L. 110–179, § 2(a), Jan. 7, 2008, 121 Stat. 2556.)","seq_in_title":430,"parent_identifier":"/us/usc/t18/ptI/ch47","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch47","level":"chapter","num":"CHAPTER 47—","heading":"FRAUD AND FALSE STATEMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id83c22fc7-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040\"><num value=\"1040\">§ 1040.</num><heading> Fraud in connection with major disaster or emergency benefits</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id83c22fc8-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/a\"><num value=\"a\">(a)</num><chapeau> Whoever, in a circumstance described in subsection (b) of this section, knowingly—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83c22fc9-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/a/1\"><num value=\"1\">(1)</num><content> falsifies, conceals, or covers up by any trick, scheme, or device any material fact; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83c22fca-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/a/2\"><num value=\"2\">(2)</num><content> makes any materially false, fictitious, or fraudulent statement or representation, or makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or representation,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">in any matter involving any benefit authorized, transported, transmitted, transferred, disbursed, or paid in connection with a major disaster declaration under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href=\"/us/usc/t42/s5170\">42 U.S.C. 5170</ref>) or an emergency declaration under section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href=\"/us/usc/t42/s5191\">42 U.S.C. 5191</ref>), or in connection with any procurement of property or services related to any emergency or major disaster declaration as a prime contractor with the United States or as a subcontractor or supplier on a contract in which there is a prime contract with the United States, shall be fined under this title, imprisoned not more than 30 years, or both.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id83c22fcb-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/b\"><num value=\"b\">(b)</num><chapeau> A circumstance described in this subsection is any instance where—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83c22fcc-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/b/1\"><num value=\"1\">(1)</num><content> the authorization, transportation, transmission, transfer, disbursement, or payment of the benefit is in or affects interstate or foreign commerce;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83c22fcd-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/b/2\"><num value=\"2\">(2)</num><content> the benefit is transported in the mail at any point in the authorization, transportation, transmission, transfer, disbursement, or payment of that benefit; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id83c22fce-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/b/3\"><num value=\"3\">(3)</num><content> the benefit is a record, voucher, payment, money, or thing of value of the United States, or of any department or agency thereof.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id83c22fcf-4631-11e3-82e4-c7c00c991bd6\" identifier=\"/us/usc/t18/s1040/c\"><num value=\"c\">(c)</num><content> In this section, the term “benefit” means any record, voucher, payment, money or thing of value, good, service, right, or privilege provided by the United States, a State or local government, or other entity.</content>\n</subsection>\n<sourceCredit id=\"id83c22fd0-4631-11e3-82e4-c7c00c991bd6\">(Added <ref href=\"/us/pl/110/179/s2/a\">Pub.
