<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2d95cf31-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705"><num value="8705">§ 8705.</num><heading> Assessments</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf32-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/a"><num value="a" class="bold">(a)</num><heading class="bold"> Assessments</heading><content><p style="-uslm-lc:I11" class="indent0">The order shall provide that assessments shall be paid by a manufacturer if the manufacturer has manufactured concrete masonry products during a period of at least 180 days prior to the date the assessment is to be remitted.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf33-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/b"><num value="b" class="bold">(b)</num><heading class="bold"> Collection</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf34-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Assessments required under the order shall be remitted by the manufacturer to the Board in the manner prescribed by the order.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf35-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Timing</heading><content><p style="-uslm-lc:I12" class="indent1">The order shall provide that assessments required under the order shall be remitted to the Board not less frequently than quarterly.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf36-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Records</heading><content><p style="-uslm-lc:I12" class="indent1">As part of the remittance of assessments, manufacturers shall identify the total amount due in assessments on all sales receipts, invoices or other commercial documents of sale as a result of the sale of concrete masonry units in a manner as prescribed by the Board to ensure compliance with the order.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf37-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c"><num value="c" class="bold">(c)</num><heading class="bold"> Assessment rates</heading><chapeau>With respect to assessment rates, the order shall contain the following terms:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf38-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Initial rate</heading><content><p style="-uslm-lc:I12" class="indent1">The assessment rate on concrete masonry products shall be $0.01 per concrete masonry unit sold.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf39-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Changes in the rate</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2d95cf3a-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Authority to change rate</heading><content><p style="-uslm-lc:I13" class="indent2">The Board shall have the authority to change the assessment rate. A two-thirds majority of voting members of the Board shall be required to approve a change in the assessment rate.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2d95cf3b-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation on increases</heading><content><p style="-uslm-lc:I13" class="indent2">An increase or decrease in the assessment rate with respect to concrete masonry products may not exceed $0.01 per concrete masonry unit sold.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2d95cf3c-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Maximum rate</heading><content><p style="-uslm-lc:I13" class="indent2">The assessment rate shall not be in excess of $0.05 per concrete masonry unit.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2d95cf3d-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/c/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Limitation on frequency of changes</heading><content><p style="-uslm-lc:I13" class="indent2">The assessment rate may not be increased or decreased more than once annually.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf3e-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/d"><num value="d" class="bold">(d)</num><heading class="bold"> Late-payment and interest charges</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf3f-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Late-payment and interest charges may be levied on each person subject to the order who fails to remit an assessment in accordance with subsection (b).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf40-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Rate</heading><content><p style="-uslm-lc:I12" class="indent1">The rate for late-payment and interest charges shall be specified by the Secretary.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf41-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/e"><num value="e" class="bold">(e)</num><heading class="bold"> Investment of assessments</heading><chapeau>Pending disbursement of assessments under a budget approved by the Secretary, the Board may invest assessments collected under this section in—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2d95cf42-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/e/1"><num value="1">(1)</num><content> obligations of the United States or any agency of the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2d95cf43-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/e/2"><num value="2">(2)</num><content> general obligations of any State or any political subdivision of a State;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2d95cf44-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/e/3"><num value="3">(3)</num><content> interest-bearing accounts or certificates of deposit of financial institutions that are members of the Federal Reserve System; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2d95cf45-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/e/4"><num value="4">(4)</num><content> obligations fully guaranteed as to principal and interest by the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2d95cf46-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f"><num value="f" class="bold">(f)</num><heading class="bold"> Assessment funds for regional initiatives</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf47-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The order shall provide that not less than 50 percent of the assessments (less administration expenses) paid by a manufacturer shall be used to support research, education, and promotion programs and projects in support of the geographic region of the manufacturer.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf48-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Geographic regions</heading><chapeau>The order shall provide for the following geographic regions:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2d95cf49-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2/A"><num value="A">(A)</num><content> Region I shall comprise Connecticut, Delaware, the District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont, and West Virginia.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2d95cf4a-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2/B"><num value="B">(B)</num><content> Region II shall comprise Alabama, Florida, Georgia, Mississippi, North Carolina, South Carolina, Tennessee, and Virginia.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2d95cf4b-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2/C"><num value="C">(C)</num><content> Region III shall comprise Illinois, Indiana, Iowa, Kentucky, Michigan, Minnesota, Nebraska, North Dakota, Ohio, South Dakota, and Wisconsin.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2d95cf4c-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2/D"><num value="D">(D)</num><content> Region IV shall comprise Arizona, Arkansas, Kansas, Louisiana, Missouri, New Mexico, Oklahoma, and Texas.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2d95cf4d-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/2/E"><num value="E">(E)</num><content> Region V shall comprise Alaska, California, Colorado, Hawaii, Idaho, Montana, Nevada, Oregon, Utah, Washington, and Wyoming.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2d95cf4e-a3d3-11e9-83b4-b8c8a2a68a45" identifier="/us/usc/t15/s8705/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Adjustment of geographic regions</heading><content><p style="-uslm-lc:I12" class="indent1">The order shall provide that the Secretary may, upon recommendation of the Board, modify the composition of the geographic regions described in paragraph (2).</p>
