L. 108–187, § 4(a)(1), Dec. 16, 2003, 117 Stat. 2703.)","seq_in_title":427,"parent_identifier":"/us/usc/t18/ptI/ch47","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch47","level":"chapter","num":"CHAPTER 47—","heading":"FRAUD AND FALSE STATEMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74a1e775-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037\"><num value=\"1037\">§ 1037.</num><heading> Fraud and related activity in connection with electronic mail</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74a1e776-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>Whoever, in or affecting interstate or foreign commerce, knowingly—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e777-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a/1\"><num value=\"1\">(1)</num><content> accesses a protected computer without authorization, and intentionally initiates the transmission of multiple commercial electronic mail messages from or through such computer,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e778-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a/2\"><num value=\"2\">(2)</num><content> uses a protected computer to relay or retransmit multiple commercial electronic mail messages, with the intent to deceive or mislead recipients, or any Internet access service, as to the origin of such messages,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e779-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a/3\"><num value=\"3\">(3)</num><content> materially falsifies header information in multiple commercial electronic mail messages and intentionally initiates the transmission of such messages,</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e77a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a/4\"><num value=\"4\">(4)</num><content> registers, using information that materially falsifies the identity of the actual registrant, for five or more electronic mail accounts or online user accounts or two or more domain names, and intentionally initiates the transmission of multiple commercial electronic mail messages from any combination of such accounts or domain names, or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e77b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/a/5\"><num value=\"5\">(5)</num><content> falsely represents oneself to be the registrant or the legitimate successor in interest to the registrant of 5 or more Internet Protocol addresses, and intentionally initiates the transmission of multiple commercial electronic mail messages from such addresses,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">or conspires to do so, shall be punished as provided in subsection (b).</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74a1e77c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Penalties</inline>.—</heading><chapeau>The punishment for an offense under subsection (a) is—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e77d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/1\"><num value=\"1\">(1)</num><chapeau> a fine under this title, imprisonment for not more than 5 years, or both, if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e77e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/1/A\"><num value=\"A\">(A)</num><content> the offense is committed in furtherance of any felony under the laws of the United States or of any State; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e77f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/1/B\"><num value=\"B\">(B)</num><content> the defendant has previously been convicted under this section or section 1030, or under the law of any State for conduct involving the transmission of multiple commercial electronic mail messages or unauthorized access to a computer system;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e780-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2\"><num value=\"2\">(2)</num><chapeau> a fine under this title, imprisonment for not more than 3 years, or both, if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e781-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/A\"><num value=\"A\">(A)</num><content> the offense is an offense under subsection (a)(1);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e782-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/B\"><num value=\"B\">(B)</num><content> the offense is an offense under subsection (a)(4) and involved 20 or more falsified electronic mail or online user account registrations, or 10 or more falsified domain name registrations;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e783-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/C\"><num value=\"C\">(C)</num><content> the volume of electronic mail messages transmitted in furtherance of the offense exceeded 2,500 during any 24-hour period, 25,000 during any 30-day period, or 250,000 during any 1-year period;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e784-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/D\"><num value=\"D\">(D)</num><content> the offense caused loss to one or more persons aggregating $5,000 or more in value during any 1-year period;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e785-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/E\"><num value=\"E\">(E)</num><content> as a result of the offense any individual committing the offense obtained anything of value aggregating $5,000 or more during any 1-year period; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e786-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/2/F\"><num value=\"F\">(F)</num><content> the offense was undertaken by the defendant in concert with three or more other persons with respect to whom the defendant occupied a position of organizer or leader; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e787-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/b/3\"><num value=\"3\">(3)</num><content> a fine under this title or imprisonment for not more than 1 year, or both, in any other case.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74a1e788-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Forfeiture.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e789-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The court, in imposing sentence on a person who is convicted of an offense under this section, shall order that the defendant forfeit to the United States—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e78a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/c/1/A\"><num value=\"A\">(A)</num><content> any property, real or personal, constituting or traceable to gross proceeds obtained from such offense; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74a1e78b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/c/1/B\"><num value=\"B\">(B)</num><content> any equipment, software, or other technology used or intended to be used to commit or to facilitate the commission of such offense.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e78c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Procedures</inline>.—</heading><content>The procedures set forth in section 413 of the Controlled Substances Act (<ref href=\"/us/usc/t21/s853\">21 U.S.C. 853</ref>), other than subsection (d) of that section, and in Rule 32.2 of the Federal Rules of Criminal Procedure, shall apply to all stages of a criminal forfeiture proceeding under this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74a1e78d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e78e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Loss</inline>.—</heading><content>The term “loss” has the meaning given that term in <ref href=\"/us/usc/t18/s1030/e\">section 1030(e) of this title</ref>.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e78f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Materially</inline>.—</heading><content>For purposes of paragraphs (3) and (4) of subsection (a), header information or registration information is materially falsified if it is altered or concealed in a manner that would impair the ability of a recipient of the message, an Internet access service processing the message on behalf of a recipient, a person alleging a violation of this section, or a law enforcement agency to identify, locate, or respond to a person who initiated the electronic mail message or to investigate the alleged violation.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e790-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/d/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Multiple</inline>.—</heading><content>The term “multiple” means more than 100 electronic mail messages during a 24-hour period, more than 1,000 electronic mail messages during a 30-day period, or more than 10,000 electronic mail messages during a 1-year period.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74a1e791-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1037/d/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Other terms</inline>.—</heading><content>Any other term has the meaning given that term by section 3 of the CAN-SPAM Act of 2003.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id74a1e792-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/108/187/s4/a/1\">Pub.
