advised in writing by the staff judge advocate that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab5b48a0-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/a/1"><num value="1">(1)</num><content> the specification alleges an offense under this chapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab5b48a1-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/a/2"><num value="2">(2)</num><content> the specification is warranted by the evidence indicated in the report of a preliminary hearing under <ref href="/us/usc/t10/s832">section 832 of this title</ref> (article 32) (if there is such a report); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab5b48a2-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/a/3"><num value="3">(3)</num><content> a court-martial would have jurisdiction over the accused and the offense.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab5b48a3-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/b"><num value="b">(b)</num><chapeau> The advice of the staff judge advocate under subsection (a) with respect to a specification under a charge shall include a written and signed statement by the staff judge advocate—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab5b48a4-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/b/1"><num value="1">(1)</num><content> expressing his conclusions with respect to each matter set forth in subsection (a); and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab5b48a5-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/b/2"><num value="2">(2)</num><content> recommending action that the convening authority take regarding the specification.</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">If the specification is referred for trial, the recommendation of the staff judge advocate shall accompany the specification.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab5b48a6-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s834/c"><num value="c">(c)</num><content> If the charges or specifications are not formally correct or do not conform to the substance of the evidence contained in the report of the investigating officer, formal corrections, and such changes in the charges and specifications as are needed to make them conform to the evidence, may be made.</content>

<p style="-uslm-lc:I68" class="indent2 firstIndent-2 fontsize8 italic">§ 834. Art. 34. Advice to convening authority before referral for trial</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) <inline class="small-caps">General Court-martial.—</inline></p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) <inline class="small-caps">Staff judge advocate advice required before referral</inline>.—Before referral of charges and specifications to a general court-martial for trial, the convening authority shall submit the matter to the staff judge advocate for advice, which the staff judge advocate shall provide to the convening authority in writing. The convening authority may not refer a specification under a charge to a general court-martial unless the staff judge advocate advises the convening authority in writing that—</p>
<p style="-uslm-lc:I13" class="indent2 fontsize8">(A) the specification alleges an offense under this chapter;</p>
<p style="-uslm-lc:I13" class="indent2 fontsize8">(B) there is probable cause to believe that the accused committed the offense charged; and</p>
<p style="-uslm-lc:I13" class="indent2 fontsize8">(C) a court-martial would have jurisdiction over the accused and the offense.</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) <inline class="small-caps">Staff judge advocate recommendation as to disposition</inline>.—Together with the written advice provided under paragraph (1), the staff judge advocate shall provide a written recommendation to the convening authority as to the disposition that should be made of the specification in the interest of justice and discipline.</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(3) <inline class="small-caps">Staff judge advocate advice and recommendation to accompany referral</inline>.—When a convening authority makes a referral for trial by general court-martial, the written advice of the staff judge advocate under paragraph (1) and the written recommendation of the staff judge advocate under paragraph (2) with respect to each specification shall accompany the referral.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) <inline class="small-caps">Special Court-martial; Convening Authority Consultation With Judge Advocate</inline>.—Before referral of charges and specifications to a special court-martial for trial, the convening authority shall consult a judge advocate on relevant legal issues.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(c) <inline class="small-caps">General and Special Courts-martial; Correction of Charges and Specifications Before Referral</inline>.—Before referral for trial by general court-martial or special court-martial, changes may be made to charges and specifications—</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) to correct errors in form; and</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) when applicable, to conform to the substance of the evidence contained in a report under <ref href="/us/usc/t10/s832/c">section 832(c) of this title</ref> (article 32(c)).</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(d) <inline class="small-caps">Referral Defined</inline>.—In this section, the term “referral” means the order of a convening authority that charges and specifications against an accused be tried by a specified court-martial.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Specific review requirements</inline>.—</heading><chapeau>As part of a review conducted pursuant to paragraph (1), the Secretary of a military department shall require that—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> consideration be given to the victim’s statement provided during the course of the criminal investigation regarding the alleged sex-related offense perpetrated against the victim; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> a determination be made whether the victim’s statement and views concerning disposition of the alleged sex-related offense were considered by the convening authority in making the referral decision.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Sex-related Offense Defined</inline>.—</heading><chapeau>In this section, the term ‘sex-related offense’ means any of the following:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> Rape or sexual assault under subsection (a) or (b) of <ref href="/us/usc/t10/s920">section 920 of title 10</ref>, United States Code (article 120 of the Uniform Code of Military Justice).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> Forcible sodomy under section 925 of such title (article 125 of the Uniform Code of Military Justice).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> An attempt to commit an offense specified in paragraph (1) or (2) as punishable under section 880 of such title (article 80 of the Uniform Code of Military Justice).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> Review of Certain Cases Not Referred to Court-martial.—</heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Cases not referred following staff judge advocate recommendation for referral for trial</inline>.—</heading><content>In any case where a staff judge advocate, pursuant to <ref href="/us/usc/t10/s834">section 834 of title 10</ref>, United States Code (article 34 of the Uniform Code of Military Justice), recommends that charges of a sex-related offense be referred for trial by court-martial and the convening authority decides not to refer any charges to a court-martial, the convening authority shall forward the case file to the Secretary of the military department concerned for review as a superior authorized to exercise general court-martial convening authority.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> Cases not referred by convening authority upon request for review by chief prosecutor.—</heading><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>In any case where a convening authority decides not to refer a charge of a sex-related offense to trial by court-martial, the Secretary of the military department concerned shall review the decision as a superior authority authorized to exercise general court-martial convening authority if the chief prosecutor of the Armed Force concerned, in response to a request by the detailed counsel for the Government, requests review of the decision by the Secretary.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><heading> <inline class="small-caps">Chief prosecutor defined</inline>.—</heading><content>In this paragraph, the term ‘chief prosecutor’ means the chief prosecutor or equivalent position of an Armed Force, or, if an Armed Force does not have a chief prosecutor or equivalent position, such other trial counsel as shall be designated by the Judge Advocate General of that Armed Force, or in the case of the Marine Corps, the Staff Judge Advocate to the Commandant of the Marine Corps.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Review of Cases Not Referred to Court-martial Following Staff Judge Advocate Recommendation Not to Refer for Trial</inline>.—</heading><content>In any case where a staff judge advocate, pursuant to <ref href="/us/usc/t10/s834">section 834 of title 10</ref>, United States Code (article 34 of the Uniform Code of Military Justice), recommends that charges of a sex-related offense should not be referred for trial by court-martial and the convening authority decides not to refer any charges to a court-martial, the convening authority shall forward the case file for review to the next superior commander authorized to exercise general court-martial convening authority.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Elements of Case File</inline>.—</heading><chapeau>A case file forwarded to higher authority for review pursuant to subsection (c) or (d) shall include the following:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> All charges and specifications preferred under <ref href="/us/usc/t10/s830">section 830 of title 10</ref>, United States Code (article 30 of the Uniform Code of Military Justice).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> All reports of investigations of such charges, including the military criminal investigative organization investigation report and the report prepared under <ref href="/us/usc/t10/s832">section 832 of title 10</ref>, United States Code (article 32 of the Uniform Code of Military Justice), as amended by section 1702.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> A certification that the victim of the alleged sex-related offense was notified of the opportunity to express views on the victim’s preferred disposition of the alleged offense for consideration by the convening authority.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> All statements of the victim provided to the military criminal investigative organization and to the victim’s chain of command relating to the alleged sex-related offense and any statement provided by the victim to the convening authority expressing the victim’s view on the victim’s preferred disposition of the alleged offense.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> The written advice of the staff judge advocate to the convening authority pursuant to <ref href="/us/usc/t10/s834">section 834 of title 10</ref>, United States Code (article 34 of the Uniform Code of Military Justice).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> A written statement explaining the reasons for the convening authority’s decision not to refer any charges for trial by court-martial.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> A certification that the victim of the alleged sex-related offense was informed of the convening authority’s decision to forward the case as provided in subsection (c) or (d).</content>
</paragraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Notice on Results or Review</inline>.—</heading><content>The victim of the alleged sex-related offense shall be notified of the results of the review conducted under subsection (c) or (d) in the manner prescribed by the victims and witness assistance program of the Armed Force concerned.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="g">“(g)</num><heading> <inline class="small-caps">Victim Allegation of Sex-related Offense</inline>.—</heading><content>The Secretary of Defense shall require the Secretaries of the military departments to develop a system to ensure that a victim of a possible sex-related offense under the Uniform Code of Military Justice is given the opportunity to state, either at the time of making an unrestricted report of the allegation or during the criminal investigation of the allegation, whether or not the victim believes that the offense alleged is a sex-related offense subject to the requirements of this section.”</content>
