<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13f17340-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852"><num value="852">§ 852.</num><heading> Art. 52. Number of votes required</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13f17341-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13f17342-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/a/1"><num value="1">(1)</num><content> No person may be convicted of an offense for which the death penalty is made mandatory by law, except by the concurrence of all the members of the court-martial present at the time the vote is taken.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13f17343-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/a/2"><num value="2">(2)</num><content> No person may be convicted of any other offense, except as provided in <ref href="/us/usc/t10/s845/b">section 845(b) of this title</ref> (article 45(b)) or by the concurrence of two-thirds of the members present at the time the vote is taken.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id13f17344-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/b"><num value="b">(b)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13f17345-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/b/1"><num value="1">(1)</num><content> No person may be sentenced to suffer death, except by the concurrence of all the members of the court-martial present at the time the vote is taken and for an offense in this chapter expressly made punishable by death.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13f17346-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/b/2"><num value="2">(2)</num><content> No person may be sentenced to life imprisonment or to confinement for more than ten years, except by the concurrence of three-fourths of the members present at the time the vote is taken.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id13f17347-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/b/3"><num value="3">(3)</num><content> All other sentences shall be determined by the concurrence of two-thirds of the members present at the time the vote is taken.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id13f17348-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s852/c"><num value="c">(c)</num><content> All other questions to be decided by the members of a general or special court-martial shall be determined by a majority vote, but a determination to reconsider a finding of guilty or to reconsider a sentence, with a view toward decreasing it, may be made by any lesser vote which indicates that the reconsideration is not opposed by the number of votes required for that finding or sentence. A tie vote on a challenge disqualifies the member challenged. A tie vote on a motion for a finding of not guilty or on a motion relating to the question of the accused’s sanity is a determination against the accused. A tie vote on any other question is a determination in favor of the accused.</content>

<p style="-uslm-lc:I68" class="indent2 firstIndent-2 fontsize8 italic">§ 852. Art. 52. Votes required for conviction, sentencing, and other matters</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) <inline class="small-caps">In General</inline>.—No person may be convicted of an offense in a general or special court-martial, other than—</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) after a plea of guilty under <ref href="/us/usc/t10/s845/b">section 845(b) of this title</ref> (article 45(b));</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) by a military judge in a court-martial with a military judge alone, under <ref href="/us/usc/t10/s816">section 816 of this title</ref> (article 16); or</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(3) in a court-martial with members under <ref href="/us/usc/t10/s816">section 816 of this title</ref> (article 16), by the concurrence of at least three-fourths of the members present when the vote is taken.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) <inline class="small-caps">Level of Concurrence Required.—</inline></p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) <inline class="small-caps">In general</inline>.—Except as provided in subsection (a) and in paragraph (2), all matters to be decided by members of a general or special court-martial shall be determined by a majority vote, but a reconsideration of a finding of guilty or reconsideration of a sentence, with a view toward decreasing the sentence, may be made by any lesser vote which indicates that the reconsideration is not opposed by the number of votes required for that finding or sentence.</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) <inline class="small-caps">Sentencing</inline>.—A sentence of death requires (A) a unanimous finding of guilty of an offense in this chapter expressly made punishable by death and (B) a unanimous determination by the members that the sentence for that offense shall include death. All other sentences imposed by members shall be determined by the concurrence of at least three-fourths of the members present when the vote is taken.</p>
