<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idd38297f2-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s1035"><num value="1035">§ 1035.</num><heading> False statements relating to health care matters</heading><subsection style="-uslm-lc:I11" class="indent0" id="idd38297f3-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s1035/a"><num value="a">(a)</num><chapeau> Whoever, in any matter involving a health care benefit program, knowingly and willfully—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idd38297f4-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s1035/a/1"><num value="1">(1)</num><content> falsifies, conceals, or covers up by any trick, scheme, or device a material fact; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idd38297f5-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s1035/a/2"><num value="2">(2)</num><content> makes any materially false, fictitious, or fraudulent statements or representations, or makes or uses any materially false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry,</content>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">in connection with the delivery of or payment for health care benefits, items, or services, shall be fined under this title or imprisoned not more than 5 years, or both.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idd38297f6-b211-11e9-bc44-d051d0f40dfd" identifier="/us/usc/t18/s1035/b"><num value="b">(b)</num><content> As used in this section, the term “health care benefit program” has the meaning given such term in <ref href="/us/usc/t18/s24/b">section 24(b) of this title</ref>.</content>
