<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74d664a1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864"><num value="1864">§ 1864.</num><heading> Hazardous or injurious devices on Federal lands</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74d664a2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/a"><num value="a">(a)</num><chapeau> Whoever—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/a/1"><num value="1">(1)</num><content> with the intent to violate the Controlled Substances Act,</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/a/2"><num value="2">(2)</num><content> with the intent to obstruct or harass the harvesting of timber, or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/a/3"><num value="3">(3)</num><content> with reckless disregard to the risk that another person will be placed in danger of death or bodily injury and under circumstances manifesting extreme indifference to such risk,</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">uses a hazardous or injurious device on Federal land, on an Indian reservation, or on an Indian allotment while the title to such allotment is held in trust by the United States or while such allotment remains inalienable by the allottee without the consent of the United States shall be punished under subsection (b).</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74d664a6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b"><num value="b">(b)</num><chapeau> An individual who violates subsection (a) shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b/1"><num value="1">(1)</num><content> if death of an individual results, be fined under this title or imprisoned for any term of years or for life, or both;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b/2"><num value="2">(2)</num><content> if serious bodily injury to any individual results, be fined under this title or imprisoned for not more than 40 years, or both;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664a9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b/3"><num value="3">(3)</num><content> if bodily injury to any individual results, be fined under this title or imprisoned for not more than 20 years, or both;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664aa-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b/4"><num value="4">(4)</num><content> if damage to the property of any individual results or if avoidance costs have been incurred exceeding $10,000, in the aggregate, be fined under this title or imprisoned for not more than 20 years, or both; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664ab-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/b/5"><num value="5">(5)</num><content> in any other case, be fined under this title or imprisoned for not more than one year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74d664ac-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/c"><num value="c">(c)</num><content> Any individual who is punished under subsection (b)(5) after one or more prior convictions under any such subsection shall be fined under this title or imprisoned for not more than 20 years, or both.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74d664ad-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d"><num value="d">(d)</num><chapeau> As used in this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74d664ae-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/1"><num value="1">(1)</num><chapeau> the term “serious bodily injury” means bodily injury which involves—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664af-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/1/A"><num value="A">(A)</num><content> a substantial risk of death;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/1/B"><num value="B">(B)</num><content> extreme physical pain;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/1/C"><num value="C">(C)</num><content> protracted and obvious disfigurement; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/1/D"><num value="D">(D)</num><content> protracted loss or impairment of the function of bodily member, organ, or mental faculty;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664b3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2"><num value="2">(2)</num><chapeau> the term “bodily injury” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2/A"><num value="A">(A)</num><content> a cut, abrasion, bruise, burn, or disfigurement;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2/B"><num value="B">(B)</num><content> physical pain;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2/C"><num value="C">(C)</num><content> illness;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2/D"><num value="D">(D)</num><content> impairment of the function of a bodily member, organ, or mental faculty; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664b8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/2/E"><num value="E">(E)</num><content> any other injury to the body, no matter how temporary;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664b9-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/3"><num value="3">(3)</num><content> the term “hazardous or injurious device” means a device, which when assembled or placed, is capable of causing bodily injury, or damage to property, by the action of any person making contact with such device subsequent to the assembly or placement. Such term includes guns attached to trip wires or other triggering mechanisms, ammunition attached to trip wires or other triggering mechanisms, or explosive devices attached to trip wires or other triggering mechanisms, sharpened stakes, lines or wires, lines or wires with hooks attached, nails placed so that the sharpened ends are positioned in an upright manner, or tree spiking devices including spikes, nails, or other objects hammered, driven, fastened, or otherwise placed into or on any timber, whether or not severed from the stump; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74d664ba-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/4"><num value="4">(4)</num><chapeau> the term “avoidance costs” means costs incurred by any individual for the purpose of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664bb-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/4/A"><num value="A">(A)</num><content> detecting a hazardous or injurious device; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id74d664bc-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/d/4/B"><num value="B">(B)</num><content> preventing death, serious bodily injury, bodily injury, or property damage likely to result from the use of a hazardous or injurious device in violation of subsection (a).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74d664bd-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s1864/e"><num value="e">(e)</num><content> Any person injured as the result of a violation of subsection (a) may commence a civil action on his own behalf against any person who is alleged to be in violation of subsection (a). The district courts shall have jurisdiction, without regard to the amount in controversy or the citizenship of the parties, in such civil actions. The court may award, in addition to monetary damages for any injury resulting from an alleged violation of subsection (a), costs of litigation, including reasonable attorney and expert witness fees, to any prevailing or substantially prevailing party, whenever the court determines such award is appropriate.</content>
