<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9539f8c9-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58"><num value="58">§ 58.</num><heading> Centers of expertise for Coast Guard prevention and response</heading><subsection style="-uslm-lc:I11" class="indent0" id="id9539f8ca-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/a"><num value="a">(a)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>The Commandant of the Coast Guard may establish and operate one or more centers of expertise for prevention and response missions of the Coast Guard (in this section referred to as a “center”).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9539f8cb-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b"><num value="b">(b)</num><heading> <inline class="small-caps">Missions</inline>.—</heading><chapeau>Any center established under subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8cc-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/1"><num value="1">(1)</num><chapeau> promote, facilitate, and conduct—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9539f8cd-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/1/A"><num value="A">(A)</num><content> education;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9539f8ce-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/1/B"><num value="B">(B)</num><content> training; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9539f8cf-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/1/C"><num value="C">(C)</num><content> activities authorized under section 93(a)(4);</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d0-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/2"><num value="2">(2)</num><content> be a repository of information on operations, practices, and resources related to the mission for which the center was established; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d1-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/b/3"><num value="3">(3)</num><content> perform and support the mission for which the center was established.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9539f8d2-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/c"><num value="c">(c)</num><heading> <inline class="small-caps">Joint Operation With Educational Institution Authorized</inline>.—</heading><chapeau>The Commandant may enter into an agreement with an appropriate official of an institution of higher education to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d3-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/c/1"><num value="1">(1)</num><content> provide for joint operation of a center; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d4-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/c/2"><num value="2">(2)</num><content> provide necessary administrative services for a center, including administration and allocation of funds.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id9539f8d5-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d"><num value="d">(d)</num><heading> Acceptance of Donations.—</heading><paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d6-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d/1"><num value="1">(1)</num><content> Except as provided in paragraph (2), the Commandant may accept, on behalf of a center, donations to be used to defray the costs of the center or to enhance the operation of the center. Those donations may be accepted from any State or local government, any foreign government, any foundation or other charitable organization (including any that is organized or operates under the laws of a foreign country), or any individual.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8d7-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d/2"><num value="2">(2)</num><chapeau> The Commandant may not accept a donation under paragraph (1) if the acceptance of the donation would compromise or appear to compromise—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id9539f8d8-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d/2/A"><num value="A">(A)</num><content> the ability of the Coast Guard or the department in which the Coast Guard is operating, any employee of the Coast Guard or the department, or any member of the Armed Forces to carry out any responsibility or duty in a fair and objective manner; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id9539f8d9-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d/2/B"><num value="B">(B)</num><content> the integrity of any program of the Coast Guard, the department in which the Coast Guard is operating, or of any person involved in such a program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9539f8da-f67c-11e5-874c-d1ab310278c8" identifier="/us/usc/t14/s58/d/3"><num value="3">(3)</num><content> The Commandant shall prescribe written guidance setting forth the criteria to be used in determining whether or not the acceptance of a donation from a foreign source would have a result described in paragraph (2).</content>
