L. 109–248, title V, § 505(a), July 27, 2006, 120 Stat. 629.)","seq_in_title":540,"parent_identifier":"/us/usc/t18/ptI/ch71","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch71","level":"chapter","num":"CHAPTER 71—","heading":"OBSCENITY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74b03f63-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467\"><num value=\"1467\">§ 1467.</num><heading> Criminal forfeiture</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74b03f64-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Property Subject to Criminal Forfeiture</inline>.—</heading><chapeau>A person who is convicted of an offense involving obscene material under this chapter shall forfeit to the United States such person’s interest in—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74b03f65-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/a/1\"><num value=\"1\">(1)</num><content> any obscene material produced, transported, mailed, shipped, or received in violation of this chapter;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74b03f66-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/a/2\"><num value=\"2\">(2)</num><content> any property, real or personal, constituting or traceable to gross profits or other proceeds obtained from such offense; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74b03f67-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/a/3\"><num value=\"3\">(3)</num><content> any property, real or personal, used or intended to be used to commit or to promote the commission of such offense.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74b03f68-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/b\"><num value=\"b\">(b)</num><content> The provisions of section 413 of the Controlled Substances Act (<ref href=\"/us/usc/t21/s853\">21 U.S.C. 853</ref>), with the exception of subsections (a) and (d), shall apply to the criminal forfeiture of property pursuant to subsection (a).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74b03f69-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1467/c\"><num value=\"c\">(c)</num><content> Any property subject to forfeiture pursuant to subsection (a) may be forfeited to the United States in a civil case in accordance with the procedures set forth in chapter 46 of this title.</content>\n</subsection>\n<sourceCredit id=\"id74b03f6a-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/100/690/tVII/s7522/a\">Pub.
