L. 104–132, title V, § 511(b)(2), Apr. 24, 1996, 110 Stat. 1284.)","seq_in_title":71,"parent_identifier":"/us/usc/t18/ptI/ch10","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch10","level":"chapter","num":"CHAPTER 10—","heading":"BIOLOGICAL WEAPONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7444d282-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177\"><num value=\"177\">§ 177.</num><heading> Injunctions</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7444d283-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>The United States may obtain in a civil action an injunction against—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7444d284-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/a/1\"><num value=\"1\">(1)</num><content> the conduct prohibited under <ref href=\"/us/usc/t18/s175\">section 175 of this title</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7444d285-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/a/2\"><num value=\"2\">(2)</num><content> the preparation, solicitation, attempt, threat, or conspiracy to engage in conduct prohibited under <ref href=\"/us/usc/t18/s175\">section 175 of this title</ref>; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7444d286-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/a/3\"><num value=\"3\">(3)</num><content> the development, production, stockpiling, transferring, acquisition, retention, or possession, or the attempted development, production, stockpiling, transferring, acquisition, retention, or possession of any biological agent, toxin, or delivery system of a type or in a quantity that under the circumstances has no apparent justification for prophylactic, protective, or other peaceful purposes.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7444d287-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Affirmative Defense</inline>.—</heading><chapeau>It is an affirmative defense against an injunction under subsection (a)(3) of this section that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7444d288-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/b/1\"><num value=\"1\">(1)</num><content> the conduct sought to be enjoined is for a prophylactic, protective, or other peaceful purpose; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7444d289-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s177/b/2\"><num value=\"2\">(2)</num><content> such biological agent, toxin, or delivery system is of a type and quantity reasonable for that purpose.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7444d28a-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/101/298/s3/a\">Pub.
