<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab6273d4-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a"><num value="853a">§ 853a.</num><heading> Art. 53a. Plea agreements</heading><subsection style="-uslm-lc:I11" class="indent0" id="idab6273d5-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="idab6273d6-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/a/1"><num value="1">(1)</num><chapeau> At any time before the announcement of findings under <ref href="/us/usc/t10/s853">section 853 of this title</ref> (article 53), the convening authority and the accused may enter into a plea agreement with respect to such matters as—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="idab6273d7-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/a/1/A"><num value="A">(A)</num><content> the manner in which the convening authority will dispose of one or more charges and specifications; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idab6273d8-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/a/1/B"><num value="B">(B)</num><content> limitations on the sentence that may be adjudged for one or more charges and specifications.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="idab6273d9-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/a/2"><num value="2">(2)</num><content> The military judge of a general or special court-martial may not participate in discussions between the parties concerning prospective terms and conditions of a plea agreement.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab6273da-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/b"><num value="b">(b)</num><heading> <inline class="small-caps">Limitation on Acceptance of Plea Agreements</inline>.—</heading><chapeau>The military judge of a general or special court-martial shall reject a plea agreement that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab6273db-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/b/1"><num value="1">(1)</num><content> contains a provision that has not been accepted by both parties;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab6273dc-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/b/2"><num value="2">(2)</num><content> contains a provision that is not understood by the accused; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab6273dd-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/b/3"><num value="3">(3)</num><content> except as provided in subsection (c), contains a provision for a sentence that is less than the mandatory minimum sentence applicable to an offense referred to in <ref href="/us/usc/t10/s856/b/2">section 856(b)(2) of this title</ref> (article 56(b)(2)).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab6273de-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/c"><num value="c">(c)</num><heading> <inline class="small-caps">Limited Conditions for Acceptance of Plea Agreement for Sentence Below Mandatory Minimum for Certain Offenses</inline>.—</heading><chapeau>With respect to an offense referred to in <ref href="/us/usc/t10/s856/b/2">section 856(b)(2) of this title</ref> (article 56(b)(2))—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab6273df-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/c/1"><num value="1">(1)</num><content> the military judge may accept a plea agreement that provides for a sentence of bad conduct discharge; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab6273e0-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/c/2"><num value="2">(2)</num><content> upon recommendation of the trial counsel, in exchange for substantial assistance by the accused in the investigation or prosecution of another person who has committed an offense, the military judge may accept a plea agreement that provides for a sentence that is less than the mandatory minimum sentence for the offense charged.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab6273e1-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s853a/d"><num value="d">(d)</num><heading> <inline class="small-caps">Binding Effect of Plea Agreement</inline>.—</heading><content>Upon acceptance by the military judge of a general or special court-martial, a plea agreement shall bind the parties and the military judge.</content>
