L. 113–4, title IX, § 906(a), Mar. 7, 2013, 127 Stat. 124.)","seq_in_title":51,"parent_identifier":"/us/usc/t18/ptI/ch7","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch7","level":"chapter","num":"CHAPTER 7—","heading":"ASSAULT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id743da766-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113\"><num value=\"113\">§ 113.</num><heading> Assaults within maritime and territorial jurisdiction</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id743da767-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a\"><num value=\"a\">(a)</num><chapeau> Whoever, within the special maritime and territorial jurisdiction of the United States, is guilty of an assault shall be punished as follows:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da768-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/1\"><num value=\"1\">(1)</num><content> Assault with intent to commit murder or a violation of section 2241 or 2242, by a fine under this title, imprisonment for not more than 20 years, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da769-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/2\"><num value=\"2\">(2)</num><content> Assault with intent to commit any felony, except murder or a violation of section 2241 or 2242, by a fine under this title or imprisonment for not more than ten years, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/3\"><num value=\"3\">(3)</num><content> Assault with a dangerous weapon, with intent to do bodily harm, by a fine under this title or imprisonment for not more than ten years, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/4\"><num value=\"4\">(4)</num><content> Assault by striking, beating, or wounding, by a fine under this title or imprisonment for not more than 1 year, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/5\"><num value=\"5\">(5)</num><content> Simple assault, by a fine under this title or imprisonment for not more than six months, or both, or if the victim of the assault is an individual who has not attained the age of 16 years, by fine under this title or imprisonment for not more than 1 year, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/6\"><num value=\"6\">(6)</num><content> Assault resulting in serious bodily injury, by a fine under this title or imprisonment for not more than ten years, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/7\"><num value=\"7\">(7)</num><content> Assault resulting in substantial bodily injury to a spouse or intimate partner, a dating partner, or an individual who has not attained the age of 16 years, by a fine under this title or imprisonment for not more than 5 years, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da76f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/a/8\"><num value=\"8\">(8)</num><content> Assault of a spouse, intimate partner, or dating partner by strangling, suffocating, or attempting to strangle or suffocate, by a fine under this title, imprisonment for not more than 10 years, or both.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id743da770-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da771-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/1\"><num value=\"1\">(1)</num><chapeau> the term “substantial bodily injury” means bodily injury which involves—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id743da772-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/1/A\"><num value=\"A\">(A)</num><content> a temporary but substantial disfigurement; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id743da773-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/1/B\"><num value=\"B\">(B)</num><content> a temporary but substantial loss or impairment of the function of any bodily member, organ, or mental faculty;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da774-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/2\"><num value=\"2\">(2)</num><content> the term “serious bodily injury” has the meaning given that term in <ref href=\"/us/usc/t18/s1365\">section 1365 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da775-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/3\"><num value=\"3\">(3)</num><content> the terms “dating partner” and “spouse or intimate partner” have the meanings <ref class=\"footnoteRef\" idref=\"fn002021\">1</ref><note type=\"footnote\" id=\"fn002021\"><num>1</num> So in original. Probably should be “meaning”.</note> given those terms in section 2266;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da776-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/4\"><num value=\"4\">(4)</num><content> the term “strangling” means intentionally, knowingly, or recklessly impeding the normal breathing or circulation of the blood of a person by applying pressure to the throat or neck, regardless of whether that conduct results in any visible injury or whether there is any intent to kill or protractedly injure the victim; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id743da777-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s113/b/5\"><num value=\"5\">(5)</num><content> the term “suffocating” means intentionally, knowingly, or recklessly impeding the normal breathing of a person by covering the mouth of the person, the nose of the person, or both, regardless of whether that conduct results in any visible injury or whether there is any intent to kill or protractedly injure the victim.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id743da778-3b28-11eb-ad8c-9fba61cd9daf\">(<ref href=\"/us/act/1948-06-25/ch645\">June 25, 1948, ch. 645</ref>, <ref href=\"/us/stat/62/689\">62 Stat. 689</ref>; <ref href=\"/us/pl/94/297/s3\">Pub.
