<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74d18267-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801"><num value="1801">§ 1801.</num><heading> Video voyeurism</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74d18268-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/a"><num value="a">(a)</num><content> Whoever, in the special maritime and territorial jurisdiction of the United States, has the intent to capture an image of a private area of an individual without their consent, and knowingly does so under circumstances in which the individual has a reasonable expectation of privacy, shall be fined under this title or imprisoned not more than one year, or both.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74d18269-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b"><num value="b">(b)</num><chapeau> In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74d1826a-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/1"><num value="1">(1)</num><content> the term “capture”, with respect to an image, means to videotape, photograph, film, record by any means, or broadcast;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d1826b-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/2"><num value="2">(2)</num><content> the term “broadcast” means to electronically transmit a visual image with the intent that it be viewed by a person or persons;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d1826c-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/3"><num value="3">(3)</num><content> the term “a private area of the individual” means the naked or undergarment clad genitals, pubic area, buttocks, or female breast of that individual;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d1826d-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/4"><num value="4">(4)</num><content> the term “female breast” means any portion of the female breast below the top of the areola; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d1826e-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/5"><num value="5">(5)</num><chapeau> the term “under circumstances in which that individual has a reasonable expectation of privacy” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74d1826f-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/5/A"><num value="A">(A)</num><content> circumstances in which a reasonable person would believe that he or she could disrobe in privacy, without being concerned that an image of a private area of the individual was being captured; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d18270-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/b/5/B"><num value="B">(B)</num><content> circumstances in which a reasonable person would believe that a private area of the individual would not be visible to the public, regardless of whether that person is in a public or private place.</content>
</subparagraph>

<subsection style="-uslm-lc:I11" class="indent0" id="id74d18271-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1801/c"><num value="c">(c)</num><content> This section does not prohibit any lawful law enforcement, correctional, or intelligence activity.</content>
