<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id07089831-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835"><num value="835">§ 835.</num><heading> Art. 35. Service of charges; commencement of trial</heading><subsection style="-uslm-lc:I11" class="indent0" id="id07089832-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Trial counsel detailed for a court-martial under <ref href="/us/usc/t10/s827">section 827 of this title</ref> (article 27) shall cause to be served upon the accused a copy of the charges and specifications referred for trial.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id07089833-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b"><num value="b">(b)</num><heading> <inline class="small-caps">Commencement of Trial</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id07089834-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b/1"><num value="1">(1)</num><chapeau> Subject to paragraphs (2) and (3), no trial or other proceeding of a general court-martial or a special court-martial (including any session under <ref href="/us/usc/t10/s839/a">section 839(a) of this title</ref> (article 39(a)) may be held over the objection of the accused—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id07089835-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b/1/A"><num value="A">(A)</num><content> with respect to a general court-martial, from the time of service through the fifth day after the date of service; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id07089836-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b/1/B"><num value="B">(B)</num><content> with respect to a special court-martial, from the time of service through the third day after the date of service.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id07089837-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b/2"><num value="2">(2)</num><content> An objection under paragraph (1) may be raised only at the first session of the trial or other proceeding and only if the first session occurs before the end of the applicable period under paragraph (1)(A) or (1)(B). If the first session occurs before the end of the applicable period, the military judge shall, at that session, inquire as to whether the defense objects under this subsection.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id07089838-b39a-11e9-9f2b-a0b71e48e050" identifier="/us/usc/t10/s835/b/3"><num value="3">(3)</num><content> This subsection shall not apply in time of war.</content>
