<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd003b0af-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902"><num value="1902">§ 1902.</num><heading> Policy on sexual harassment and sexual violence</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd003d7c0-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/a"><num value="a">(a)</num><heading> <inline class="small-caps">Required Policy</inline>.—</heading><content>The Commandant shall direct the Superintendent of the Coast Guard Academy to prescribe a policy on sexual harassment and sexual violence applicable to the cadets and other personnel of the Academy.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd003d7c1-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b"><num value="b">(b)</num><heading> <inline class="small-caps">Matters To Be Specified in Policy</inline>.—</heading><chapeau>The policy on sexual harassment and sexual violence under this section shall include specification of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd003d7c2-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/1"><num value="1">(1)</num><content> Programs to promote awareness of the incidence of rape, acquaintance rape, and other sexual offenses of a criminal nature that involve cadets or other Academy personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd003fed3-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/2"><num value="2">(2)</num><content> Information about how the Coast Guard and the Academy will protect the confidentiality of victims of sexual harassment or sexual violence, including how any records, statistics, or reports intended for public release will be formatted such that the confidentiality of victims is not jeopardized.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd00425e4-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/3"><num value="3">(3)</num><chapeau> Procedures that cadets and other Academy personnel should follow in the case of an occurrence of sexual harassment or sexual violence, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd00425e5-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/3/A"><num value="A">(A)</num><content> if the victim chooses to report an occurrence of sexual harassment or sexual violence, a specification of the individual or individuals to whom the alleged offense should be reported and options for confidential reporting, including written information to be given to victims that explains how the Coast Guard and the Academy will protect the confidentiality of victims;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd0044cf6-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/3/B"><num value="B">(B)</num><content> a specification of any other individual whom the victim should contact; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd0044cf7-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/3/C"><num value="C">(C)</num><content> procedures on the preservation of evidence potentially necessary for proof of criminal sexual assault.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd0044cf8-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/4"><num value="4">(4)</num><content> Procedures for disciplinary action in cases of criminal sexual assault involving a cadet or other Academy personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd0047409-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/5"><num value="5">(5)</num><content> Sanctions authorized to be imposed in a substantiated case of sexual harassment or sexual violence involving a cadet or other Academy personnel, including with respect to rape, acquaintance rape, or other criminal sexual offense, whether forcible or nonforcible.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd004740a-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/b/6"><num value="6">(6)</num><content> Required training on the policy for all cadets and other Academy personnel who process allegations of sexual harassment or sexual violence involving a cadet or other Academy personnel.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd0049b1b-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c"><num value="c">(c)</num><heading> <inline class="small-caps">Assessment.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd0049b1c-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Commandant shall direct the Superintendent to conduct at the Academy during each Academy program year an assessment to determine the effectiveness of the policies of the Academy with respect to sexual harassment and sexual violence involving cadets or other Academy personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd0049b1d-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2"><num value="2">(2)</num><heading> <inline class="small-caps">Biennial survey</inline>.—</heading><chapeau>For the assessment at the Academy under paragraph (1) with respect to an Academy program year that begins in an odd-numbered calendar year, the Superintendent shall conduct a survey of cadets and other Academy personnel—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd004c22e-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/A"><num value="A">(A)</num><chapeau> to measure—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd004c22f-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/A/i"><num value="i">(i)</num><content> the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have been reported to an official of the Academy; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd004e940-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/A/ii"><num value="ii">(ii)</num><content> the incidence, during that program year, of sexual harassment and sexual violence events, on or off the Academy reservation, that have not been reported to an official of the Academy; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd004e941-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/B"><num value="B">(B)</num><chapeau> to assess the perceptions of the cadets and other Academy personnel with respect to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idd004e942-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/B/i"><num value="i">(i)</num><content> the Academy’s policies, training, and procedures on sexual harassment and sexual violence involving cadets or other Academy personnel;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd0051053-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/B/ii"><num value="ii">(ii)</num><content> the enforcement of such policies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd0051054-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/B/iii"><num value="iii">(iii)</num><content> the incidence of sexual harassment and sexual violence involving cadets or other Academy personnel; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idd0051055-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/c/2/B/iv"><num value="iv">(iv)</num><content> any other issues relating to sexual harassment and sexual violence involving cadets or other Academy personnel.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd0053766-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d"><num value="d">(d)</num><heading> <inline class="small-caps">Report.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idd0053767-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/1"><num value="1">(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Commandant shall direct the Superintendent to submit to the Commandant a report on sexual harassment and sexual violence involving cadets or other Academy personnel for each Academy program year.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd0053768-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/2"><num value="2">(2)</num><heading> <inline class="small-caps">Report specifications</inline>.—</heading><chapeau>Each report under paragraph (1) shall include, for the Academy program year covered by the report, the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd0053769-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/2/A"><num value="A">(A)</num><content> The number of sexual assaults, rapes, and other sexual offenses involving cadets or other Academy personnel that have been reported to Academy officials during the Academy program year and, of those reported cases, the number that have been substantiated.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd0055e7a-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/2/B"><num value="B">(B)</num><content> A plan for the actions that are to be taken in the following Academy program year regarding prevention of and response to sexual harassment and sexual violence involving cadets or other Academy personnel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd0055e7b-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/3"><num value="3">(3)</num><heading> <inline class="small-caps">Biennial survey</inline>.—</heading><content>Each report under paragraph (1) for an Academy program year that begins in an odd-numbered calendar year shall include the results of the survey conducted in that Academy program year under subsection (c)(2).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd005858c-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/4"><num value="4">(4)</num><heading> <inline class="small-caps">Transmission of report</inline>.—</heading><chapeau>The Commandant shall transmit each report received by the Commandant under this subsection, together with the Commandant’s comments on the report, to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idd005858d-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/4/A"><num value="A">(A)</num><content> the Committee on Commerce, Science, and Transportation of the Senate; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd005ac9e-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/4/B"><num value="B">(B)</num><content> the Committee on Transportation and Infrastructure of the House of Representatives.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd005ac9f-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/5"><num value="5">(5)</num><heading> <inline class="small-caps">Focus groups.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idd005aca0-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/5/A"><num value="A">(A)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>For each Academy program year with respect to which the Superintendent is not required to conduct a survey at the Academy under subsection (c)(2), the Commandant shall require focus groups to be conducted at the Academy for the purposes of ascertaining information relating to sexual assault and sexual harassment issues at the Academy.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idd005d3b1-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/d/5/B"><num value="B">(B)</num><heading> <inline class="small-caps">Inclusion in reports</inline>.—</heading><content>Information derived from a focus group under subparagraph (A) shall be included in the next transmitted Commandant’s report under this subsection.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd005d3b2-d03c-11eb-8c26-a38e5fd8dd0e" identifier="/us/usc/t14/s1902/e"><num value="e">(e)</num><heading> <inline class="small-caps">Victim Confidentiality</inline>.—</heading><content>To the extent that information collected under the authority of this section is reported or otherwise made available to the public, such information shall be provided in a form that is consistent with applicable privacy protections under Federal law and does not jeopardize the confidentiality of victims.</content>
