<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id13f17369-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854"><num value="854">§ 854.</num><heading> Art. 54. Record of trial</heading><subsection style="-uslm-lc:I11" class="indent0" id="id13f1736a-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/a"><num value="a">(a)</num><content> Each general court-martial shall keep a separate record of the proceedings in each case brought before it, and the record shall be authenticated by the signature of the military judge. If the record cannot be authenticated by the military judge by reason of his death, disability, or absence, it shall be authenticated by the signature of the trial counsel or by that of a member if the trial counsel is unable to authenticate it by reason of his death, disability, or absence. In a court-martial consisting of only a military judge the record shall be authenticated by the court reporter under the same conditions which would impose such a duty on a member under this subsection.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13f1736b-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/b"><num value="b">(b)</num><content> Each special and summary court-martial shall keep a separate record of the proceedings in each case, and the record shall be authenticated in the manner required by such regulations as the President may prescribe.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13f1736c-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/c"><num value="c">(c)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id13f1736d-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/c/1"><num value="1">(1)</num><chapeau> A complete record of the proceedings and testimony shall be prepared—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id13f1736e-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/c/1/A"><num value="A">(A)</num><content> in each general court-martial case in which the sentence adjudged includes death, a dismissal, a discharge, or (if the sentence adjudged does not include a discharge) any other punishment which exceeds that which may otherwise be adjudged by a special court-martial; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id13f1736f-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/c/1/B"><num value="B">(B)</num><content> in each special court-martial case in which the sentence adjudged includes a bad-conduct discharge, confinement for more than six months, or forfeiture of pay for more than six months.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id13f17370-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/c/2"><num value="2">(2)</num><content> In all other court-martial cases, the record shall contain such matters as may be prescribed by regulations of the President.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13f17371-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/d"><num value="d">(d)</num><content> A copy of the record of the proceedings of each general and special court-martial shall be given to the accused as soon as it is authenticated.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id13f17372-13f7-11e7-83cc-8e80841adf57" identifier="/us/usc/t10/s854/e"><num value="e">(e)</num><content> In the case of a general or special court-martial involving a sexual assault or other offense covered by <ref href="/us/usc/t10/s920">section 920 of this title</ref> (article 120), a copy of all prepared records of the proceedings of the court-martial shall be given to the victim of the offense if the victim testified during the proceedings. The records of the proceedings shall be provided without charge and as soon as the records are authenticated. The victim shall be notified of the opportunity to receive the records of the proceedings.</content>

<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) <inline class="small-caps">General and Special Courts-martial</inline>.—Each general or special court-martial shall keep a separate record of the proceedings in each case brought before it. The record shall be certified by a court-reporter, except that in the case of death, disability, or absence of a court reporter, the record shall be certified by an official selected as the President may prescribe by regulation.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) <inline class="small-caps">Summary Courts-martial</inline>.—Each summary court-martial shall keep a separate record of the proceedings in each case, and the record shall be certified in the manner required by such regulations as the President may prescribe.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(c) <inline class="small-caps">Contents of Record</inline>.—(1) Except as provided in paragraph (2), the record shall contain such matters as the President may prescribe by regulation.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(2) In accordance with regulations prescribed by the President, a complete record of proceedings and testimony shall be prepared in any case of a sentence of death, dismissal, discharge, confinement for more than six months, or forfeiture of pay for more than six months.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(d) <inline class="small-caps">Copy to Accused</inline>.—A copy of the record of the proceedings of each general and special court-martial shall be given to the accused as soon as it is certified.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(e) <inline class="small-caps">Copy to Victim</inline>.—In the case of a general or special court-martial, upon request, a copy of all prepared records of the proceedings of the court-martial shall be given to the victim of the offense if the victim testified during the proceedings. The records of the proceedings shall be provided without charge and as soon as the records are certified. The victim shall be notified of the opportunity to receive the records of the proceedings.</p>
