L. 114–153, § 2(b), May 11, 2016, 130 Stat. 380.)","seq_in_title":677,"parent_identifier":"/us/usc/t18/ptI/ch90","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch90","level":"chapter","num":"CHAPTER 90—","heading":"PROTECTION OF TRADE SECRETS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74d3f319-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839\"><num value=\"1839\">§ 1839.</num><heading> Definitions</heading>\n<chapeau style=\"-uslm-lc:I11\" class=\"indent0\">As used in this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f31a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/1\"><num value=\"1\">(1)</num><content> the term “foreign instrumentality” means any agency, bureau, ministry, component, institution, association, or any legal, commercial, or business organization, corporation, firm, or entity that is substantially owned, controlled, sponsored, commanded, managed, or dominated by a foreign government;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f31b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/2\"><num value=\"2\">(2)</num><content> the term “foreign agent” means any officer, employee, proxy, servant, delegate, or representative of a foreign government;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f31c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/3\"><num value=\"3\">(3)</num><chapeau> the term “trade secret” means all forms and types of financial, business, scientific, technical, economic, or engineering information, including patterns, plans, compilations, program devices, formulas, designs, prototypes, methods, techniques, processes, procedures, programs, or codes, whether tangible or intangible, and whether or how stored, compiled, or memorialized physically, electronically, graphically, photographically, or in writing if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f31d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/3/A\"><num value=\"A\">(A)</num><content> the owner thereof has taken reasonable measures to keep such information secret; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f31e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/3/B\"><num value=\"B\">(B)</num><content> the information derives independent economic value, actual or potential, from not being generally known to, and not being readily ascertainable through proper means by, another person who can obtain economic value from the disclosure or use of the information;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f31f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/4\"><num value=\"4\">(4)</num><content> the term “owner”, with respect to a trade secret, means the person or entity in whom or in which rightful legal or equitable title to, or license in, the trade secret is reposed;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f320-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5\"><num value=\"5\">(5)</num><chapeau> the term “misappropriation” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f321-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/A\"><num value=\"A\">(A)</num><content> acquisition of a trade secret of another by a person who knows or has reason to know that the trade secret was acquired by improper means; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f322-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B\"><num value=\"B\">(B)</num><chapeau> disclosure or use of a trade secret of another without express or implied consent by a person who—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74d3f323-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/i\"><num value=\"i\">(i)</num><content> used improper means to acquire knowledge of the trade secret;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74d3f324-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/ii\"><num value=\"ii\">(ii)</num><chapeau> at the time of disclosure or use, knew or had reason to know that the knowledge of the trade secret was—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id74d3f325-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/ii/I\"><num value=\"I\">(I)</num><content> derived from or through a person who had used improper means to acquire the trade secret;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id74d3f326-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/ii/II\"><num value=\"II\">(II)</num><content> acquired under circumstances giving rise to a duty to maintain the secrecy of the trade secret or limit the use of the trade secret; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id74d3f327-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/ii/III\"><num value=\"III\">(III)</num><content> derived from or through a person who owed a duty to the person seeking relief to maintain the secrecy of the trade secret or limit the use of the trade secret; or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id74d3f328-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/iii\"><num value=\"iii\">(iii)</num><chapeau> before a material change of the position of the person, knew or had reason to know that—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id74d3f329-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/iii/I\"><num value=\"I\">(I)</num><content> the trade secret was a trade secret; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id74d3f32a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/5/B/iii/II\"><num value=\"II\">(II)</num><content> knowledge of the trade secret had been acquired by accident or mistake;</content>\n</subclause>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f32b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/6\"><num value=\"6\">(6)</num><chapeau> the term “improper means”—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f32c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/6/A\"><num value=\"A\">(A)</num><content> includes theft, bribery, misrepresentation, breach or inducement of a breach of a duty to maintain secrecy, or espionage through electronic or other means; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74d3f32d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/6/B\"><num value=\"B\">(B)</num><content> does not include reverse engineering, independent derivation, or any other lawful means of acquisition; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f32e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1839/7\"><num value=\"7\">(7)</num><content> the term “Trademark Act of 1946” means the Act entitled “An Act to provide for the registration and protection of trademarks used in commerce, to carry out the provisions of certain international conventions, and for other purposes <ref class=\"footnoteRef\" idref=\"fn002126\">1</ref><note type=\"footnote\" id=\"fn002126\"><num>1</num> So in original.
