<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id148242cf-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions relating to HUBZones</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id148242d0-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Historically underutilized business zone</heading><chapeau>The terms “historically underutilized business zone” or “HUBZone” mean any area located within 1 or more—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d1-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/A"><num value="A">(A)</num><content> qualified census tracts;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d2-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/B"><num value="B">(B)</num><content> qualified nonmetropolitan counties;</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d3-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/C"><num value="C">(C)</num><content> lands within the external boundaries of an Indian reservation;</content>

<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d4-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/D"><num value="D">(D)</num><content> redesignated areas;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d5-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/E"><num value="E">(E)</num><content> base closure areas;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d6-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/F"><num value="F">(F)</num><content> qualified disaster areas; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d7-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/1/G"><num value="G">(G)</num><content> a Governor-designated covered area.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id148242d8-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> HUBZone small business concern</heading><chapeau>The term “HUBZone small business concern” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id148242d9-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/A"><num value="A">(A)</num><content> a small business concern that is at least 51 percent owned and controlled by United States citizens;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242da-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/B"><num value="B">(B)</num><chapeau> a small business concern that is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id148242db-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/B/i"><num value="i">(i)</num><content> an Alaska Native Corporation owned and controlled by Natives (as determined pursuant to <ref href="/us/usc/t43/s1626/e/1">section 1626(e)(1) of title 43</ref>); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id148242dc-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/B/ii"><num value="ii">(ii)</num><content> a direct or indirect subsidiary corporation, joint venture, or partnership of an Alaska Native Corporation qualifying pursuant to <ref href="/us/usc/t43/s1626/e/1">section 1626(e)(1) of title 43</ref>, if that subsidiary, joint venture, or partnership is owned and controlled by Natives (as determined pursuant to <ref href="/us/usc/t43/s1626/e/2">section 1626(e)(2) of title 43</ref>);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242dd-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/C"><num value="C">(C)</num><chapeau> a small business concern—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id148242de-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/C/i"><num value="i">(i)</num><content> that is wholly owned by one or more Indian tribal governments, or by a corporation that is wholly owned by one or more Indian tribal governments; or</content>

<clause style="-uslm-lc:I14" class="indent3" id="id148242df-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/C/ii"><num value="ii">(ii)</num><content> that is owned in part by one or more Indian tribal governments, or by a corporation that is wholly owned by one or more Indian tribal governments, if all other owners are either United States citizens or small business concerns;</content>

</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242e0-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/D"><num value="D">(D)</num><chapeau> a small business concern—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id148242e1-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/D/i"><num value="i">(i)</num><content> that is wholly owned by one or more Native Hawaiian Organizations (as defined in <ref href="/us/usc/t15/s637/a/15">section 637(a)(15) of this title</ref>), or by a corporation that is wholly owned by one or more Native Hawaiian Organizations; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id148242e2-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/D/ii"><num value="ii">(ii)</num><content> that is owned in part by one or more Native Hawaiian Organizations, or by a corporation that is wholly owned by one or more Native Hawaiian Organizations, if all other owners are either United States citizens or small business concerns;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242e3-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/E"><num value="E">(E)</num><chapeau> a small business concern that is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id148242e4-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/E/i"><num value="i">(i)</num><content> wholly owned by a community development corporation that has received financial assistance under part 1 of subchapter A of the Community Economic Development Act of 1981 (<ref href="/us/usc/t42/s9805">42 U.S.C. 9805</ref> et seq.); or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id148242e5-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/E/ii"><num value="ii">(ii)</num><content> owned in part by one or more community development corporations, if all other owners are either United States citizens or small business concerns; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148242e6-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/F"><num value="F">(F)</num><chapeau> a small business concern that is—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id148242e7-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/F/i"><num value="i">(i)</num><content> a small agricultural cooperative organized or incorporated in the United States;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id148242e8-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/F/ii"><num value="ii">(ii)</num><content> wholly owned by 1 or more small agricultural cooperatives organized or incorporated in the United States; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id148242e9-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/2/F/iii"><num value="iii">(iii)</num><content> owned in part by 1 or more small agricultural cooperatives organized or incorporated in the United States, if all owners are small business concerns or United States citizens.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id148268fa-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Qualified areas</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id148268fb-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Qualified census tract</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id148268fc-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/A/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">The term “qualified census tract” means a census tract that is covered by the definition of “qualified census tract” in <ref href="/us/usc/t26/s42/d/5/B/ii">section 42(d)(5)(B)(ii) of title 26</ref> and that is reflected in an online tool prepared by the Administrator described under subsection (d)(7).</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id148268fd-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/A/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Exception</heading><chapeau>For any metropolitan statistical area in the Commonwealth of Puerto Rico, the term “qualified census tract” has the meaning given that term in <ref href="/us/usc/t26/s42/d/5/B/ii">section 42(d)(5)(B)(ii) of title 26</ref> as applied without regard to subclause (II) of such section and that is reflected in the online tool described under clause (i), except that this clause shall only apply—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id148268fe-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/A/ii/I"><num value="I">(I)</num><content> 10 years after the date that the Administrator implements this clause, or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id148268ff-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/A/ii/II"><num value="II">(II)</num><content> the date on which the Financial Oversight and Management Board for the Commonwealth of Puerto Rico created by the Puerto Rico Oversight, Management, and Economic Stability Act ceases to exist,</content>
</subclause>
</clause>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14826900-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Qualified nonmetropolitan county</heading><chapeau>The term “qualified nonmetropolitan county” means any county that is reflected in the online tool described under subparagraph (A)(i) and—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id14826901-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B/i"><num value="i">(i)</num><content> that was not located in a metropolitan statistical area (as defined in <ref href="/us/usc/t26/s143/k/2/B">section 143(k)(2)(B) of title 26</ref>) at the time of the most recent census taken for purposes of selecting qualified census tracts under <ref href="/us/usc/t26/s42/d/5/B/ii">section 42(d)(5)(B)(ii) of title 26</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id14826902-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B/ii"><num value="ii">(ii)</num><chapeau> in which—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id14826903-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B/ii/I"><num value="I">(I)</num><content> the median household income is less than 80 percent of the State median household income, based on a 5-year average of the available data from the Bureau of the Census of the Department of Commerce;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id14826904-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B/ii/II"><num value="II">(II)</num><content> the unemployment rate is not less than 140 percent of the average unemployment rate for the United States or for the State in which such county is located, whichever is less, based on a 5-year average of the available data from the Secretary of Labor; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id14826905-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/B/ii/III"><num value="III">(III)</num><content> there is located a difficult development area, as designated by the Secretary of Housing and Urban Development in accordance with <ref href="/us/usc/t26/s42/d/5/B/iii">section 42(d)(5)(B)(iii) of title 26</ref>, within Alaska, Hawaii, or any territory or possession of the United States outside the 48 contiguous States.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14826906-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Redesignated area</heading><content><p style="-uslm-lc:I13" class="indent2">The term “redesignated area” means any census tract that ceases to be qualified under subparagraph (A) and any nonmetropolitan county that ceases to be qualified under subparagraph (B) for a period of 3 years after the date on which the census tract or nonmetropolitan county ceased to be so qualified.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14826907-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Base closure area</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id14826908-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>Subject to clause (ii), the term “base closure area” means—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id14826909-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/I"><num value="I">(I)</num><chapeau> lands within the external boundaries of a military installation that were closed through a privatization process under the authority of—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id1482690a-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/I/aa"><num value="aa">(aa)</num><content> the Defense Base Closure and Realignment Act of 1990 (part A of title XXIX of division B of <ref href="/us/pl/101/510">Public Law 101–510</ref>; <ref href="/us/usc/t10/s2687">10 U.S.C. 2687</ref> note);</content>

<item style="-uslm-lc:I580434" class="indent5" id="id1482690b-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/I/bb"><num value="bb">(bb)</num><content> title II of the Defense Authorization Amendments and Base Closure and Realignment Act (<ref href="/us/pl/100/526">Public Law 100–526</ref>; <ref href="/us/usc/t10/s2687">10 U.S.C. 2687</ref> note);</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id1482690c-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/I/cc"><num value="cc">(cc)</num><content> <ref href="/us/usc/t10/s2687">section 2687 of title 10</ref>; or</content>

<item style="-uslm-lc:I580434" class="indent5" id="id1482690d-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/I/dd"><num value="dd">(dd)</num><content> any other provision of law authorizing or directing the Secretary of Defense or the Secretary of a military department to dispose of real property at the military installation for purposes relating to base closures of redevelopment, while retaining the authority to enter into a leaseback of all or a portion of the property for military use;</content>

</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482690e-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/II"><num value="II">(II)</num><content> the census tract or nonmetropolitan county in which the lands described in subclause (I) are wholly contained;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482690f-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/III"><num value="III">(III)</num><content> a census tract or nonmetropolitan county the boundaries of which intersect the area described in subclause (I); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id14829020-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/i/IV"><num value="IV">(IV)</num><content> a census tract or nonmetropolitan county the boundaries of which are contiguous to the area described in subclause (II) or subclause (III).</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id14829021-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I14" class="indent3">A census tract or nonmetropolitan county described in clause (i) shall be considered to be a base closure area for a period beginning on the date on which the Administrator designates such census tract or nonmetropolitan county as a base closure area and ending on the date on which the base closure area ceases to be a qualified census tract under subparagraph (A) or a qualified nonmetropolitan county under subparagraph (B) in accordance with the online tool prepared by the Administrator described under subsection (d)(7), except that such period may not be less than 8 years.</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id14829022-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Definitions</heading><chapeau>In this subparagraph:</chapeau><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id14829023-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> Census tract</heading><content><p style="-uslm-lc:I16" class="indent4">The term “census tract” means a census tract delineated by the United States Bureau of the Census in the most recent decennial census that is not located in a nonmetropolitan county and does not otherwise qualify as a qualified census tract.</p>

</subclause>
<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id14829024-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/D/iii/II"><num value="II" class="bold">(II)</num><heading class="bold"> Nonmetropolitan county</heading><content><p style="-uslm-lc:I16" class="indent4">The term “nonmetropolitan county” means a county that was not located in a metropolitan statistical area (as defined in <ref href="/us/usc/t26/s143/k/2/B">section 143(k)(2)(B) of title 26</ref>) at the time of the most recent census taken for purposes of selecting qualified census tracts and does not otherwise qualify as a qualified nonmetropolitan county.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14829025-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E"><num value="E" class="bold">(E)</num><heading class="bold"> Qualified disaster area</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id14829026-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Subject to clause (ii), the term “qualified disaster area” means any census tract or nonmetropolitan county located in an area where a major disaster has occurred or an area in which a catastrophic incident has occurred if such census tract or nonmetropolitan county ceased to be qualified under subparagraph (A) or (B), as applicable, during the period beginning 5 years before the date on which the President declared the major disaster or the catastrophic incident occurred.</p>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id14829027-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Duration</heading><chapeau>A census tract or nonmetropolitan county shall be considered to be a qualified disaster area under clause (i) only for the period of time ending on the date the area ceases to be a qualified census tract under subparagraph (A) or a qualified nonmetropolitan county under subparagraph (B), in accordance with the online tool prepared by the Administrator described under subsection (d)(7) and beginning—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id14829028-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/ii/I"><num value="I">(I)</num><content> in the case of a major disaster, on the date on which the President declared the major disaster for the area in which the census tract or nonmetropolitan county, as applicable, is located; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id14829029-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/ii/II"><num value="II">(II)</num><content> in the case of a catastrophic incident, on the date on which the catastrophic incident occurred in the area in which the census tract or nonmetropolitan county, as applicable, is located.</content>

<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482902a-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Definitions</heading><chapeau>In this subparagraph:</chapeau><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id1482902b-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/E/iii/I"><num value="I" class="bold">(I)</num><heading class="bold"> Major disaster</heading><content><p style="-uslm-lc:I16" class="indent4">The term “major disaster” means a major disaster declared by the President under <ref href="/us/usc/t42/s5170">section 5170 of title 42</ref>.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482902d-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F"><num value="F" class="bold">(F)</num><heading class="bold"> Governor-designated covered area</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482902e-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">A “Governor-designated covered area” means a covered area that the Administrator has designated by approving a petition described under clause (ii).</p>

</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482902f-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Petition</heading><chapeau>For a covered area to receive a designation as a Governor-designated covered area, the Governor of the State in which the covered area is wholly contained shall include such covered area in a petition to the Administrator requesting such a designation. In reviewing a request for designation included in such a petition, the Administrator may consider—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id14829030-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/ii/I"><num value="I">(I)</num><content> the potential for job creation and investment in the covered area;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id14829031-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/ii/II"><num value="II">(II)</num><content> the demonstrated interest of small business concerns in the covered area to be designated as a Governor-designated covered area;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482b742-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/ii/III"><num value="III">(III)</num><content> how State and local government officials have incorporated the covered area into an economic development strategy; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482b743-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/ii/IV"><num value="IV">(IV)</num><content> if the covered area was a HUBZone before becoming the subject of the petition, the impact on the covered area if the Administrator did not approve the petition.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482b744-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Limitations</heading><content><p style="-uslm-lc:I14" class="indent3">Each calendar year, a Governor may submit not more than 1 petition described under clause (ii). Such petition shall include all covered areas in a State for which the Governor seeks designation as a Governor-designated covered area, except that the total number of covered areas included in such petition may not exceed 10 percent of the total number of covered areas in the State.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482b745-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> Certification</heading><content><p style="-uslm-lc:I14" class="indent3">If the Administrator grants a petition described under clause (ii), the Governor of the Governor-designated covered area shall, not less frequently than annually, submit data to the Administrator certifying that each Governor-designated covered area continues to meet the requirements of clause (v)(I).</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id1482b746-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v"><num value="v" class="bold">(v)</num><heading class="bold"> Definitions</heading><chapeau>In this subparagraph:</chapeau><subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id1482b747-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v/I"><num value="I" class="bold">(I)</num><heading class="bold"> Covered area</heading><chapeau>The term “covered area” means an area in a State—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id1482b748-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v/I/aa"><num value="aa">(aa)</num><content> that is located outside of an urbanized area, as determined by the Bureau of the Census;</content>

<item style="-uslm-lc:I580434" class="indent5" id="id1482b749-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v/I/bb"><num value="bb">(bb)</num><content> with a population of not more than 50,000; and</content>

<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id1482b74b-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v/II"><num value="II" class="bold">(II)</num><heading class="bold"> Governor</heading><content><p style="-uslm-lc:I16" class="indent4">The term “Governor” means the chief executive of a State.</p>

<subclause style="-uslm-lc:I72" class="indent6 firstIndent-2" id="id1482b74c-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/3/F/v/III"><num value="III" class="bold">(III)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I16" class="indent4">The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands, and American Samoa.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1482b74d-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Qualified HUBZone small business concern</heading><content><p style="-uslm-lc:I12" class="indent1">The term “qualified HUBZone small business concern” means a HUBZone small business concern that has been certified by the Administrator in accordance with the procedures described in this section.</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482b751-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Indian reservation</heading><chapeau>The term “Indian reservation”—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id1482b752-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C/i"><num value="i">(i)</num><chapeau> has the same meaning as the term “Indian country” in <ref href="/us/usc/t18/s1151">section 1151 of title 18</ref>, except that such term does not include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id1482b753-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C/i/I"><num value="I">(I)</num><content> any lands that are located within a State in which a tribe did not exercise governmental jurisdiction on <date date="2000-12-21">December 21, 2000</date>, unless that tribe is recognized after <date date="2000-12-21">December 21, 2000</date>, by either an Act of Congress or pursuant to regulations of the Secretary of the Interior for the administrative recognition that an Indian group exists as an Indian tribe (part 83 of title 25, Code of Federal Regulations); and</content>

<clause style="-uslm-lc:I14" class="indent3" id="id1482b755-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C/ii"><num value="ii">(ii)</num><chapeau> in the State of Oklahoma, means lands that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id1482b756-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C/ii/I"><num value="I">(I)</num><content> are within the jurisdictional areas of an Oklahoma Indian tribe (as determined by the Secretary of the Interior); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482b757-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/5/C/ii/II"><num value="II">(II)</num><content> are recognized by the Secretary of the Interior as eligible for trust land status under part 151 of title 25, Code of Federal Regulations (as in effect on <date date="2000-12-21">December 21, 2000</date>).</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1482b758-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/b/6"><num value="6" class="bold">(6)</num><heading class="bold"> Agricultural commodity</heading><content><p style="-uslm-lc:I12" class="indent1">The term “agricultural commodity” has the same meaning as in <ref href="/us/usc/t7/s5602">section 5602 of title 7</ref>.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1482de69-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c"><num value="c" class="bold">(c)</num><heading class="bold"> Eligible contracts</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1482de6a-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><chapeau>In this subsection—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1482de6b-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/1/A"><num value="A">(A)</num><content> the term “contracting officer” has the meaning given that term in <ref href="/us/usc/t41/s2101/1">section 2101(1) of title 41</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1482de6c-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/1/B"><num value="B">(B)</num><content> the term “full and open competition” has the meaning given that term in <ref href="/us/usc/t41/s107">section 107 of title 41</ref>.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1482de6d-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Authority of contracting officer</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de6e-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Sole source contracts</heading><chapeau>A contracting officer may award sole source contracts under this section to any qualified HUBZone small business concern, if—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id1482de6f-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A/i"><num value="i">(i)</num><content> the qualified HUBZone small business concern is determined to be a responsible contractor with respect to performance of such contract opportunity, and the contracting officer does not have a reasonable expectation that 2 or more qualified HUBZone small business concerns will submit offers for the contracting opportunity;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id1482de70-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A/ii"><num value="ii">(ii)</num><chapeau> the anticipated award price of the contract (including options) will not exceed—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id1482de71-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A/ii/I"><num value="I">(I)</num><content> $5,000,000, in the case of a contract opportunity assigned a standard industrial classification code for manufacturing; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id1482de72-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A/ii/II"><num value="II">(II)</num><content> $3,000,000, in the case of all other contract opportunities; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id1482de73-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/A/iii"><num value="iii">(iii)</num><content> in the estimation of the contracting officer, the contract award can be made at a fair and reasonable price.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de74-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Restricted competition</heading><content><p style="-uslm-lc:I13" class="indent2">A contract opportunity may be awarded pursuant to this section on the basis of competition restricted to qualified HUBZone small business concerns if the contracting officer has a reasonable expectation that not less than 2 qualified HUBZone small business concerns will submit offers and that the award can be made at a fair market price.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de75-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Appeals</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 5 days from the date the Administration is notified of a procurement officer’s decision not to award a contract opportunity under this section to a qualified HUBZone small business concern, the Administrator may notify the contracting officer of the intent to appeal the contracting officer’s decision, and within 15 days of such date the Administrator may file a written request for reconsideration of the contracting officer’s decision with the Secretary of the department or agency head.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1482de76-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Price evaluation preference in full and open competitions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de77-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraph (B), in any case in which a contract is to be awarded on the basis of full and open competition, the price offered by a qualified HUBZone small business concern shall be deemed as being lower than the price offered by another offeror (other than another small business concern), if the price offered by the qualified HUBZone small business concern is not more than 10 percent higher than the price offered by the otherwise lowest, responsive, and responsible offeror.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de78-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Procurement of commodities</heading><chapeau>For purchases by the Secretary of Agriculture of agricultural commodities, the price evaluation preference shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id1482de79-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/B/i"><num value="i">(i)</num><content> 10 percent, for the portion of a contract to be awarded that is not greater than 25 percent of the total volume being procured for each commodity in a single invitation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id1482de7a-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/B/ii"><num value="ii">(ii)</num><content> 5 percent, for the portion of a contract to be awarded that is greater than 25 percent, but not greater than 40 percent, of the total volume being procured for each commodity in a single invitation; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id1482de7b-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/B/iii"><num value="iii">(iii)</num><content> zero, for the portion of a contract to be awarded that is greater than 40 percent of the total volume being procured for each commodity in a single invitation.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1482de7c-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Procurement of commodities for international food aid export operations</heading><content><p style="-uslm-lc:I13" class="indent2">The price evaluation preference for purchases of agricultural commodities by the Secretary of Agriculture for export operations through international food aid programs administered by the Farm Service Agency shall be 5 percent on the first portion of a contract to be awarded that is not greater than 20 percent of the total volume of each commodity being procured in a single invitation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id1483058d-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/3/D"><num value="D" class="bold">(D)</num><heading class="bold"> Treatment of preference</heading><content><p style="-uslm-lc:I13" class="indent2">A contract awarded to a HUBZone small business concern under a preference described in subparagraph (B) shall not be counted toward the fulfillment of any requirement partially set aside for competition restricted to small business concerns.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1483058e-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Relationship to other contracting preferences</heading><content><p style="-uslm-lc:I12" class="indent1">A procurement may not be made from a source on the basis of a preference provided in paragraph (2) or (3), if the procurement would otherwise be made from a different source under section 4124 or 4125 of title 18 or chapter 85 of title 41.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id1483058f-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d"><num value="d" class="bold">(d)</num><heading class="bold"> Eligibility requirements; enforcement</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14830590-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Certification</heading><chapeau>In order to be eligible for certification by the Administrator as a qualified HUBZone small business concern, a HUBZone small business concern shall submit documentation to the Administrator stating that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id14830591-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/1/A"><num value="A">(A)</num><content> at the time of certification and at each examination conducted pursuant to paragraph (4), the principal office of the concern is located in a HUBZone and not fewer than 35 percent of its employees reside in a HUBZone;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id14830592-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/1/B"><num value="B">(B)</num><content> the concern will attempt to maintain the applicable employment percentage under subparagraph (A) during the performance of any contract awarded to such concern on the basis of a preference provided under subsection (c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id14830593-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/1/C"><num value="C">(C)</num><content> the concern will ensure that the requirements of <ref href="/us/usc/t15/s657s">section 657s of this title</ref> are satisfied with respect to any subcontract entered into by such concern pursuant to a contract awarded under this section.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14830594-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Verification</heading><chapeau>In carrying out this section, the Administrator shall establish procedures relating to—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id14830595-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/2/A"><num value="A">(A)</num><content> the filing, investigation, and disposition by the Administration of any challenge to the eligibility of a HUBZone small business concern to receive assistance under this section (including a challenge, filed by an interested party, relating to the veracity of documentation provided to the Administration by such a concern under paragraph (1)); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id14830596-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/2/B"><num value="B">(B)</num><content> verification by the Administrator of the accuracy of any documentation provided by a HUBZone small business concern under paragraph (1).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14830597-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall verify the eligibility of a HUBZone small business concern using the procedures described in paragraph (2) within a reasonable time and not later than 60 days after the date on which the Administrator receives sufficient and complete documentation from a HUBZone small business concern under paragraph (1).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14830598-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Recertification</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 3 years after the date that such HUBZone small business concern was certified as a qualified HUBZone small business concern, and every 3 years thereafter, the Administrator shall verify the accuracy of any documentation provided by a HUBZone small business concern under paragraph (1) to determine if such HUBZone small business concern remains a qualified HUBZone small business concern.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14830599-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Examinations</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall conduct program examinations of qualified HUBZone small business concerns, using a risk-based analysis to select which concerns are examined, to ensure that any concern examined meets the requirements of paragraph (1).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id1483059a-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/6"><num value="6" class="bold">(6)</num><heading class="bold"> Loss of certification</heading><content><p style="-uslm-lc:I12" class="indent1">A HUBZone small business concern that, based on the results of an examination conducted pursuant to paragraph (5) no longer meets the requirements of paragraph (1), shall have 30 days to submit documentation to the Administrator to be eligible to be certified as a qualified HUBZone small business concern. During the 30-day period, such concern may not compete for or be awarded a contract under this section. If such concern fails to meet the requirements of paragraph (1) by the last day of the 30-day period, the Administrator shall not certify such concern as a qualified HUBZone small business concern.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cab-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7"><num value="7" class="bold">(7)</num><heading class="bold"> HUBZone online tool</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14832cac-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The Administrator shall develop a publicly accessible online tool that depicts HUBZones. Such online tool shall be updated—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id14832cad-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/A/i"><num value="i">(i)</num><content> with respect to HUBZones described under subparagraphs (A) and (B) of subsection (b)(3), beginning on <date date="2020-01-01">January 1, 2020</date>, and every 5 years thereafter;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id14832cae-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/A/ii"><num value="ii">(ii)</num><content> with respect to a HUBZone described under subsection (b)(3)(C), immediately after the area becomes, or ceases to be, a redesignated area; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id14832caf-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/A/iii"><num value="iii">(iii)</num><content> with respect to HUBZones described under subparagraphs (D), (E), and (F) of subsection (b)(3), immediately after an area is designated as a base closure area, qualified disaster area, or Governor-designated covered area, respectively.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14832cb0-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Data</heading><content><p style="-uslm-lc:I13" class="indent2">The online tool required under subparagraph (A) shall clearly and conspicuously provide access to the data used by the Administrator to determine whether or not an area is a HUBZone in the year in which the online tool was prepared.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id14832cb1-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/7/C"><num value="C" class="bold">(C)</num><heading class="bold"> Notification of update</heading><content><p style="-uslm-lc:I13" class="indent2">The Administrator shall include in the online tool a notification of the date on which the online tool, and the data used to create the online tool, will be updated.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cb2-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/8"><num value="8" class="bold">(8)</num><heading class="bold"> List of qualified HUBZone small business concerns</heading><chapeau>The Administrator shall establish and publicly maintain on the internet a list of qualified HUBZone small business concerns that shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id14832cb3-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/8/A"><num value="A">(A)</num><content> to the extent practicable, include the name, address, and type of business with respect to such concern;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id14832cb4-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/8/B"><num value="B">(B)</num><content> be updated by the Administrator not less than annually; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id14832cb5-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/8/C"><num value="C">(C)</num><content> be provided upon request to any Federal agency or other entity.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cb6-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/9"><num value="9" class="bold">(9)</num><heading class="bold"> Provision of data</heading><content><p style="-uslm-lc:I12" class="indent1">Upon the request of the Administrator, the Secretary of Labor, the Administrator of the Federal Emergency Management Agency, the Secretary of Housing and Urban Development, and the Secretary of the Interior (or the Assistant Secretary for Indian Affairs), shall promptly provide to the Administrator such information as the Administrator determines to be necessary to carry out this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cb7-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/d/10"><num value="10" class="bold">(10)</num><heading class="bold"> Penalties</heading><content><p style="-uslm-lc:I12" class="indent1">In addition to the penalties described in <ref href="/us/usc/t15/s645/d">section 645(d) of this title</ref>, any small business concern that is determined by the Administrator to have misrepresented the status of that concern as a “qualified HUBZone small business concern” for purposes of this section shall be subject to liability for fraud, including <ref href="/us/usc/t18/s1001">section 1001 of title 18</ref> and sections 3729 through 3733 of title 31.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id14832cb8-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e"><num value="e" class="bold">(e)</num><heading class="bold"> Performance metrics</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cb9-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 1 year after <date date="2017-12-12">December 12, 2017</date>, the Administrator shall publish performance metrics designed to measure the success of the HUBZone program established under this section in meeting the program’s objective of promoting economic development in economically distressed areas (as defined in <ref href="/us/usc/t15/s636/m/11">section 636(m)(11) of this title</ref>).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cba-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Collecting and managing HUBZone data</heading><content><p style="-uslm-lc:I12" class="indent1">The Administrator shall develop processes to incentivize each regional office of the Administration to collect and manage data on HUBZones within the geographic area served by such regional office.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id14832cbb-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Report</heading><chapeau>Not later than 90 days after the last day of each fiscal year, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report analyzing the data from the performance metrics established under this subsection and including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id148353cc-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e/3/A"><num value="A">(A)</num><content> the number of HUBZone small business concerns that lost certification as a qualified HUBZone small business concern because of the results of an examination performed under subsection (d)(5); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id148353cd-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/e/3/B"><num value="B">(B)</num><content> the number of those concerns that did not submit documentation to be recertified under subsection (d)(6).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id148353ce-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s657a/f"><num value="f" class="bold">(f)</num><heading class="bold"> Authorization of appropriations</heading><content><p style="-uslm-lc:I11" class="indent0">There is authorized to be appropriated to carry out the program established by this section $10,000,000 for each of fiscal years 2020 through 2025.</p>
