<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id15d723ce-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246"><num value="7246">§ 7246.</num><heading> Fair funds for investors</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id15d723cf-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/a"><num value="a" class="bold">(a)</num><heading class="bold"> Civil penalties to be used for the relief of victims</heading><content><p style="-uslm-lc:I11" class="indent0">If, in any judicial or administrative action brought by the Commission under the securities laws, the Commission obtains a civil penalty against any person for a violation of such laws, or such person agrees, in settlement of any such action, to such civil penalty, the amount of such civil penalty shall, on the motion or at the direction of the Commission, be added to and become part of a disgorgement fund or other fund established for the benefit of the victims of such violation.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id15d723d0-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/b"><num value="b" class="bold">(b)</num><heading class="bold"> Acceptance of additional donations</heading><content><p style="-uslm-lc:I11" class="indent0">The Commission is authorized to accept, hold, administer, and utilize gifts, bequests and devises of property, both real and personal, to the United States for a disgorgement fund or other fund described in subsection (a). Such gifts, bequests, and devises of money and proceeds from sales of other property received as gifts, bequests, or devises shall be deposited in such fund and shall be available for allocation in accordance with subsection (a).</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id15d723d1-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/c"><num value="c" class="bold">(c)</num><heading class="bold"> Study required</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id15d723d2-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Subject of study</heading><chapeau>The Commission shall review and analyze—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id15d723d3-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/c/1/A"><num value="A">(A)</num><content> enforcement actions by the Commission over the five years preceding <date date="2002-07-30">July 30, 2002</date>, that have included proceedings to obtain civil penalties or disgorgements to identify areas where such proceedings may be utilized to efficiently, effectively, and fairly provide restitution for injured investors; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id15d74ae4-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/c/1/B"><num value="B">(B)</num><content> other methods to more efficiently, effectively, and fairly provide restitution to injured investors, including methods to improve the collection rates for civil penalties and disgorgements.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id15d74ae5-ab47-11ea-b1b5-9f8f31ec3df0" identifier="/us/usc/t15/s7246/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Report required</heading><content><p style="-uslm-lc:I12" class="indent1">The Commission shall report its findings to the Committee on Financial Services of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate within 180 days after of <ref class="footnoteRef" idref="fn002536">1</ref><note type="footnote" id="fn002536"><num>1</num> So in original.
