</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7965-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Opal Creek Wilderness</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Opal Creek Wilderness” means certain land in the Willamette National Forest in the State of Oregon comprising approximately 12,800 acres, as generally depicted on the map entitled “Proposed Opal Creek Wilderness and Scenic Recreation Area”, dated July 1996.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7966-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Scenic Recreation Area</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Scenic Recreation Area” means the Opal Creek Scenic Recreation Area, comprising approximately 13,000 acres, as generally depicted on the map entitled “Proposed Opal Creek Wilderness and Scenic Recreation Area”, dated July 1996 and established under subsection (c)(1)(C).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7967-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Agriculture.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d7968-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/b"><num value="b" class="bold">(b)</num><heading class="bold"> Purposes</heading><chapeau>The purposes of this section are—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idff4d7969-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/b/1"><num value="1">(1)</num><content> to establish a wilderness and scenic recreation area to protect and provide for the enhancement of the natural, scenic, recreational, historic and cultural resources of the area in the vicinity of Opal Creek;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idff4d796a-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/b/2"><num value="2">(2)</num><content> to protect and support the economy of the communities of the Santiam Canyon; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idff4d796b-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/b/3"><num value="3">(3)</num><content> to provide increased protection for an important drinking water source for communities served by the North Santiam River.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d796c-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c"><num value="c" class="bold">(c)</num><heading class="bold"> Establishment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d796d-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><chapeau>On a determination by the Secretary under paragraph (2)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d796e-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/1/A"><num value="A">(A)</num><content> the Opal Creek Wilderness, as depicted on the map described in subsection (a)(2), is hereby designated as wilderness, subject to the provisions of the Wilderness Act [<ref href="/us/usc/t16/s1131">16 U.S.C. 1131</ref> et seq.], shall become a component of the National Wilderness System, and shall be known as the Opal Creek Wilderness;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d796f-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/1/B"><num value="B">(B)</num><content> the part of the Bull of the Woods Wilderness that is located in the Willamette National Forest shall be incorporated into the Opal Creek Wilderness; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d7970-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/1/C"><num value="C">(C)</num><content> the Secretary shall establish the Opal Creek Scenic Recreation Area in the Willamette National Forest in the State of Oregon, comprising approximately 13,000 acres, as generally depicted on the map described in subsection (a)(3).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7971-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Conditions</heading><chapeau>The designations in paragraph (1) shall not take effect unless the Secretary makes a determination, not later than 2 years after <date date="1996-11-12">November 12, 1996</date>, that the following conditions have been met:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d7972-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A"><num value="A">(A)</num><chapeau> the following have been donated to the United States in an acceptable condition and without encumbrances:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idff4d7973-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/i"><num value="i">(i)</num><chapeau> all right, title, and interest in the following patented parcels of land—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idff4d7974-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/i/I"><num value="I">(I)</num><content> Santiam Number 1, mineral survey number 992, as described in patent number 39–92–0002, dated <date date="1991-12-11">December 11, 1991</date>;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idff4d7975-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/i/II"><num value="II">(II)</num><content> Ruth Quartz Mine Number 2, mineral survey number 994, as described in patent number 39–91–0012, dated <date date="1991-02-12">February 12, 1991</date>;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idff4d7976-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/i/III"><num value="III">(III)</num><content> Morning Star Lode, mineral survey number 993, as described in patent number 36–91–0011, dated <date date="1991-02-12">February 12, 1991</date>;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7977-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/ii"><num value="ii">(ii)</num><content> all right, title, and interest held by any entity other than the Times Mirror Land and Timber Company, its successors and assigns, in and to lands located in section 18, township 8 south, range 5 east, Marion County, Oregon, Eureka numbers 6, 7, 8, and 13 mining claims; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7978-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/A/iii"><num value="iii">(iii)</num><content> an easement across the Hewitt, Starvation, and Poor Boy Mill Sites, mineral survey number 990, as described in patent number 36–91–0017, dated <date date="1991-05-09">May 9, 1991</date>. In the sole discretion of the Secretary, such easement may be limited to administrative use if an alternative access route, adequate and appropriate for public use, is provided.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d7979-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/B"><num value="B">(B)</num><chapeau> a binding agreement has been executed by the Secretary and the owners of record as of <date date="1996-03-29">March 29, 1996</date>, of the following interests, specifying the terms and conditions for the disposition of such interests to the United States Government—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idff4d797a-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/B/i"><num value="i">(i)</num><content> The lode mining claims known as Princess Lode, Black Prince Lode, and King Number 4 Lode, embracing portions of sections 29 and 32, township 8 south, range 5 east, Willamette Meridian, Marion County, Oregon, the claims being more particularly described in the field notes and depicted on the plat of mineral survey number 887, Oregon; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d797b-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/2/B/ii"><num value="ii">(ii)</num><content> Ruth Quartz Mine Number 1, mineral survey number 994, as described in patent number 39–91–0012, dated <date date="1991-02-12">February 12, 1991</date>.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d797c-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Additions to the wilderness and scenic recreation areas</heading><subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d797d-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/3/A"><num value="A">(A)</num><content> Lands or interests in lands conveyed to the United States under this subsection shall be included in and become part of, as appropriate, Opal Creek Wilderness or the Opal Creek Scenic Recreation Area.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d797e-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/3/B"><num value="B">(B)</num><content> On acquiring all or substantially all of the land located in section 36, township 8 south, range 4 east, of the Willamette Meridian, Marion County, Oregon, commonly known as the Rosboro section by exchange, purchase from a willing seller, or by donation, the Secretary shall expand the boundary of the Scenic Recreation Area to include such land.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d797f-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/c/3/C"><num value="C">(C)</num><content> On acquiring all or substantially all of the land located in section 18, township 8 south, range 5 east, Marion County, Oregon, commonly known as the Time Mirror property, by exchange, purchase from a willing seller, or by donation, such land shall be included in and become a part of the Opal Creek Wilderness.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d7980-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d"><num value="d" class="bold">(d)</num><heading class="bold"> Administration</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7981-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall administer the Scenic Recreation Area in accordance with this section and the laws (including regulations) applicable to the National Forest System.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7982-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Opal Creek Management Plan</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7983-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 2 years after the date of establishment of the Scenic Recreation Area, the Secretary, in consultation with the advisory committee established under subsection (e)(1), shall prepare a comprehensive Opal Creek Management Plan (Management Plan) for the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7984-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Incorporation in land and resource management</heading><content><p style="-uslm-lc:I13" class="indent2">Upon its completion, the Opal Creek Management Plan shall become part of the land and resource management plan for the Willamette National Forest and supersede any conflicting provision in such land and resource management plan. Nothing in this paragraph shall be construed to supersede the requirements of the Endangered Species Act [<ref href="/us/usc/t16/s1531">16 U.S.C. 1531</ref> et seq.] or the National Forest Management Act or regulations promulgated under those Acts, or any other law.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7985-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Requirements</heading><chapeau>The Opal Creek Management Plan shall provide for a broad range of land uses, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idff4d7986-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/C/i"><num value="i">(i)</num><content> recreation;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7987-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/C/ii"><num value="ii">(ii)</num><content> harvesting of nontraditional forest products, such as gathering mushrooms and material to make baskets; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7988-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/C/iii"><num value="iii">(iii)</num><content> educational and research opportunities.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7989-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/2/D"><num value="D" class="bold">(D)</num><heading class="bold"> Plan amendments</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may amend the Opal Creek Management Plan as the Secretary may determine to be necessary, consistent with the procedures and purposes of this section.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d798a-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Cultural and historic resource inventory</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d798b-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Not later than 1 year after the date of establishment of the Scenic Recreation Area, the Secretary shall review and revise the inventory of the cultural and historic resources on the public land in the Scenic Recreation Area developed pursuant to the Oregon Wilderness Act of 1984 (<ref href="/us/pl/98/328">Public Law 98–328</ref>).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d798c-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Interpretation</heading><content><p style="-uslm-lc:I13" class="indent2">Interpretive activities shall be developed under the management plan in consultation with State and local historic preservation organizations and shall include a balanced and factual interpretation of the cultural, ecological, and industrial history of forestry and mining in the Scenic Recreation Area.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d798d-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Transportation planning</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d798e-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> <ref class="footnoteRef" idref="fn002402">1</ref><note type="footnote" id="fn002402"><num>1</num> So in original. No subpar. (B) has been enacted.</note> In general</heading><chapeau>Except as provided in this subparagraph, motorized vehicles shall not be permitted in the Scenic Recreation Area. To maintain reasonable motorized and other access to recreation sites and facilities in existence on <date date="1996-11-12">November 12, 1996</date>, the Secretary shall prepare a transportation plan for the Scenic Recreation Area that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idff4d798f-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A/i"><num value="i">(i)</num><content> evaluates the road network within the Scenic Recreation Area to determine which roads should be retained and which roads should be closed;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7990-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A/ii"><num value="ii">(ii)</num><content> provides guidelines for transportation and access consistent with this section;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7991-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A/iii"><num value="iii">(iii)</num><content> considers the access needs of persons with disabilities in preparing the transportation plan for the Scenic Recreation Area;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7992-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A/iv"><num value="iv">(iv)</num><content> allows forest road 2209 beyond the gate to the Scenic Recreation Area, as depicted on the map described in subsection (a)(2), to be used by motorized vehicles only for administrative purposes and for access by private inholders, subject to such terms and conditions as the Secretary may determine to be necessary; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d7993-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/4/A/v"><num value="v">(v)</num><content> restricts construction or improvement of forest road 2209 beyond the gate to the Scenic Recreation Area to maintaining the character of the road as it existed upon <date date="1996-11-12">November 12, 1996</date>, which shall not include paving or widening.</content>
</clause>
</subparagraph>

<continuation style="-uslm-lc:I17" class="indent1 firstIndent0">In order to comply with subsection (f)(2), the Secretary may make improvements to forest road 2209 and its bridge structures consistent with the character of the road as it existed on <date date="1996-11-12">November 12, 1996</date>.</continuation>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7994-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Hunting and fishing</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7995-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to applicable Federal and State law, the Secretary shall permit hunting and fishing in the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7996-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary may designate zones in which, and establish periods when, no hunting or fishing shall be permitted for reasons of public safety, administration, or public use and enjoyment of the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7997-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Consultation</heading><content><p style="-uslm-lc:I13" class="indent2">Except during an emergency, as determined by the Secretary, the Secretary shall consult with the Oregon State Department of Fish and Wildlife before issuing any regulation under this subsection.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d7998-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/6"><num value="6" class="bold">(6)</num><heading class="bold"> Timber cutting</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d7999-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to subparagraph (B), the Secretary shall prohibit the cutting and/or selling of trees in the Scenic Reservation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d799a-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Permitted cutting</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="idff4d799b-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/6/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><chapeau>Subject to clause (ii), the Secretary may allow the cutting of trees in the Scenic Recreation Area only—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idff4d799c-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/6/B/i/I"><num value="I">(I)</num><content> for public safety, such as to control the continued spread of a forest fire in the Scenic Recreation Area or on land adjacent to the Scenic Recreation Area;</content>

<subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d79a7-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/8/B"><num value="B">(B)</num><content> Nothing in this section shall be construed to interfere with the ability of the Secretary to approve and issue, or deny, special use permits in connection with exploration, mining, and mining-related activities in the Bornite Project Area.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d79a8-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/8/C"><num value="C">(C)</num><content> Motorized vehicles, roads, structures, and utilities (including but not limited to power lines and water lines) may be allowed inside the Scenic Recreation Area to serve the activities conducted on land within the Bornite Project.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="idff4d79a9-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/8/D"><num value="D">(D)</num><content> After <date date="1996-11-12">November 12, 1996</date>, no patent shall be issued for any mining claim under the general mining laws located within the Bornite Project Area.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79aa-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/9"><num value="9" class="bold">(9)</num><heading class="bold"> Water impoundments</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding the Federal Power Act (<ref href="/us/usc/t16/s791a">16 U.S.C. 791a</ref> et seq.), the Federal Energy Regulatory Commission may not license the construction of any dam, water conduit, reservoir, powerhouse, transmission line, or other project work in the Scenic Recreation Area, except as may be necessary to comply with the provisions of paragraph (8) with regard to the Bornite Project.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79ab-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/10"><num value="10" class="bold">(10)</num><heading class="bold"> Recreations</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79ac-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/10/A"><num value="A" class="bold">(A)</num><heading class="bold"> Recognition</heading><content><p style="-uslm-lc:I13" class="indent2">Congress recognizes recreation as an appropriate use of the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79ad-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/10/B"><num value="B" class="bold">(B)</num><heading class="bold"> Minimum levels</heading><content><p style="-uslm-lc:I13" class="indent2">The management plan shall permit recreation activities at not less than the levels in existence on <date date="1996-11-12">November 12, 1996</date>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79ae-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/10/C"><num value="C" class="bold">(C)</num><heading class="bold"> Higher levels</heading><content><p style="-uslm-lc:I13" class="indent2">The management plan may provide for levels of recreation use higher than the levels in existence on <date date="1996-11-12">November 12, 1996</date>, if such uses are consistent with the protection of the resource values of the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79af-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/10/D"><num value="D" class="bold">(D)</num><heading class="bold"> Public trail access</heading><content><p style="-uslm-lc:I13" class="indent2">The management plan may include public trail access through section 28, township 8 south, range 5 east, Willamette Meridian, to Battle Ax Creek, Opal Pool and other areas in the Opal Creek Wilderness and the Opal Creek Scenic Recreation Area.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79b0-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/11"><num value="11" class="bold">(11)</num><heading class="bold"> Participation</heading><chapeau>So that the knowledge, expertise, and views of all agencies and groups may contribute affirmatively to the most sensitive present and future use of the Scenic Recreation Area and its various subareas for the benefit of the public:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79b1-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/11/A"><num value="A" class="bold">(A)</num><heading class="bold"> Advisory council</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall consult on a periodic and regular basis with the advisory council established under subsection (e) with respect to matters relating to management of the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79b2-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/11/B"><num value="B" class="bold">(B)</num><heading class="bold"> Public participation</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall seek the views of private groups, individuals, and the public concerning the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79b3-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/11/C"><num value="C" class="bold">(C)</num><heading class="bold"> Other agencies</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall seek the views and assistance of, and cooperate with, any other Federal, State, or local agency with any responsibility for the zoning, planning, or natural resources of the Scenic Recreation Area.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79b4-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/d/11/D"><num value="D" class="bold">(D)</num><heading class="bold"> Nonprofit agencies and organizations</heading><content><p style="-uslm-lc:I13" class="indent2">The Secretary shall seek the views of any nonprofit agency or organization that may contribute information or expertise about the resources and the management of the Scenic Recreation Area.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d79b5-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e"><num value="e" class="bold">(e)</num><heading class="bold"> Advisory council</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79b6-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Establishment</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 90 days after the establishment of the Scenic Recreation Area, the Secretary shall establish an advisory council for the Scenic Recreation Area.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79b7-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Membership</heading><chapeau>The advisory council shall consist of not more than 13 members, of whom—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79b8-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2/A"><num value="A">(A)</num><content> 1 member shall represent Marion County, Oregon, and shall be designated by the governing body of the county;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79b9-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2/B"><num value="B">(B)</num><content> 1 member shall represent the State of Oregon and shall be designated by the Governor of Oregon;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79ba-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2/C"><num value="C">(C)</num><content> 1 member shall represent the City of Salem, and shall be designated by the mayor of Salem, Oregon;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79bb-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2/D"><num value="D">(D)</num><content> 1 member from a city within a 25-mile radius of the Opal Creek Scenic Recreation Area, to be designated by the Governor of the State of Oregon from a list of candidates provided by the mayors of the cities located within a 25-mile radius of the Opal Creek Scenic Recreation Area; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79bc-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/2/E"><num value="E">(E)</num><content> not more than 9 members shall be appointed by the Secretary from among persons who, individually or through association with a national or local organization, have an interest in the administration of the Scenic Recreation Area, including, but not limited to, representatives of the timber industry, environmental organizations, the mining industry, inholders in the Opal Creek Wilderness and Scenic Recreation Area, economic development interests and Indian tribes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79bd-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Staggered terms</heading><content><p style="-uslm-lc:I12" class="indent1">Members of the advisory council shall serve for staggered terms of 3 years.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79be-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Chairman</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall designate 1 member of the advisory council as chairman.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79bf-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/5"><num value="5" class="bold">(5)</num><heading class="bold"> Vacancies</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary shall fill a vacancy on the advisory council in the same manner as the original appointment.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79c0-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/e/6"><num value="6" class="bold">(6)</num><heading class="bold"> Compensation</heading><content><p style="-uslm-lc:I12" class="indent1">Members of the advisory council shall receive no compensation for their service on the advisory council.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d79c1-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f"><num value="f" class="bold">(f)</num><heading class="bold"> General provisions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79c2-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> Land acquisition</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79c3-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Subject to the other provisions of this section, the Secretary may acquire any lands or interests in land in the Scenic Recreation Area or the Opal Creek Wilderness that the Secretary determines are needed to carry out this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79c4-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Public land</heading><content><p style="-uslm-lc:I13" class="indent2">Any lands or interests in land owned by a State or a political subdivision of a State may be acquired only by donation or exchange.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79c5-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Condemnation</heading><chapeau>Within the boundaries of the Opal Creek Wilderness or the Scenic Recreation Area, the Secretary may not acquire any privately owned land or interest in land without the consent of the owner unless the Secretary finds that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idff4d79c6-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/C/i"><num value="i">(i)</num><content> the nature of land use has changed significantly, or the landowner has demonstrated intent to change the land use significantly, from the use that existed on <date date="1996-11-12">November 12, 1996</date>; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idff4d79c7-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/C/ii"><num value="ii">(ii)</num><content> acquisition by the Secretary of the land or interest in land is essential to ensure use of the land or interest in land in accordance with the purposes of this title <ref class="footnoteRef" idref="fn002405">4</ref><note type="footnote" id="fn002405"><num>4</num> So in original. Probably should be “section”.</note> or the management plan prepared under subsection (d)(2).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79c8-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Construction</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this section shall be construed to enhance or diminish the condemnation authority available to the Secretary outside the boundaries of the Opal Creek Wilderness or the Scenic Recreation Area.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79c9-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Environmental response actions and cost recovery</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79ca-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Response actions</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this section shall limit the authority of the Secretary or a responsible party to conduct an environmental response action in the Scenic Recreation Area in connection with the release, threatened release, or cleanup of a hazardous substance, pollutant, or contaminant, including a response action conducted under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<ref href="/us/usc/t42/s9601">42 U.S.C. 9601</ref> et seq.).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79cb-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Liability</heading><content><p style="-uslm-lc:I13" class="indent2">Nothing in this section shall limit the authority of the Secretary or a responsible party to recover costs related to the release, threatened release, or cleanup of any hazardous substance or pollutant or contaminant in the Scenic Recreation Area.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79cc-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/3"><num value="3" class="bold">(3)</num><heading class="bold"> Maps and description</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79cd-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">As soon as practicable after <date date="1996-11-12">November 12, 1996</date>, the Secretary shall file a map and a boundary description for the Opal Creek Wilderness and for the Scenic Recreation Area with the Committee on Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79ce-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Force and effect</heading><content><p style="-uslm-lc:I13" class="indent2">The boundary description and map shall have the same force and effect as if the description and map were included in this section, except that the Secretary may correct clerical and typographical errors in the boundary description and map.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="idff4d79cf-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Availability</heading><content><p style="-uslm-lc:I13" class="indent2">The map and boundary description shall be on file and available for public inspection in the Office of the Chief of the Forest Service, Department of Agriculture.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79d0-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/f/4"><num value="4" class="bold">(4)</num><heading class="bold"> Savings provision</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this section shall interfere with activity for which a special use permit has been issued, has not been revoked, and has not expired, before <date date="1996-11-12">November 12, 1996</date>, subject to the terms of the permit.</p>

The appraisal shall consider access costs for the parcels involved.</p>

The court shall have the authority to order the Secretary to complete the transaction contemplated in this subsection.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idff4d79e3-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/i"><num value="i" class="bold">(i)</num><heading class="bold"> Economic development</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79e4-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Economic development plan</heading><content><p style="-uslm-lc:I12" class="indent1">As a condition for receiving funding under paragraph (2), the State of Oregon, in consultation with Marion County, Oregon, and the Secretary of Agriculture, shall develop a plan for economic development projects for which grants under this subsection may be used in a manner consistent with this section and to benefit local communities in the vicinity of the Opal Creek area. Such plan shall be based on an economic opportunity study and other appropriate information.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idff4d79e5-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Funds provided to the States for grants</heading><content><p style="-uslm-lc:I12" class="indent1">Upon completion of the Opal Creek Management Plan, and receipt of the plan referred to in paragraph (1), the Secretary shall provide, subject to appropriations, $15,000,000 to the State of Oregon. Such funds shall be used to make grants or loans for economic development projects that further the purposes of this section and benefit the local communities in the vicinity of the Opal Creek area.</p>

<subparagraph style="-uslm-lc:I13" class="indent2" id="idff4d79e9-d384-11e6-b69b-ae63742e6266" identifier="/us/usc/t16/s545b/i/3/C"><num value="C">(C)</num><content> as loans are repaid, make additional grants and loans with the money made available for obligation by such repayments.</content>
