<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2b6b268f-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d"><num value="45d">§ 45d.</num><heading> Unfair or deceptive acts or practices with respect to substance use disorder treatment service and products</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2b6b2690-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Unlawful activity</heading><content><p style="-uslm-lc:I11" class="indent0">It is unlawful to engage in an unfair or deceptive act or practice with respect to any substance use disorder treatment service or substance use disorder treatment product.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2b6b2691-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Enforcement by the Federal Trade Commission</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2b6b2692-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Unfair or deceptive acts or practices</heading><content><p style="-uslm-lc:I12" class="indent1">A violation of subsection (a) shall be treated as a violation of a rule under section 18 of the Federal Trade Commission Act (<ref href="/us/usc/t15/s57a">15 U.S.C. 57a</ref>) regarding unfair or deceptive acts or practices.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2b6b2693-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Powers of the Federal Trade Commission</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2b6b2694-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/b/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<ref href="/us/usc/t15/s41">15 U.S.C. 41</ref> et seq.) were incorporated into and made a part of this section.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2b6b2695-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s45d/b/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Privileges and immunities</heading><content><p style="-uslm-lc:I13" class="indent2">Any person who violates subsection (a) shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act as though all applicable terms and provisions of the Federal Trade Commission Act (<ref href="/us/usc/t15/s41">15 U.S.C. 41</ref> et seq.) were incorporated and made part of this section.</p>
