<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa78e-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/1"><num value="1" class="bold">(1)</num><heading class="bold"> 1982 Convention</heading><content><p style="-uslm-lc:I12" class="indent1">The term “1982 Convention” means the United Nations Convention on the Law of the Sea of 10 December 1982.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa78f-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/2"><num value="2" class="bold">(2)</num><heading class="bold"> Agreement</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Agreement” means the Agreement for the Implementation of the Provisions of the United Nations Convention on the Law of the Sea of 10 December 1982 relating to the Conservation and Management of Straddling Fish Stocks and Highly Migratory Fish Stocks.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa790-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/3"><num value="3" class="bold">(3)</num><heading class="bold"> Commission</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Commission” means the Commission for the Conservation and Management of Highly Migratory Fish Stocks in the Western and Central Pacific Ocean established in accordance with this Convention.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa791-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/4"><num value="4" class="bold">(4)</num><heading class="bold"> Convention area</heading><content><p style="-uslm-lc:I12" class="indent1">The term “convention area” means all waters of the Pacific Ocean bounded to the south and to the east by the following line:</p>
<p style="-uslm-lc:I17" class="indent1 firstIndent0">From the south coast of Australia due south along the 141th meridian of east longitude to its intersection with the 55th parallel of south latitude; thence due east along the 55th parallel of south latitude to its intersection with the 150th meridian of east longitude; thence due south along the 150th meridian of east longitude to its intersection with the 60th parallel of south latitude; thence due east along the 60th parallel of south latitude to its intersection with the 130th meridian of west longitude; thence due north along the 130th meridian of west longitude to its intersection with the 4th parallel of south latitude; thence due west along the 4th parallel of south latitude to its intersection with the 150th meridian of west longitude; thence due north along the 150th meridian of west longitude.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa792-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/5"><num value="5" class="bold">(5)</num><heading class="bold"> Exclusive economic zone</heading><content><p style="-uslm-lc:I12" class="indent1">The term “exclusive economic zone” means the zone established by Presidential Proclamation Numbered 5030 of <date date="1983-03-10">March 10, 1983</date>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa793-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6"><num value="6" class="bold">(6)</num><heading class="bold"> Fishing</heading><chapeau>The term “fishing” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa794-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/A"><num value="A">(A)</num><content> searching for, catching, taking, or harvesting fish;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa795-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/B"><num value="B">(B)</num><content> attempting to search for, catch, take, or harvest fish;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa796-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/C"><num value="C">(C)</num><content> engaging in any other activity which can reasonably be expected to result in the locating, catching, taking, or harvesting of fish for any purpose;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa797-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/D"><num value="D">(D)</num><content> placing, searching for, or recovering fish aggregating devices or associated electronic equipment such as radio beacons;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa798-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/E"><num value="E">(E)</num><content> any operations at sea directly in support of, or in preparation for, any activity described in subparagraphs (A) through (D), including transshipment; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id4bcaa799-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/6/F"><num value="F">(F)</num><content> use of any other vessel, vehicle, aircraft, or hovercraft, for any activity described in subparagraphs (A) through (E) except for emergencies involving the health and safety of the crew or the safety of a vessel.</content>
</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79a-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/7"><num value="7" class="bold">(7)</num><heading class="bold"> Fishing vessel</heading><content><p style="-uslm-lc:I12" class="indent1">The term “fishing vessel” means any vessel used or intended for use for the purpose of fishing, including support ships, carrier vessels, and any other vessel directly involved in such fishing operations.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79b-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/8"><num value="8" class="bold">(8)</num><heading class="bold"> Highly migratory fish stocks</heading><content><p style="-uslm-lc:I12" class="indent1">The term “highly migratory fish stocks” means all fish stocks of the species listed in Annex 1 of the 1982 Convention, except sauries, occurring in the Convention Area,<ref class="footnoteRef" idref="fn002591">1</ref><note type="footnote" id="fn002591"><num>1</num> So in original. Probably should not be capitalized.</note> and such other species of fish as the Commission may determine.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79c-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/9"><num value="9" class="bold">(9)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Commerce.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79d-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/10"><num value="10" class="bold">(10)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means each of the several States of the United States, the District of Columbia, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, and any other commonwealth, territory, or possession of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79e-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/11"><num value="11" class="bold">(11)</num><heading class="bold"> Transhipment</heading><content><p style="-uslm-lc:I12" class="indent1">The term “transshipment” means the unloading of all or any of the fish on board a fishing vessel to another fishing vessel either at sea or in port.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id4bcaa79f-814b-11e4-b920-ed6d4eead01f" identifier="/us/usc/t16/s6901/12"><num value="12" class="bold">(12)</num><heading class="bold"> WCPFC Convention; Western and Central Pacific Convention</heading><content><p style="-uslm-lc:I12" class="indent1">The terms “WCPFC Convention” and “Western and Central Pacific Convention” means the Convention on the Conservation and Management of the Highly Migratory Fish Stocks in the Western and Central Pacific Ocean, (including any annexes, amendments, or protocols which are in force, or have come into force, for the United States) which was adopted at Honolulu, Hawaii, on <date date="2000-09-05">September 5, 2000</date>, by the Multilateral High Level Conference on the Highly Migratory Fish Stocks in the Western and Central Pacific Ocean.</p>
