<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idab64be39-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a"><num value="858a">§ 858a.</num><heading> Art. 58a. Sentences: reduction in enlisted grade upon approval</heading><subsection style="-uslm-lc:I11" class="indent0" id="idab64be3a-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a/a"><num value="a">(a)</num><chapeau> Unless otherwise provided in regulations to be prescribed by the Secretary concerned, a court-martial sentence of an enlisted member in a pay grade above E–1, as approved by the convening authority, that includes—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idab64be3b-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a/a/1"><num value="1">(1)</num><content> a dishonorable or bad-conduct discharge;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab64be3c-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a/a/2"><num value="2">(2)</num><content> confinement; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idab64be3d-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a/a/3"><num value="3">(3)</num><content> hard labor without confinement;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">reduces that member to pay grade E–1, effective on the date of that approval.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idab64be3e-0381-11e7-b712-ff538fc5bb63" identifier="/us/usc/t10/s858a/b"><num value="b">(b)</num><content> If the sentence of a member who is reduced in pay grade under subsection (a) is set aside or disapproved, or, as finally approved, does not include any punishment named in subsection (a)(1), (2), or (3), the rights and privileges of which he was deprived because of that reduction shall be restored to him and he is entitled to the pay and allowances to which he would have been entitled, for the period the reduction was in effect, had he not been so reduced.</content>

<p style="-uslm-lc:I11" class="indent0 fontsize8">(a) A court-martial sentence of an enlisted member in a pay grade above E–1, as set forth in the judgment of the court-martial entered into the record under <ref href="/us/usc/t10/s860c">section 860c of this title</ref> (article 60c), that includes—</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(1) a dishonorable or bad-conduct discharge;</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(2) confinement; or</p>
<p style="-uslm-lc:I12" class="indent1 fontsize8">(3) hard labor without confinement;</p>
<p style="-uslm-lc:I10" class="indent0 firstIndent0 fontsize8">reduces that member to pay grade E–1, effective on the date on which the judgment is so entered.</p>
<p style="-uslm-lc:I11" class="indent0 fontsize8">(b) If the sentence of a member who is reduced in pay grade under subsection (a) is set aside or reduced, or, as finally affirmed, does not include any punishment named in subsection (a)(1), (2), or (3), the rights and privileges of which he was deprived because of that reduction shall be restored to him and he is entitled to the pay and allowances to which he would have been entitled, for the period the reduction was in effect, had he not been so reduced.</p>
