<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74cf3849-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791"><num value="1791">§ 1791.</num><heading> Providing or possessing contraband in prison</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74cf384a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/a"><num value="a">(a)</num><heading> <inline class="small-caps">Offense</inline>.—</heading><chapeau>Whoever—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74cf384b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/a/1"><num value="1">(1)</num><content> in violation of a statute or a rule or order issued under a statute, provides to an inmate of a prison a prohibited object, or attempts to do so; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf384c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/a/2"><num value="2">(2)</num><content> being an inmate of a prison, makes, possesses, or obtains, or attempts to make or obtain, a prohibited object;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be punished as provided in subsection (b) of this section.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74cf384d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b"><num value="b">(b)</num><heading> <inline class="small-caps">Punishment</inline>.—</heading><chapeau>The punishment for an offense under this section is a fine under this title or—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74cf384e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b/1"><num value="1">(1)</num><content> imprisonment for not more than 20 years, or both, if the object is specified in subsection (d)(1)(C) of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf384f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b/2"><num value="2">(2)</num><content> imprisonment for not more than 10 years, or both, if the object is specified in subsection (d)(1)(A) of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf3850-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b/3"><num value="3">(3)</num><content> imprisonment for not more than 5 years, or both, if the object is specified in subsection (d)(1)(B) of this section;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf3851-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b/4"><num value="4">(4)</num><content> imprisonment for not more than one year, or both, if the object is specified in subsection (d)(1)(D), (d)(1)(E), or (d)(1)(F) of this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf3852-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/b/5"><num value="5">(5)</num><content> imprisonment for not more than 6 months, or both, if the object is specified in subsection (d)(1)(G) of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74cf3853-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/c"><num value="c">(c)</num><heading> <inline class="small-caps">Consecutive Punishment Required in Certain Cases</inline>.—</heading><content>Any punishment imposed under subsection (b) for a violation of this section involving a controlled substance shall be consecutive to any other sentence imposed by any court for an offense involving such a controlled substance. Any punishment imposed under subsection (b) for a violation of this section by an inmate of a prison shall be consecutive to the sentence being served by such inmate at the time the inmate commits such violation.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74cf3854-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d"><num value="d">(d)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>As used in this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74cf3855-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1"><num value="1">(1)</num><chapeau> the term “prohibited object” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf3856-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/A"><num value="A">(A)</num><content> a firearm or destructive device or a controlled substance in schedule I or II, other than marijuana or a controlled substance referred to in subparagraph (C) of this subsection;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf3857-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/B"><num value="B">(B)</num><content> marijuana or a controlled substance in schedule III, other than a controlled substance referred to in subparagraph (C) of this subsection, ammunition, a weapon (other than a firearm or destructive device), or an object that is designed or intended to be used as a weapon or to facilitate escape from a prison;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf3858-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/C"><num value="C">(C)</num><content> a narcotic drug, methamphetamine, its salts, isomers, and salts of its isomers, lysergic acid diethylamide, or phencyclidine;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf3859-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/D"><num value="D">(D)</num><content> a controlled substance (other than a controlled substance referred to in subparagraph (A), (B), or (C) of this subsection) or an alcoholic beverage;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf385a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/E"><num value="E">(E)</num><content> any United States or foreign currency;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf385b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/F"><num value="F">(F)</num><content> a phone or other device used by a user of commercial mobile service (as defined in section 332(d) of the Communications Act of 1934 (<ref href="/us/usc/t47/s332/d">47 U.S.C. 332(d)</ref>)) in connection with such service; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74cf385c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/1/G"><num value="G">(G)</num><content> any other object that threatens the order, discipline, or security of a prison, or the life, health, or safety of an individual;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf385d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/2"><num value="2">(2)</num><content> the terms “ammunition”, “firearm”, and “destructive device” have, respectively, the meanings given those terms in <ref href="/us/usc/t18/s921">section 921 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74cf385e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1791/d/3"><num value="3">(3)</num><content> the terms “controlled substance” and “narcotic drug” have, respectively, the meanings given those terms in section 102 of the Controlled Substances Act (<ref href="/us/usc/t21/s802">21 U.S.C. 802</ref>); and</content>

<p style="-uslm-lc:I23" class="indent2">“(D) a controlled substance, other than a narcotic drug, as defined in section 102 of the Controlled Substances Act (<ref href="/us/usc/t21/s802">21 U.S.C. 802</ref>), or an alcoholic beverage;</p>
<p style="-uslm-lc:I23" class="indent2">“(E) United States currency; or</p>
<p style="-uslm-lc:I23" class="indent2">“(F) any other object; or</p>
<p style="-uslm-lc:I22" class="indent1">“(2) being an inmate of a Federal penal or correctional facility, he makes, possesses, procures, or otherwise provides himself with, or attempts to make, possess, procure, or otherwise provide himself with, anything described in paragraph (1).</p>
<p style="-uslm-lc:I21" class="indent0">“(b) <inline class="small-caps">Grading</inline>.—An offense described in this section is punishable by—</p>
<p style="-uslm-lc:I22" class="indent1">“(1) imprisonment for not more than ten years, a fine of not more than $25,000, or both, if the object is anything set forth in paragraph (1)(A);</p>
<p style="-uslm-lc:I22" class="indent1">“(2) imprisonment for not more than five years, a fine of not more than $10,000, or both, if the object is anything set forth in paragraph (1)(B) or (1)(C);</p>
<p style="-uslm-lc:I22" class="indent1">“(3) imprisonment for not more than one year, a fine of not more than $5,000, or both, if the object is anything set forth in paragraph (1)(D) or (1)(E); and</p>
<p style="-uslm-lc:I22" class="indent1">“(4) imprisonment for not more than six months, a fine of not more than $1,000, or both, if the object is any other object.</p>
<p style="-uslm-lc:I21" class="indent0">“(c) <inline class="small-caps">Definitions</inline>.—As used in this section, ‘firearm’ and ‘destructive device’ have the meaning given those terms, respectively, in <ref href="/us/usc/t18/s921/a/3">18 U.S.C. 921(a)(3)</ref> and (4).”</p>
