Sentence of confinement for life without eligibility for parole</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627413-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/a\"><num value=\"a\">(a)</num><content> For any offense for which a sentence of confinement for life may be adjudged, a court-martial may adjudge a sentence of confinement for life without eligibility for parole.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idab627414-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b\"><num value=\"b\">(b)</num><chapeau> An accused who is sentenced to confinement for life without eligibility for parole shall be confined for the remainder of the accused’s life unless—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627415-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b/1\"><num value=\"1\">(1)</num><chapeau> the sentence is set aside or otherwise modified as a result of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab627416-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b/1/A\"><num value=\"A\">(A)</num><content> action taken by the convening authority, the Secretary concerned, or another person authorized to act under <ref href=\"/us/usc/t10/s860\">section 860 of this title</ref> (article 60); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idab627417-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b/1/B\"><num value=\"B\">(B)</num><content> any other action taken during post-trial procedure and review under any other provision of subchapter IX;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627418-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b/2\"><num value=\"2\">(2)</num><content> the sentence is set aside or otherwise modified as a result of action taken by a Court of Criminal Appeals, the Court of Appeals for the Armed Forces, or the Supreme Court; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idab627419-0381-11e7-b712-ff538fc5bb63\" identifier=\"/us/usc/t10/s856a/b/3\"><num value=\"3\">(3)</num><content> the accused is pardoned.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idab62741a-0381-11e7-b712-ff538fc5bb63\">(Added <ref href=\"/us/pl/105/85/dA/tV\">Pub. E, title LVIII</ref>, § 5301(b), title LXIII, § 5542, <date date=\"2016-12-23\">Dec. 23, 2016</date>, <ref href=\"/us/stat/130/2920\">130 Stat. 2920</ref>, 2967, provided that, effective on the date designated by the President, not later than the first day of the first calendar month beginning two years after <date date=\"2016-12-23\">Dec. 23, 2016</date>, with implementing regulations prescribed by the President not later than one year after <date date=\"2016-12-23\">Dec. 23, 2016</date>, and with provisions relating to applicability to various situations, this section is repealed.</p>\n</note>\n<note style=\"-uslm-lc:I74\" topic=\"effectiveDate\" id=\"idab62741d-0381-11e7-b712-ff538fc5bb63\"><heading class=\"centered smallCaps\">Effective Date of Repeal</heading><p style=\"-uslm-lc:I21\" class=\"indent0\">Repeal effective on the date designated by the President, not later than the first day of the first calendar month beginning two years after <date date=\"2016-12-23\">Dec. 23, 2016</date>, with implementing regulations prescribed by the President not later than one year after <date date=\"2016-12-23\">Dec. 23, 2016</date>, and with provisions relating to applicability to various situations, see <ref href=\"/us/pl/114/328/s5542\">section 5542 of Pub.
