<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id8f59c07d-9cee-11e3-93d2-f26b595ec9f4" identifier="/us/usc/t15/s8403"><num value="8403">§ 8403.</num><heading> Negative option marketing on the Internet</heading>
<chapeau style="-uslm-lc:I11" class="indent0">It shall be unlawful for any person to charge or attempt to charge any consumer for any goods or services sold in a transaction effected on the Internet through a negative option feature (as defined in the Federal Trade Commission’s Telemarketing Sales Rule in part 310 of title 16, Code of Federal Regulations), unless the person—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id8f59c07e-9cee-11e3-93d2-f26b595ec9f4" identifier="/us/usc/t15/s8403/1"><num value="1">(1)</num><content> provides text that clearly and conspicuously discloses all material terms of the transaction before obtaining the consumer’s billing information;</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8f59c07f-9cee-11e3-93d2-f26b595ec9f4" identifier="/us/usc/t15/s8403/2"><num value="2">(2)</num><content> obtains a consumer’s express informed consent before charging the consumer’s credit card, debit card, bank account, or other financial account for products or services through such transaction; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id8f59c080-9cee-11e3-93d2-f26b595ec9f4" identifier="/us/usc/t15/s8403/3"><num value="3">(3)</num><content> provides simple mechanisms for a consumer to stop recurring charges from being placed on the consumer’s credit card, debit card, bank account, or other financial account.</content>
