L. 108–212, § 2(a), Apr. 1, 2004, 118 Stat. 568.)","seq_in_title":678,"parent_identifier":"/us/usc/t18/ptI/ch90A","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch90A","level":"chapter","num":"CHAPTER 90A—","heading":"PROTECTION OF UNBORN CHILDREN","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74d3f338-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841\"><num value=\"1841\">§ 1841.</num><heading> Protection of unborn children</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f339-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a\"><num value=\"a\">(a)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f33a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/1\"><num value=\"1\">(1)</num><content> Whoever engages in conduct that violates any of the provisions of law listed in subsection (b) and thereby causes the death of, or bodily injury (as defined in section 1365) to, a child, who is in utero at the time the conduct takes place, is guilty of a separate offense under this section.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f33b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f33c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/A\"><num value=\"A\">(A)</num><content> Except as otherwise provided in this paragraph, the punishment for that separate offense is the same as the punishment provided under Federal law for that conduct had that injury or death occurred to the unborn child’s mother.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f33d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/B\"><num value=\"B\">(B)</num><chapeau> An offense under this section does not require proof that—</chapeau><clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f33e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/B/i\"><num value=\"i\">(i)</num><content> the person engaging in the conduct had knowledge or should have had knowledge that the victim of the underlying offense was pregnant; or</content>\n</clause>\n<clause style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f33f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/B/ii\"><num value=\"ii\">(ii)</num><content> the defendant intended to cause the death of, or bodily injury to, the unborn child.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f340-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/C\"><num value=\"C\">(C)</num><content> If the person engaging in the conduct thereby intentionally kills or attempts to kill the unborn child, that person shall instead of being punished under subparagraph (A), be punished as provided under sections 1111, 1112, and 1113 of this title for intentionally killing or attempting to kill a human being.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f341-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/a/2/D\"><num value=\"D\">(D)</num><content> Notwithstanding any other provision of law, the death penalty shall not be imposed for an offense under this section.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f342-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/b\"><num value=\"b\">(b)</num><chapeau> The provisions referred to in subsection (a) are the following:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f343-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/b/1\"><num value=\"1\">(1)</num><content> Sections 36, 37, 43, 111, 112, 113, 114, 115, 229, 242, 245, 247, 248, 351, 831, 844(d), (f), (h)(1), and (i), 924(j), 930, 1111, 1112, 1113, 1114, 1116, 1118, 1119, 1120, 1121, 1153(a), 1201(a), 1203, 1365(a), 1501, 1503, 1505, 1512, 1513, 1751, 1864, 1951, 1952 (a)(1)(B), (a)(2)(B), and (a)(3)(B), 1958, 1959, 1992, 2113, 2114, 2116, 2118, 2119, 2191, 2231, 2241(a), 2245, 2261, 2261A, 2280, 2281, 2332, 2332a, 2332b, 2340A, and 2441 of this title.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f344-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/b/2\"><num value=\"2\">(2)</num><content> Section 408(e) of the Controlled Substances Act of 1970 (<ref href=\"/us/usc/t21/s848/e\">21 U.S.C. 848(e)</ref>).</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f345-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/b/3\"><num value=\"3\">(3)</num><content> Section 202 of the Atomic Energy Act of 1954 (<ref href=\"/us/usc/t42/s2283\">42 U.S.C. 2283</ref>).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f346-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/c\"><num value=\"c\">(c)</num><chapeau> Nothing in this section shall be construed to permit the prosecution—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f347-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/c/1\"><num value=\"1\">(1)</num><content> of any person for conduct relating to an abortion for which the consent of the pregnant woman, or a person authorized by law to act on her behalf, has been obtained or for which such consent is implied by law;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f348-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/c/2\"><num value=\"2\">(2)</num><content> of any person for any medical treatment of the pregnant woman or her unborn child; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74d3f349-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/c/3\"><num value=\"3\">(3)</num><content> of any woman with respect to her unborn child.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74d3f34a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s1841/d\"><num value=\"d\">(d)</num><content> As used in this section, the term “unborn child” means a child in utero, and the term “child in utero” or “child, who is in utero” means a member of the species homo sapiens, at any stage of development, who is carried in the womb.</content>\n</subsection>\n<sourceCredit id=\"id74d3f34b-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/108/212/s2/a\">Pub.
