<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idb9a5fb3b-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701"><num value="1701">§ 1701.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">For the purposes of this chapter, the term—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb3c-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/1"><num value="1">(1)</num><content> “Director” means the Director of the Bureau of Consumer Financial Protection;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb3d-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/2"><num value="2">(2)</num><content> “person” means an individual, or an unincorporated organization, partnership, association, corporation, trust, or estate;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb3e-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/3"><num value="3">(3)</num><content> “subdivision” means any land which is located in any State or in a foreign country and is divided or is proposed to be divided into lots, whether contiguous or not, for the purpose of sale or lease as part of a common promotional plan;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb3f-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/4"><num value="4">(4)</num><content> “common promotional plan” means a plan, undertaken by a single developer or a group of developers acting in concert, to offer lots for sale or lease; where such land is offered for sale by such a developer or group of developers acting in concert, and such land is contiguous or is known, designated, or advertised as a common unit or by a common name, such land shall be presumed, without regard to the number of lots covered by each individual offering, as being offered for sale or lease as part of a common promotional plan;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb40-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/5"><num value="5">(5)</num><content> “developer” means any person who, directly or indirectly, sells or leases, or offers to sell or lease, or advertises for sale or lease any lots in a subdivision;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb41-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/6"><num value="6">(6)</num><content> “agent” means any person who represents, or acts for or on behalf of, a developer in selling or leasing, or offering to sell or lease, any lot or lots in a subdivision; but shall not include an attorney at law whose representation of another person consists solely of rendering legal services;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb42-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/7"><num value="7">(7)</num><content> “blanket encumbrance” means a trust deed, mortgage, judgment, or any other lien or encumbrance, including an option or contract to sell or a trust agreement, affecting a subdivision or affecting more than one lot offered within a subdivision except that such term shall not include any lien or other encumbrance arising as the result of the imposition of any tax assessment by any public authority;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb43-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/8"><num value="8">(8)</num><content> “interstate commerce” means trade or commerce among the several States or between any foreign country and any State;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb44-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/9"><num value="9">(9)</num><content> “State” includes the several States, the District of Columbia, the Commonwealth of Puerto Rico, and the territories and possessions of the United States;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb45-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/10"><num value="10">(10)</num><content> “purchaser” means an actual or prospective purchaser or lessee of any lot in a subdivision;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb46-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/11"><num value="11">(11)</num><content> “offer” includes any inducement, solicitation, or attempt to encourage a person to acquire a lot in a subdivision; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idb9a5fb47-7fa0-11ec-b2a6-e63981532160" identifier="/us/usc/t15/s1701/12"><num value="12">(12)</num><content> “Bureau” means the Bureau of Consumer Financial Protection.</content>
