<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155ab8b2-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Director</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Director” means the Director of the Bureau of Land Management.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155ab8b3-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Projects</heading><content><p style="-uslm-lc:I11" class="indent0">The Chief and the Director, via agreement or contract as appropriate, may enter into stewardship contracting projects with private persons or other public or private entities to perform services to achieve land management goals for the national forests and the public lands that meet local and rural community needs.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155adfc4-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Land management goals</heading><chapeau>The land management goals of a project under subsection (b) may include any of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id155adfc5-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/1"><num value="1">(1)</num><content> Road and trail maintenance or obliteration to restore or maintain water quality.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfc6-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/2"><num value="2">(2)</num><content> Soil productivity, habitat for wildlife and fisheries, or other resource values.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfc7-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/3"><num value="3">(3)</num><content> Setting of prescribed fires to improve the composition, structure, condition, and health of stands or to improve wildlife habitat.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfc8-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/4"><num value="4">(4)</num><content> Removing vegetation or other activities to promote healthy forest stands, reduce fire hazards, or achieve other land management objectives.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfc9-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/5"><num value="5">(5)</num><content> Watershed restoration and maintenance.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfca-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/6"><num value="6">(6)</num><content> Restoration and maintenance of wildlife and fish.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155adfcb-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/c/7"><num value="7">(7)</num><content> Control of noxious and exotic weeds and reestablishing native plant species.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155adfcc-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d"><num value="d" class="bold">(d)</num><heading class="bold"> Agreements or contracts</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfcd-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Procurement procedure</heading><content><p style="-uslm-lc:I12" class="indent1">A source for performance of an agreement or contract under subsection (b) shall be selected on a best-value basis, including consideration of source under other public and private agreements or contracts.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfce-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Contract for sale of property</heading><content><p style="-uslm-lc:I12" class="indent1">A contract entered into under this section may, at the discretion of the Secretary of Agriculture, be considered a contract for the sale of property under such terms as the Secretary may prescribe without regard to any other provision of law.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfcf-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/3"><num value="3" class="bold">(3)</num><heading class="bold"> Term</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id155adfd0-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), the Chief and the Director may enter into a contract under subsection (b) in accordance with <ref href="/us/usc/t41/s3903">section 3903 of title 41</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfd2-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4"><num value="4" class="bold">(4)</num><heading class="bold"> Offsets</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id155adfd3-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The Chief and the Director may apply the value of timber or other forest products removed as an offset against the cost of services received under the agreement or contract described in subsection (b).</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id155adfd4-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Methods of appraisal</heading><chapeau>The value of timber or other forest products used as an offset under subparagraph (A)—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id155adfd5-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/B/i"><num value="i">(i)</num><content> shall be determined using appropriate methods of appraisal commensurate with the quantity of products to be removed; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id155adfd6-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/B/ii"><num value="ii">(ii)</num><chapeau> may—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id155adfd7-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/B/ii/I"><num value="I">(I)</num><content> be determined using a unit of measure appropriate to the contracts; and</content>

<subclause style="-uslm-lc:I16" class="indent4" id="id155adfd8-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/4/B/ii/II"><num value="II">(II)</num><content> may include valuing products on a per-acre basis.</content>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfd9-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/5"><num value="5" class="bold">(5)</num><heading class="bold"> Relation to other laws</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding subsections (d) and (g) of <ref href="/us/usc/t16/s472a">section 472a of this title</ref>, the Chief may enter into an agreement or contract under subsection (b). <paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfda-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/6"><num value="6" class="bold">(6)</num><heading class="bold"> Contracting officer</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding any other provision of law, the Secretary or the Secretary of the Interior may determine the appropriate contracting officer to enter into and administer an agreement or contract under subsection (b).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfdb-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/7"><num value="7" class="bold">(7)</num><heading class="bold"> Fire liability provisions</heading><chapeau>Not later than 90 days after <date date="2014-02-07">February 7, 2014</date>, the Chief shall issue for use in all contracts and agreements under this section fire liability provisions that are in substantially the same form as the fire liability provisions contained in—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id155adfdc-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/7/A"><num value="A">(A)</num><content> integrated resource timber contracts, as described in the Forest Service contract numbered 2400–13, part H, section H.4; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155adfdd-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/d/7/B"><num value="B">(B)</num><content> timber sale contracts conducted pursuant to <ref href="/us/usc/t16/s472a">section 472a of this title</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155adfde-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e"><num value="e" class="bold">(e)</num><heading class="bold"> Receipts</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfdf-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Chief and the Director may collect monies from an agreement or contract under subsection (b) if the collection is a secondary objective of negotiating the contract that will best achieve the purposes of this section.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155adfe0-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Use</heading><chapeau>Monies from an agreement or contract under subsection (b)—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id155b06f1-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/2/A"><num value="A">(A)</num><content> may be retained by the Chief and the Director; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b06f2-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/2/B"><num value="B">(B)</num><content> shall be available for expenditure without further appropriation at the project site from which the monies are collected or at another project site.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b06f3-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Relation to other laws</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id155b06f4-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/e/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Notwithstanding any other provision of law, the value of services received by the Chief or the Director under a stewardship contract project conducted under this section, and any payments made or resources provided by the contractor, Chief, or Director shall not be considered monies received from the National Forest System or the public lands.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155b06f6-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/f"><num value="f" class="bold">(f)</num><heading class="bold"> Costs of removal</heading><chapeau>Notwithstanding the fact that a contractor did not harvest the timber, the Chief may collect deposits from a contractor covering the costs of removal of timber or other forest products under—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id155b06f7-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/f/1"><num value="1">(1)</num><content> <ref href="/us/usc/t16/s490">section 490 of this title</ref>; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id155b06f8-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/f/2"><num value="2">(2)</num><content> <ref href="/us/usc/t16/s498">section 498 of this title</ref>.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155b06f9-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/g"><num value="g" class="bold">(g)</num><heading class="bold"> Performance and payment guarantees</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b06fa-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/g/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Chief and the Director may require performance and payment bonds under sections 28.103–2 and 28.103–3 of the Federal Acquisition Regulation, in an amount that the contracting officer considers sufficient to protect the investment in receipts by the Federal Government generated by the contractor from the estimated value of the forest products to be removed under a contract under subsection (b).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b06fb-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/g/2"><num value="2" class="bold">(2)</num><heading class="bold"> Excess offset value</heading><chapeau>If the offset value of the forest products exceeds the value of the resource improvement treatments, the Chief and the Director may—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id155b06fc-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/g/2/A"><num value="A">(A)</num><content> use the excess to satisfy any outstanding liabilities for cancelled agreements or contracts; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b06fd-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/g/2/B"><num value="B">(B)</num><content> if there are no outstanding liabilities described in subparagraph (A), apply the excess to other authorized stewardship projects.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155b06fe-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h"><num value="h" class="bold">(h)</num><heading class="bold"> Cancellation ceilings</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b06ff-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Notwithstanding <ref href="/us/usc/t41/s3903/b/1">section 3903(b)(1) of title 41</ref>, the Chief and the Director may obligate funds in stages that are economically or programmatically viable to cover any potential cancellation or termination costs for an agreement or contract under subsection (b).</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b0700-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> Advance notice to Congress of cancellation ceiling in excess of $25,000,000</heading><chapeau>Not later than 30 days before entering into a multiyear agreement or contract under subsection (b) that includes a cancellation ceiling in excess of $25,000,000, but does not include proposed funding for the costs of cancelling the agreement or contract up to that cancellation ceiling, the Chief or the Director, as applicable, shall submit to the Committee on Energy and Natural Resources and the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Natural Resources and the Committee on Agriculture of the House of Representatives a written notice that includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id155b0701-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/2/A"><num value="A">(A)</num><content> a description of the cancellation ceiling amounts proposed for each program year in the agreement or contract;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b0702-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/2/B"><num value="B">(B)</num><content> the reasons why the cancellation ceiling amounts described under subparagraph (A) were selected;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b0703-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/2/C"><num value="C">(C)</num><content> a description of the extent to which the costs of contract cancellation are not included in the budget for the agreement or contract; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b0704-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/2/D"><num value="D">(D)</num><content> an assessment of the financial risk of not including budgeting for the costs of agreement or contract cancellation.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b0705-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/h/3"><num value="3" class="bold">(3)</num><heading class="bold"> Transmittal of notice to OMB</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 14 days after the date on which written notice is provided under paragraph (2), the Chief or the Director, as appropriate, shall transmit a copy of the notice to the Director of the Office of Management and Budget.</p>

</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id155b0706-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/i"><num value="i" class="bold">(i)</num><heading class="bold"> Monitoring and evaluation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b0707-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Chief and the Director shall establish a multiparty monitoring and evaluation process that accesses the stewardship contracting projects conducted under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id155b2e18-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Participants</heading><chapeau>Other than the Chief and Director, participants in the process described in paragraph (1) may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id155b2e19-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/i/2/A"><num value="A">(A)</num><content> any cooperating governmental agencies, including tribal governments; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id155b2e1a-7657-11e9-9adc-9fc1fea319d6" identifier="/us/usc/t16/s6591c/i/2/B"><num value="B">(B)</num><content> any other interested groups or individuals.</content>
</subparagraph>
