Depositions</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13d9a63c-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13d9a63d-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a/1"><num value="1">(1)</num><chapeau> At any time after charges have been signed as provided in <ref href="/us/usc/t10/s830">section 830 of this title</ref> (article 30), oral or written depositions may be ordered as follows:</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13d9a63e-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a/1/A"><num value="A">(A)</num><content> Before referral of such charges for trial, by the convening authority who has such charges for disposition.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13d9a63f-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a/1/B"><num value="B">(B)</num><content> After referral of such charges for trial, by the convening authority or the military judge hearing the case.</content>

</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13d9a640-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a/2"><num value="2">(2)</num><content> An authority authorized to order a deposition under paragraph (1) may order the deposition at the request of any party, but only if the party demonstrates that, due to exceptional circumstances, it is in the interest of justice that the testimony of the prospective witness be taken and preserved for use at a preliminary hearing under <ref href="/us/usc/t10/s832">section 832 of this title</ref> (article 32) or a court-martial.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13d9a641-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/a/3"><num value="3">(3)</num><content> If a deposition is to be taken before charges are referred for trial, the authority under paragraph (1)(A) may designate commissioned officers as counsel for the Government and counsel for the accused, and may authorize those officers to take the deposition of any witness.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13d9a642-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/b"><num value="b">(b)</num><content> The party at whose instance a deposition is to be taken shall give to every other party reasonable written notice of the time and place for taking the deposition.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13d9a643-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/c"><num value="c">(c)</num><content> Depositions may be taken before and authenticated by any military or civil officer authorized by the laws of the United States or by the laws of the place where the deposition is taken to administer oaths.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13d9a644-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/d"><num value="d">(d)</num><chapeau> A duly authenticated deposition taken upon reasonable notice to the other parties, so far as otherwise admissible under the rules of evidence, may be read in evidence or, in the case of audiotape, videotape, or similar material, may be played in evidence before any military court or commission in any case not capital, or in any proceeding before a court of inquiry or military board, if it appears—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id13d9a645-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/d/1"><num value="1">(1)</num><content> that the witness resides or is beyond the State, Commonwealth, or District of Columbia in which the court, commission, or board is ordered to sit, or beyond 100 miles from the place of trial or hearing;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13d9a646-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/d/2"><num value="2">(2)</num><content> that the witness by reason of death, age, sickness, bodily infirmity, imprisonment, military necessity, nonamenability to process, or other reasonable cause, is unable or refuses to appear and testify in person at the place of trial or hearing; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id13d9a647-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/d/3"><num value="3">(3)</num><content> that the present whereabouts of the witness is unknown.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13d9a648-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/e"><num value="e">(e)</num><content> Subject to subsection (d), testimony by deposition may be presented by the defense in capital cases.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13d9a649-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s849/f"><num value="f">(f)</num><content> Subject to subsection (d), a deposition may be read in evidence or, in the case of audiotape, videotape, or similar material, may be played in evidence in any case in which the death penalty is authorized but is not mandatory, whenever the convening authority directs that the case be treated as not capital, and in such a case a sentence of death may not be adjudged by the court-martial.</content>

<p style="-uslm-lc:I68" class="indent2 firstIndent-2 fontsize8 italic">§ 849. Art. 49. Depositions</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) <inline class="small-caps">In General</inline>.—(1) Subject to paragraph (2), a convening authority or a military judge may order depositions at the request of any party.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(2) A deposition may be ordered under paragraph (1) only if the requesting party demonstrates that, due to exceptional circumstances, it is in the interest of justice that the testimony of a prospective witness be preserved for use at a court-martial, military commission, court of inquiry, or other military court or board.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(3) A party who requests a deposition under this section shall give to every other party reasonable written notice of the time and place for the deposition.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(4) A deposition under this section shall be taken before, and authenticated by, an impartial officer, as follows:</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(A) Whenever practicable, by an impartial judge advocate certified under <ref href="/us/usc/t10/s827/b">section 827(b) of this title</ref> (article 27(b)).</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(B) In exceptional circumstances, by an impartial military or civil officer authorized to administer oaths by (i) the laws of the United States or (ii) the laws of the place where the deposition is taken.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) <inline class="small-caps">Representation by Counsel</inline>.—Representation of the parties with respect to a deposition shall be by counsel detailed in the same manner as trial counsel and defense counsel are detailed under <ref href="/us/usc/t10/s827">section 827 of this title</ref> (article 27). In addition, the accused shall have the right to be represented by civilian or military counsel in the same manner as such counsel are provided for in <ref href="/us/usc/t10/s838/b">section 838(b) of this title</ref> (article 38(b)).</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(c) <inline class="small-caps">Admissibility and Use as Evidence</inline>.—A deposition order under subsection (a) does not control the admissibility of the deposition in a court-martial or other proceeding under this chapter. Except as provided by subsection (d), a party may use all or part of a deposition as provided by the rules of evidence.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(d) <inline class="small-caps">Capital Cases</inline>.—Testimony by deposition may be presented in capital cases only by the defense.</p>
