B, title II, § 221, Nov. 18, 2011, 125 Stat. 621.)","seq_in_title":662,"parent_identifier":"/us/usc/t18/ptI/ch85","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch85","level":"chapter","num":"CHAPTER 85—","heading":"PRISON-MADE GOODS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74cf3824-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761\"><num value=\"1761\">§ 1761.</num><heading> Transportation or importation</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74cf3825-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/a\"><num value=\"a\">(a)</num><content> Whoever knowingly transports in interstate commerce or from any foreign country into the United States any goods, wares, or merchandise manufactured, produced, or mined, wholly or in part by convicts or prisoners, except convicts or prisoners on parole, supervised release, or probation, or in any penal or reformatory institution, shall be fined under this title or imprisoned not more than two years, or both.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74cf3826-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/b\"><num value=\"b\">(b)</num><content> This chapter shall not apply to agricultural commodities or parts for the repair of farm machinery, nor to commodities manufactured in a Federal, District of Columbia, or State institution for use by the Federal Government, or by the District of Columbia, or by any State or Political subdivision of a State or not-for-profit organizations.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74cf3827-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c\"><num value=\"c\">(c)</num><chapeau> In addition to the exceptions set forth in subsection (b) of this section, this chapter shall not apply to goods, wares, or merchandise manufactured, produced, or mined by convicts or prisoners who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74cf3828-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/1\"><num value=\"1\">(1)</num><content> are participating in—one of not more than 50 prison work pilot projects designated by the Director of the Bureau of Justice Assistance;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74cf3829-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/2\"><num value=\"2\">(2)</num><chapeau> have, in connection with such work, received wages at a rate which is not less than that paid for work of a similar nature in the locality in which the work was performed, except that such wages may be subject to deductions which shall not, in the aggregate, exceed 80 per centum of gross wages, and shall be limited as follows:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74cf382a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/2/A\"><num value=\"A\">(A)</num><content> taxes (Federal, State, local);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74cf382b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/2/B\"><num value=\"B\">(B)</num><content> reasonable charges for room and board, as determined by regulations issued by the chief State correctional officer, in the case of a State prisoner;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74cf382c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/2/C\"><num value=\"C\">(C)</num><content> allocations for support of family pursuant to State statute, court order, or agreement by the offender;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74cf382d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/2/D\"><num value=\"D\">(D)</num><content> contributions to any fund established by law to compensate the victims of crime of not more than 20 per centum but not less than 5 per centum of gross wages;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74cf382e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/3\"><num value=\"3\">(3)</num><content> have not solely by their status as offenders, been deprived of the right to participate in benefits made available by the Federal or State Government to other individuals on the basis of their employment, such as workmen’s compensation. However, such convicts or prisoners shall not be qualified to receive any payments for unemployment compensation while incarcerated, notwithstanding any other provision of the law to the contrary; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74cf382f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/c/4\"><num value=\"4\">(4)</num><content> have participated in such employment voluntarily and have agreed in advance to the specific deductions made from gross wages pursuant to this section, and all other financial arrangements as a result of participation in such employment.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74cf3830-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/d\"><num value=\"d\">(d)</num><content> This section shall not apply to goods, wares, or merchandise manufactured, produced, mined or assembled by convicts or prisoners who are participating in any pilot project approved by the FPI Board of Directors, which are currently, or would otherwise be, manufactured, produced, mined, or assembled outside the United States.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74cf3831-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1761/e\"><num value=\"e\">(e)</num><content> For the purposes of this section, the term “State” means a State of the United States and any commonwealth, territory, or possession of the United States.</content>\n</subsection>\n<sourceCredit id=\"id74cf3832-3b28-11eb-ad8c-9fba61cd9daf\">(<ref href=\"/us/act/1948-06-25/ch645\">June 25, 1948, ch. 645</ref>, <ref href=\"/us/stat/62/785\">62 Stat. 785</ref>; <ref href=\"/us/pl/90/351/tI/s819/a\">Pub. Each section related to the same subject matter and defined the same offense. <ref href=\"/us/usc/t18/s396a\">Section 396a of title 18</ref>, U.S.C., 1940 ed., was enacted later and superseded <ref href=\"/us/usc/t18/s396b\">section 396b of title 18</ref>, U.S.C., 1940 ed.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Reference to persons aiding, causing or assisting was omitted. Such persons are principals under <ref href=\"/us/usc/t18/s2\">section 2 of this title</ref>.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">Reference to states, territories, specific places, etc., were omitted.
