<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id77e4b4c4-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d"><num value="657d">§ 657d.</num><heading> Federal and State Technology Partnership Program</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e4b4c5-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section and <ref href="/us/usc/t15/s657e">section 657e of this title</ref>, the following definitions apply:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4c6-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Applicant</heading><content><p style="-uslm-lc:I12" class="indent1">The term “applicant” means an entity, organization, or individual that submits a proposal for an award or a cooperative agreement under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4c7-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Business advice and counseling</heading><content><p style="-uslm-lc:I12" class="indent1">The term “business advice and counseling” means providing advice and assistance on matters described in <ref href="/us/usc/t15/s657e/c/2/B">section 657e(c)(2)(B) of this title</ref> to small business concerns to guide them through the SBIR and STTR program process, from application to award and successful completion of each phase of the program.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4c8-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Catastrophic incident</heading><content><p style="-uslm-lc:I12" class="indent1">The term “catastrophic incident” means a major disaster that is comparable to the description of a catastrophic incident in the National Response Plan of the Administration, or any successor thereto.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4c9-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> FAST program</heading><content><p style="-uslm-lc:I12" class="indent1">The term “FAST program” means the Federal and State Technology Partnership Program established under this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4ca-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Mentor</heading><content><p style="-uslm-lc:I12" class="indent1">The term “mentor” means an individual described in <ref href="/us/usc/t15/s657e/c/2">section 657e(c)(2) of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4cb-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Mentoring Network</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Mentoring Network” means an association, organization, coalition, or other entity (including an individual) that meets the requirements of <ref href="/us/usc/t15/s657e/c">section 657e(c) of this title</ref>.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4cc-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/7"><num value="7" class="bold">(7)</num><heading class="bold"> Recipient</heading><content><p style="-uslm-lc:I12" class="indent1">The term “recipient” means a person that receives an award or becomes party to a cooperative agreement under this section.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4ce-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/9"><num value="9" class="bold">(9)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means each of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, and American Samoa.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4cf-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/a/10"><num value="10" class="bold">(10)</num><heading class="bold"> STTR program</heading><content><p style="-uslm-lc:I12" class="indent1">The term “STTR program” has the same meaning as in <ref href="/us/usc/t15/s638/e/6">section 638(e)(6) of this title</ref>.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e4b4d0-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/b"><num value="b" class="bold">(b)</num><heading class="bold"> Establishment of Program</heading><content><p style="-uslm-lc:I11" class="indent0">The Administrator shall establish a program to be known as the Federal and State Technology Partnership Program, the purpose of which shall be to strengthen the technological competitiveness of small business concerns in the States.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e4b4d1-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c"><num value="c" class="bold">(c)</num><heading class="bold"> Grants and cooperative agreements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4b4d2-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Joint review</heading><chapeau>In carrying out the FAST program under this section, the Administrator and the SBIR program managers at the National Science Foundation and the Department of Defense shall jointly review proposals submitted by applicants and may make awards or enter into cooperative agreements under this section based on the factors for consideration set forth in paragraph (2), in order to enhance or develop in a State—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4b4d3-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/A"><num value="A">(A)</num><content> technology research and development by small business concerns;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4b4d4-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/B"><num value="B">(B)</num><content> technology transfer from university research to technology-based small business concerns;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4b4d5-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/C"><num value="C">(C)</num><content> technology deployment and diffusion benefiting small business concerns;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4b4d6-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D"><num value="D">(D)</num><chapeau> the technological capabilities of small business concerns through the establishment or operation of consortia comprised of entities, organizations, or individuals, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id77e4b4d7-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D/i"><num value="i">(i)</num><content> State and local development agencies and entities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4b4d8-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D/ii"><num value="ii">(ii)</num><content> representatives of technology-based small business concerns;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4b4d9-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D/iii"><num value="iii">(iii)</num><content> industries and emerging companies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4b4da-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D/iv"><num value="iv">(iv)</num><content> universities; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4b4db-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/D/v"><num value="v">(v)</num><content> small business development centers; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4b4dc-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/E"><num value="E">(E)</num><chapeau> outreach, financial support, and technical assistance to technology-based small business concerns participating in or interested in participating in an SBIR program, including initiatives—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id77e4b4dd-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/E/i"><num value="i">(i)</num><content> to make grants or loans to companies to pay a portion or all of the cost of developing SBIR proposals;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4b4de-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/E/ii"><num value="ii">(ii)</num><content> to establish or operate a Mentoring Network within the FAST program to provide business advice and counseling that will assist small business concerns that have been identified by FAST program participants, program managers of participating SBIR agencies, the Administration, or other entities that are knowledgeable about the SBIR and STTR programs as good candidates for the SBIR and STTR programs, and that would benefit from mentoring, in accordance with <ref href="/us/usc/t15/s657e">section 657e of this title</ref>;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbef-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/E/iii"><num value="iii">(iii)</num><content> to create or participate in a training program for individuals providing SBIR outreach and assistance at the State and local levels; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf0-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/1/E/iv"><num value="iv">(iv)</num><content> to encourage the commercialization of technology developed through SBIR program funding.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dbf1-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Selection considerations</heading><chapeau>In making awards or entering into cooperative agreements under this section, the Administrator and the SBIR program managers referred to in paragraph (1)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dbf2-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/A"><num value="A">(A)</num><content> may only consider proposals by applicants that intend to use a portion of the Federal assistance provided under this section to provide outreach, financial support, or technical assistance to technology-based small business concerns participating in or interested in participating in the SBIR program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dbf3-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B"><num value="B">(B)</num><chapeau> shall consider, at a minimum—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf4-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/i"><num value="i">(i)</num><content> whether the applicant has demonstrated that the assistance to be provided would address unmet needs of small business concerns in the community, and whether it is important to use Federal funding for the proposed activities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf5-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/ii"><num value="ii">(ii)</num><content> whether the applicant has demonstrated that a need exists to increase the number or success of small high-technology businesses in the State, as measured by the number of first phase and second phase SBIR awards that have historically been received by small business concerns in the State;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf6-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/iii"><num value="iii">(iii)</num><content> whether the projected costs of the proposed activities are reasonable;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf7-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/iv"><num value="iv">(iv)</num><content> whether the proposal integrates and coordinates the proposed activities with other State and local programs assisting small high-technology firms in the State;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf8-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/v"><num value="v">(v)</num><content> the manner in which the applicant will measure the results of the activities to be conducted; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e4dbf9-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/vi"><num value="vi">(vi)</num><chapeau> whether the proposal addresses the needs of small business concerns—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id77e4dbfa-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/vi/I"><num value="I">(I)</num><content> owned and controlled by women;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id77e4dbfb-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/vi/II"><num value="II">(II)</num><content> owned and controlled by minorities; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id77e4dbfc-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/B/vi/III"><num value="III">(III)</num><content> located in areas that have historically not participated in the SBIR and STTR programs; and</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dbfd-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/2/C"><num value="C">(C)</num><content> shall give special consideration to an applicant that is located in an area affected by a catastrophic incident.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dbfe-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Proposal limit</heading><content><p style="-uslm-lc:I12" class="indent1">Not more than one proposal may be submitted for inclusion in the FAST program under this section to provide services in any one State in any 1 fiscal year.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dbff-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Process</heading><content><p style="-uslm-lc:I12" class="indent1">Proposals and applications for assistance under this section shall be in such form and subject to such procedures as the Administrator shall establish. The Administrator shall promulgate regulations establishing standards for the consideration of proposals under paragraph (2), including standards regarding each of the considerations identified in paragraph (2)(B).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dc00-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Additional assistance for catastrophic incidents</heading><chapeau>Upon application by an applicant that receives an award or has in effect a cooperative agreement under this section and that is located in an area affected by a catastrophic incident, the Administrator may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc01-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/5/A"><num value="A">(A)</num><content> provide additional assistance to the applicant; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc02-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/c/5/B"><num value="B">(B)</num><content> waive the matching requirements under subsection (e)(2).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e4dc03-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d"><num value="d" class="bold">(d)</num><heading class="bold"> Cooperation and coordination</heading><chapeau>In carrying out the FAST program under this section, the Administrator shall cooperate and coordinate with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id77e4dc04-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/1"><num value="1">(1)</num><content> Federal agencies required by <ref href="/us/usc/t15/s638">section 638 of this title</ref> to have an SBIR program; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id77e4dc05-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/2"><num value="2">(2)</num><chapeau> entities, organizations, and individuals actively engaged in enhancing or developing the technological capabilities of small business concerns, including—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc06-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/2/A"><num value="A">(A)</num><content> State and local development agencies and entities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc07-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/2/B"><num value="B">(B)</num><content> State committees established under the Experimental Program to Stimulate Competitive Research of the National Science Foundation (as established under <ref href="/us/usc/t42/s1862g">section 1862g of title 42</ref>);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc08-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/2/C"><num value="C">(C)</num><content> State science and technology councils; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e4dc09-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/d/2/D"><num value="D">(D)</num><content> representatives of technology-based small business concerns.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e4dc0a-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e"><num value="e" class="bold">(e)</num><heading class="bold"> Administrative requirements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dc0b-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Competitive basis</heading><content><p style="-uslm-lc:I12" class="indent1">Awards and cooperative agreements under this section shall be made or entered into, as applicable, on a competitive basis.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e4dc0c-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Matching requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id77e4dc0d-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau>The non-Federal share of the cost of an activity (other than a planning activity) carried out using an award or under a cooperative agreement under this section shall be—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id77e5031e-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/A/i"><num value="i">(i)</num><content> 50 cents for each Federal dollar, in the case of a recipient that will serve small business concerns located in one of the 18 States receiving the fewest SBIR first phase awards (as described in <ref href="/us/usc/t15/s638/e/4/A">section 638(e)(4)(A) of this title</ref>);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e5031f-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/A/ii"><num value="ii">(ii)</num><content> except as provided in subparagraph (B), 1 dollar for each Federal dollar, in the case of a recipient that will serve small business concerns located in one of the 16 States receiving the greatest number of such SBIR first phase awards; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e50320-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/A/iii"><num value="iii">(iii)</num><content> except as provided in subparagraph (B), 75 cents for each Federal dollar, in the case of a recipient that will serve small business concerns located in a State that is not described in clause (i) or (ii) that is receiving such SBIR first phase awards.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id77e50321-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Low-income areas</heading><content><p style="-uslm-lc:I13" class="indent2">The non-Federal share of the cost of the activity carried out using an award or under a cooperative agreement under this section shall be 50 cents for each Federal dollar that will be directly allocated by a recipient described in subparagraph (A) to serve small business concerns located in a qualified census tract, as that term is defined in section 42(d)(5)(C)(ii) <ref class="footnoteRef" idref="fn002227">1</ref><note type="footnote" id="fn002227"><num>1</num> See References in Text note below.</note> of title 26. Federal dollars not so allocated by that recipient shall be subject to the matching requirements of subparagraph (A).</p>

<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id77e50322-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Types of funding</heading><content><p style="-uslm-lc:I13" class="indent2">The non-Federal share of the cost of an activity carried out by a recipient shall be comprised of not less than 50 percent cash and not more than 50 percent of indirect costs and in-kind contributions, except that no such costs or contributions may be derived from funds from any other Federal program.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id77e50323-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Rankings</heading><content><p style="-uslm-lc:I13" class="indent2">For purposes of subparagraph (A), the Administrator shall reevaluate the ranking of a State once every 2 fiscal years, beginning with fiscal year 2001, based on the most recent statistics compiled by the Administrator.</p>

</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e50324-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Duration</heading><content><p style="-uslm-lc:I12" class="indent1">Awards may be made or cooperative agreements entered into under this section for multiple years, not to exceed 5 years in total.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e50325-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f"><num value="f" class="bold">(f)</num><heading class="bold"> Reports</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e50326-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Initial report</heading><chapeau>Not later than 120 days after <date date="2000-12-21">December 21, 2000</date>, the Administrator shall prepare and submit to the Committee on Small Business of the Senate and the Committee on Science and the Committee on Small Business of the House of Representatives a report, which shall include, with respect to the FAST program, including Mentoring Networks—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e50327-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/1/A"><num value="A">(A)</num><content> a description of the structure and procedures of the program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e50328-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/1/B"><num value="B">(B)</num><content> a management plan for the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e50329-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/1/C"><num value="C">(C)</num><content> a description of the merit-based review process to be used in the program.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e5032a-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Annual reports</heading><chapeau>The Administrator shall submit an annual report to the Committee on Small Business of the Senate and the Committee on Science and the Committee on Small Business of the House of Representatives regarding—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e5032b-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2/A"><num value="A">(A)</num><content> the number and amount of awards provided and cooperative agreements entered into under the FAST program during the preceding year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e5032c-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2/B"><num value="B">(B)</num><content> a list of recipients under this section, including their location and the activities being performed with the awards made or under the cooperative agreements entered into; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e5032d-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2/C"><num value="C">(C)</num><chapeau> the Mentoring Networks and the mentoring database, as provided for under <ref href="/us/usc/t15/s657e">section 657e of this title</ref>, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id77e5032e-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2/C/i"><num value="i">(i)</num><content> the status of the inclusion of mentoring information in the database required by <ref href="/us/usc/t15/s638/k">section 638(k) of this title</ref>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id77e5032f-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/f/2/C/ii"><num value="ii">(ii)</num><content> the status of the implementation and description of the usage of the Mentoring Networks.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e50330-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/g"><num value="g" class="bold">(g)</num><heading class="bold"> Reviews by Inspector General</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e50331-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><chapeau>The Inspector General of the Administration shall conduct a review of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id77e50332-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/g/1/A"><num value="A">(A)</num><content> the extent to which recipients under the FAST program are measuring the performance of the activities being conducted and the results of such measurements; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id77e50333-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/g/1/B"><num value="B">(B)</num><content> the overall management and effectiveness of the FAST program.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e50334-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I12" class="indent1">During the first quarter of fiscal year 2004, the Inspector General of the Administration shall submit a report to the Committee on Small Business of the Senate and the Committee on Science and the Committee on Small Business of the House of Representatives on the review conducted under paragraph (1).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id77e52a45-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/h"><num value="h" class="bold">(h)</num><heading class="bold"> Program levels</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e52a46-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">There is authorized to be appropriated to carry out the FAST program, including Mentoring Networks, under this section and <ref href="/us/usc/t15/s657e">section 657e of this title</ref>, $10,000,000 for each of fiscal years 2001 through 2005.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id77e52a47-2a8a-11e7-afaa-fbd9ab76935d" identifier="/us/usc/t15/s657d/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Mentoring database</heading><content><p style="-uslm-lc:I12" class="indent1">Of the total amount made available under paragraph (1) for fiscal years 2001 through 2005, a reasonable amount, not to exceed a total of $500,000, may be used by the Administration to carry out <ref href="/us/usc/t15/s657e/d">section 657e(d) of this title</ref>.</p>
