Maximum and minimum limits</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627403-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/a\"><num value=\"a\">(a)</num><content> The punishment which a court-martial may direct for an offense may not exceed such limits as the President may prescribe for that offense.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627404-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b\"><num value=\"b\">(b)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627405-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/1\"><num value=\"1\">(1)</num><content> While a person subject to this chapter who is found guilty of an offense specified in paragraph (2) shall be punished as a general court-martial may direct, such punishment must include, at a minimum, dismissal or dishonorable discharge, except as provided for in <ref href=\"/us/usc/t10/s860\">section 860 of this title</ref> (article 60).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627406-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/2\"><num value=\"2\">(2)</num><chapeau> Paragraph (1) applies to the following offenses:</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627407-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/2/A\"><num value=\"A\">(A)</num><content> An offense in violation of subsection (a) or (b) of <ref href=\"/us/usc/t10/s920\">section 920 of this title</ref> (article 120(a) or (b)).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627408-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/2/B\"><num value=\"B\">(B)</num><content> Rape and sexual assault of a child under subsection (a) or (b) of <ref href=\"/us/usc/t10/s920b\">section 920b of this title</ref> (article 120b).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627409-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/2/C\"><num value=\"C\">(C)</num><content> Forcible sodomy under <ref href=\"/us/usc/t10/s925\">section 925 of this title</ref> (article 125).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab62740a-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856/b/2/D\"><num value=\"D\">(D)</num><content> An attempt to commit an offense specified in subparagraph (A), (B), or (C) that is punishable under <ref href=\"/us/usc/t10/s880\">section 880 of this title</ref> (article 80).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idab62740b-0381-11e7-b712-ff538fc5bb63\">(<ref href=\"/us/act/1956-08-10/ch1041\">Aug. 10, 1956, ch. 1041</ref>, <ref href=\"/us/stat/70A/56\">70A Stat. 56</ref>; <ref href=\"/us/pl/113/66/dA/tXVII\">Pub. E, title LVIII</ref>, § 5301(a), title LXIII, § 5542, <date date=\"2016-12-23\">Dec. 23, 2016</date>, <ref href=\"/us/stat/130/2919\">130 Stat. 2919</ref>, 2967, provided that, effective on the date designated by the President, not later than the first day of the first calendar month beginning two years after <date date=\"2016-12-23\">Dec. 23, 2016</date>, with implementing regulations prescribed by the President not later than one year after <date date=\"2016-12-23\">Dec. 23, 2016</date>, and with provisions relating to applicability to various situations, this section is amended to read as follows:</p>\n<p style=\"-uslm-lc:I68\" class=\"indent2 firstIndent-2 fontsize8 italic\">§ 856. Art. 56. Sentencing</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(a) <inline class=\"small-caps\">Sentence Maximums</inline>.—The punishment which a court-martial may direct for an offense may not exceed such limits as the President may prescribe for that offense.</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(b) <inline class=\"small-caps\">Sentence Minimums for Certain Offenses</inline>.—(1) Except as provided in subsection (d) of <ref href=\"/us/usc/t10/s853a\">section 853a of this title</ref> (article 53a), punishment for any offense specified in paragraph (2) shall include dismissal or dishonorable discharge, as applicable.</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(2) The offenses referred to in paragraph (1) are as follows:</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(A) Rape under subsection (a) of <ref href=\"/us/usc/t10/s920\">section 920 of this title</ref> (article 120).</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(B) Sexual assault under subsection (b) of such section (article).</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(C) Rape of a child under subsection (a) of <ref href=\"/us/usc/t10/s920b\">section 920b of this title</ref> (article 120b).</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(D) Sexual assault of a child under subsection (b) of such section (article).</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(E) An attempt to commit an offense specified in subparagraph (A), (B), (C), or (D) that is punishable under <ref href=\"/us/usc/t10/s880\">section 880 of this title</ref> (article 80).</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(F) Conspiracy to commit an offense specified in subparagraph (A), (B), (C), or (D) that is punishable under <ref href=\"/us/usc/t10/s881\">section 881 of this title</ref> (article 81).</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(c) <inline class=\"small-caps\">Imposition of Sentence.—</inline></p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(1) <inline class=\"small-caps\">In general</inline>.—In sentencing an accused under <ref href=\"/us/usc/t10/s853\">section 853 of this title</ref> (article 53), a court-martial shall impose punishment that is sufficient, but not greater than necessary, to promote justice and to maintain good order and discipline in the armed forces, taking into consideration—</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(A) the nature and circumstances of the offense and the history and characteristics of the accused;</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(B) the impact of the offense on—</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(i) the financial, social, psychological, or medical well-being of any victim of the offense; and</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(ii) the mission, discipline, or efficiency of the command of the accused and any victim of the offense;</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(C) the need for the sentence—</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(i) to reflect the seriousness of the offense;</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(ii) to promote respect for the law;</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(iii) to provide just punishment for the offense;</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(iv) to promote adequate deterrence of misconduct;</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(v) to protect others from further crimes by the accused;</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(vi) to rehabilitate the accused; and</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(vii) to provide, in appropriate cases, the opportunity for retraining and return to duty to meet the needs of the service; and</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(D) the sentences available under this chapter.</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(2) <inline class=\"small-caps\">Sentencing by military judge</inline>.—In announcing the sentence in a general or special court-martial in which the accused is sentenced by a military judge alone under <ref href=\"/us/usc/t10/s853\">section 853 of this title</ref> (article 53), the military judge shall, with respect to each offense of which the accused is found guilty, specify the term of confinement, if any, and the amount of the fine, if any. If the accused is sentenced to confinement for more than one offense, the military judge shall specify whether the terms of confinement are to run consecutively or concurrently.</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(3) <inline class=\"small-caps\">Sentencing by members</inline>.—In a general or special court-martial in which the accused has elected sentencing by members, the court-martial shall announce a single sentence for all of the offenses of which the accused was found guilty.</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(4) <inline class=\"small-caps\">Sentence of confinement for life without eligibility for parole</inline>.—(A) If an offense is subject to a sentence of confinement for life, a court-martial may impose a sentence of confinement for life without eligibility for parole.</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(B) An accused who is sentenced to confinement for life without eligibility for parole shall be confined for the remainder of the accused’s life unless—</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(i) the sentence is set aside or otherwise modified as a result of—</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(I) action taken by the convening authority or the Secretary concerned; or</p>\n<p style=\"-uslm-lc:I14\" class=\"indent3 fontsize8\">(II) any other action taken during post-trial procedure and review under any other provision of subchapter IX of this chapter;</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(ii) the sentence is set aside or otherwise modified as a result of action taken by a Court of Criminal Appeals, the Court of Appeals for the Armed Forces, or the Supreme Court; or</p>\n<p style=\"-uslm-lc:I13\" class=\"indent2 fontsize8\">(iii) the accused is pardoned.</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(d) <inline class=\"small-caps\">Appeal of Sentence by the United States</inline>.—(1) With the approval of the Judge Advocate General concerned, the Government may appeal a sentence to the Court of Criminal Appeals, on the grounds that—</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(A) the sentence violates the law; or</p>\n<p style=\"-uslm-lc:I12\" class=\"indent1 fontsize8\">(B) the sentence is plainly unreasonable.</p>\n<p style=\"-uslm-lc:I11\" class=\"indent0 fontsize8\">(2) An appeal under this subsection must be filed within 60 days after the date on which the judgment of a court-martial is entered into the record under <ref href=\"/us/usc/t10/s860c\">section 860c of this title</ref> (article 60c).</p>\n<p style=\"-uslm-lc:I88\" class=\"indent1 fontsize8 italic\">See 2016 Amendment note below.</p>\n</note>\n<note topic=\"historicalAndRevision\" id=\"idab62740e-0381-11e7-b712-ff538fc5bb63\">\n<table xmlns=\"http://www.w3.org/1999/xhtml\" class=\"HNR\" width=\"50%\" style=\"border-collapse:collapse;
