<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id56b22363-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908"><num value="1908">§ 1908.</num><heading> Authorization for use of Coast Guard Academy facilities and equipment by covered foundations</heading><subsection style="-uslm-lc:I11" class="indent0" id="id56b22364-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/a"><num value="a">(a)</num><heading> <inline class="small-caps">Authority</inline>.—</heading><content>Subject to subsections (b) and (c), the Secretary, with the concurrence of the Superintendent of the Coast Guard Academy, may authorize a covered foundation to use, on a reimbursable or nonreimbursable basis as determined by the Secretary, facilities or equipment of the Coast Guard Academy.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id56b22365-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/b"><num value="b">(b)</num><heading> <inline class="small-caps">Prohibition</inline>.—</heading><content>The Secretary may not authorize any use of facilities or equipment under subsection (a) if such use may jeopardize the health, safety, or well-being of any member of the Coast Guard or cadet of the Coast Guard Academy.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id56b22366-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c"><num value="c">(c)</num><heading> <inline class="small-caps">Limitations</inline>.—</heading><chapeau>The Secretary may only authorize the use of facilities or equipment under subsection (a) if such use—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id56b22367-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/1"><num value="1">(1)</num><content> is without any liability of the United States to the covered foundation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id56b22368-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/2"><num value="2">(2)</num><chapeau> does not—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22369-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/2/A"><num value="A">(A)</num><content> affect the ability of any official or employee of the Coast Guard, or any member of the armed forces, to carry out any responsibility or duty in a fair and objective manner;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b2236a-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/2/B"><num value="B">(B)</num><content> compromise the integrity or appearance of integrity of any program of the Coast Guard, or any individual involved in any such program; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b2236b-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/2/C"><num value="C">(C)</num><content> include the participation of any cadet of the Coast Guard Academy at an event of the covered foundation, other than participation of such a cadet in an honor guard;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id56b2236c-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/3"><num value="3">(3)</num><content> complies with any applicable ethics regulation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id56b2236d-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/c/4"><num value="4">(4)</num><content> has been reviewed and approved by an attorney of the Coast Guard.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id56b2236e-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/d"><num value="d">(d)</num><heading> <inline class="small-caps">Issuance of Policies</inline>.—</heading><content>The Secretary shall issue Coast Guard policies to carry out this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id56b2236f-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/e"><num value="e">(e)</num><heading> <inline class="small-caps">Briefing</inline>.—</heading><content>For any fiscal year in which the Secretary exercises the authority under subsection (a), not later than the last day of such fiscal year, the Commandant shall provide a briefing to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives on the number of events or activities of a covered foundation supported by such exercise of authority during the fiscal year.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id56b22370-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f"><num value="f">(f)</num><heading> <inline class="small-caps">Covered Foundation Defined</inline>.—</heading><chapeau>In this section, the term “covered foundation” means an organization that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id56b22371-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/1"><num value="1">(1)</num><content> is a charitable, educational, or civic nonprofit organization under section 501(c)(3) of the Internal Revenue Code of 1986; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id56b22372-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2"><num value="2">(2)</num><chapeau> the Secretary determines operates exclusively to support—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22373-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2/A"><num value="A">(A)</num><content> recruiting activities with respect to the Coast Guard Academy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22374-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2/B"><num value="B">(B)</num><content> parent or alumni development in support of the Coast Guard Academy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22375-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2/C"><num value="C">(C)</num><content> academic, leadership, or character development of Coast Guard Academy cadets;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22376-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2/D"><num value="D">(D)</num><content> institutional development of the Coast Guard Academy; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id56b22377-2930-11f1-a4c1-c531e6569a02" identifier="/us/usc/t14/s1908/f/2/E"><num value="E">(E)</num><content> athletics in support of the Coast Guard Academy.</content>
</subparagraph>
