<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74a1e765-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036"><num value="1036">§ 1036.</num><heading> Entry by false pretenses to any real property, vessel, or aircraft of the United States or secure area of any airport or seaport</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74a1e766-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/a"><num value="a">(a)</num><chapeau> Whoever, by any fraud or false pretense, enters or attempts to enter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e767-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/a/1"><num value="1">(1)</num><content> any real property belonging in whole or in part to, or leased by, the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e768-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/a/2"><num value="2">(2)</num><content> any vessel or aircraft belonging in whole or in part to, or leased by, the United States;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e769-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/a/3"><num value="3">(3)</num><content> any secure or restricted area of any seaport, designated as secure in an approved security plan, as required under <ref href="/us/usc/t46/s70103">section 70103 of title 46</ref>, United States Code, and the rules and regulations promulgated under that section; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e76a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/a/4"><num value="4">(4)</num><content> any secure area of any airport,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be punished as provided in subsection (b) of this section.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74a1e76b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/b"><num value="b">(b)</num><chapeau> The punishment for an offense under subsection (a) of this section is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e76c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/b/1"><num value="1">(1)</num><content> a fine under this title or imprisonment for not more than 10 years, or both, if the offense is committed with the intent to commit a felony; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e76d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/b/2"><num value="2">(2)</num><content> a fine under this title or imprisonment for not more than 6 months, or both, in any other case.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74a1e76e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/c"><num value="c">(c)</num><chapeau> As used in this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e76f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/c/1"><num value="1">(1)</num><content> the term “secure area” means an area access to which is restricted by the airport authority, captain of the seaport, or a public agency; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74a1e770-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1036/c/2"><num value="2">(2)</num><content> the term “airport” has the meaning given such term in <ref href="/us/usc/t49/s47102">section 47102 of title 49</ref>.</content>
