<chapeau style="-uslm-lc:I11" class="indent0">In this chapter:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c487a-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/1"><num value="1" class="bold">(1)</num><heading class="bold"> Commission</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Commission” means the North Pacific Fisheries Commission established in accordance with the North Pacific Fisheries Convention.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c487b-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/2"><num value="2" class="bold">(2)</num><heading class="bold"> Commissioner</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Commissioner” means a United States Commissioner appointed under <ref href="/us/usc/t16/s7702/a">section 7702(a) of this title</ref>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c487c-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/3"><num value="3" class="bold">(3)</num><heading class="bold"> Convention Area</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Convention Area” means the area to which the Convention on the Conservation and Management of High Seas Fisheries Resources in the North Pacific Ocean applies under Article 4 of such Convention.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c487d-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/4"><num value="4" class="bold">(4)</num><heading class="bold"> Council</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Council” means the North Pacific Fishery Management Council, the Pacific Fishery Management Council, or the Western Pacific Fishery Management Council established under <ref href="/us/usc/t16/s1852">section 1852 of this title</ref>, as the context requires.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c487e-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/5"><num value="5" class="bold">(5)</num><heading class="bold"> Exclusive economic zone</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “exclusive economic zone” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7a2c487f-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/5/A"><num value="A">(A)</num><content> with respect to the United States, the zone established by Presidential Proclamation Numbered 5030 of <date date="1983-03-10">March 10, 1983</date> (<ref href="/us/usc/t16/s1453">16 U.S.C. 1453</ref> note); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7a2c4880-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/5/B"><num value="B">(B)</num><content> with respect to a foreign country, a designated zone similar to the zone referred to in subparagraph (A) for that country, consistent with international law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4881-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6"><num value="6" class="bold">(6)</num><heading class="bold"> Fisheries resources</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7a2c4882-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Except as provided in subparagraph (B), the term “fisheries resources” means all fish, mollusks, crustaceans, and other marine species caught by a fishing vessel within the Convention Area, as well as any products thereof.</p>

</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7a2c4883-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusions</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “fisheries resources” does not include—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7a2c4884-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/B/i"><num value="i">(i)</num><content> sedentary species insofar as they are subject to the sovereign rights of coastal nations consistent with Article 77, paragraph 4 of the 1982 Convention and indicator species of vulnerable marine ecosystems as listed in, or adopted pursuant to, Article 13, paragraph 5 of the North Pacific Fisheries Convention;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c4885-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/B/ii"><num value="ii">(ii)</num><content> catadromous species;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c4886-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/B/iii"><num value="iii">(iii)</num><content> marine mammals, marine reptiles, or seabirds; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c4887-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/6/B/iv"><num value="iv">(iv)</num><content> other marine species already covered by preexisting international fisheries management instruments within the area of competence of such instruments.</content>

</subparagraph>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4888-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7"><num value="7" class="bold">(7)</num><heading class="bold"> Fishing activities</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7a2c4889-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “fishing activities” means—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7a2c488a-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A/i"><num value="i">(i)</num><content> the actual or attempted searching for, catching, taking, or harvesting of fisheries resources;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c488b-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A/ii"><num value="ii">(ii)</num><content> engaging in any activity that can reasonably be expected to result in the locating, catching, taking, or harvesting of fisheries resources for any purpose;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c488c-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A/iii"><num value="iii">(iii)</num><content> the processing of fisheries resources at sea;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c488d-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A/iv"><num value="iv">(iv)</num><content> the transshipment of fisheries resources at sea or in port; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7a2c488e-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/A/v"><num value="v">(v)</num><content> any operation at sea in direct support of, or in preparation for, any activity described in clauses (i) through (iv), including transshipment.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id7a2c488f-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/7/B"><num value="B" class="bold">(B)</num><heading class="bold"> Exclusions</heading><content><p style="-uslm-lc:I13" class="indent2">The term “fishing activities” does not include any operation related to an emergency involving the health or safety of a crew member or the safety of a fishing vessel.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4890-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/8"><num value="8" class="bold">(8)</num><heading class="bold"> Fishing vessel</heading><content><p style="-uslm-lc:I12" class="indent1">The term “fishing vessel” means any vessel used or intended for use for the purpose of engaging in fishing activities, including a processing vessel, a support ship, a carrier vessel, or any other vessel directly engaged in such fishing activities.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4891-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/9"><num value="9" class="bold">(9)</num><heading class="bold"> High seas</heading><content><p style="-uslm-lc:I12" class="indent1">The term “high seas” does not include an area that is within the exclusive economic zone of the United States or of any other country.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4892-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/10"><num value="10" class="bold">(10)</num><heading class="bold"> North Pacific Fisheries Convention</heading><content><p style="-uslm-lc:I12" class="indent1">The term “North Pacific Fisheries Convention” means the Convention on the Conservation and Management of the High Seas Fisheries Resources in the North Pacific Ocean (including any annexes, amendments, or protocols that are in force, or have come into force) for the United States, which was adopted at Tokyo on <date date="2012-02-24">February 24, 2012</date>.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4893-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/11"><num value="11" class="bold">(11)</num><heading class="bold"> Person</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “person” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7a2c4894-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/11/A"><num value="A">(A)</num><content> any individual, whether or not a citizen or national of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7a2c4895-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/11/B"><num value="B">(B)</num><content> any corporation, partnership, association, or other entity, whether or not organized or existing under the laws of any State; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7a2c4896-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/11/C"><num value="C">(C)</num><content> any Federal, State, local, tribal, or foreign government or any entity of such government.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4897-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/12"><num value="12" class="bold">(12)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">Except as otherwise specifically provided, the term “Secretary” means the Secretary of Commerce.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4898-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/13"><num value="13" class="bold">(13)</num><heading class="bold"> State</heading><content><p style="-uslm-lc:I12" class="indent1">The term “State” means each of the several States of the United States, the District of Columbia, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, and any other commonwealth, territory, or possession of the United States.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c4899-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/14"><num value="14" class="bold">(14)</num><heading class="bold"> Straddling stock</heading><content><p style="-uslm-lc:I12" class="indent1">The term “straddling stock” means a stock of fisheries resources that migrates between, or occurs in, the economic exclusion zone of one or more parties to the Convention and the Convention Area.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id7a2c489a-6992-11f1-ab3f-8b4c043f8cd5" identifier="/us/usc/t16/s7701/15"><num value="15" class="bold">(15)</num><heading class="bold"> Transshipment</heading><content><p style="-uslm-lc:I12" class="indent1">The term “transshipment” means the unloading of any fisheries resources taken in the Convention Area from one fishing vessel to another fishing vessel either at sea or in port.</p>
