<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74428884-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176"><num value="176">§ 176.</num><heading> Seizure, forfeiture, and destruction</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74428885-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/a"><num value="a">(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id74428886-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/a/1"><num value="1">(1)</num><chapeau> Except as provided in paragraph (2), the Attorney General may request the issuance, in the same manner as provided for a search warrant, of a warrant authorizing the seizure of any biological agent, toxin, or delivery system that—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id74428887-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/a/1/A"><num value="A">(A)</num><content> pertains to conduct prohibited under <ref href="/us/usc/t18/s175">section 175 of this title</ref>; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id74428888-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/a/1/B"><num value="B">(B)</num><content> is of a type or in a quantity that under the circumstances has no apparent justification for prophylactic, protective, or other peaceful purposes.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id74428889-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/a/2"><num value="2">(2)</num><content> In exigent circumstances, seizure and destruction of any biological agent, toxin, or delivery system described in subparagraphs (A) and (B) of paragraph (1) may be made upon probable cause without the necessity for a warrant.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7442888a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/b"><num value="b">(b)</num><heading> <inline class="small-caps">Procedure</inline>.—</heading><content>Property seized pursuant to subsection (a) shall be forfeited to the United States after notice to potential claimants and an opportunity for a hearing. At such hearing, the Government shall bear the burden of persuasion by a preponderance of the evidence. Except as inconsistent herewith, the same procedures and provisions of law relating to a forfeiture under the customs laws shall extend to a seizure or forfeiture under this section. The Attorney General may provide for the destruction or other appropriate disposition of any biological agent, toxin, or delivery system seized and forfeited pursuant to this section.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id7444d27b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/c"><num value="c">(c)</num><heading> <inline class="small-caps">Affirmative Defense</inline>.—</heading><chapeau>It is an affirmative defense against a forfeiture under subsection (a)(1)(B) of this section that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7444d27c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/c/1"><num value="1">(1)</num><content> such biological agent, toxin, or delivery system is for a prophylactic, protective, or other peaceful purpose; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7444d27d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s176/c/2"><num value="2">(2)</num><content> such biological agent, toxin, or delivery system, is of a type and quantity reasonable for that purpose.</content>
