and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74532b18-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/a/2\"><num value=\"2\">(2)</num><content> may be fined a further sum equal to the money so loaned or gratuity given.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74532b19-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Regulations</inline>.—</heading><content>A Federal financial institution regulatory agency may prescribe regulations establishing additional limitations on the application for and receipt of credit under this section and on the application and receipt of residential mortgage loans under this section, after consulting with each other Federal financial institution regulatory agency.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74532b1a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74532b1b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Examiner</inline>.—</heading><chapeau>The term “examiner” means any person—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b1c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/1/A\"><num value=\"A\">(A)</num><content> appointed by a Federal financial institution regulatory agency or pursuant to the laws of any State to examine a financial institution; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b1d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/1/B\"><num value=\"B\">(B)</num><content> elected under the law of any State to conduct examinations of any financial institutions.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74532b1e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Federal financial institution regulatory agency</inline>.—</heading><chapeau>The term “Federal financial institution regulatory agency” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b1f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/A\"><num value=\"A\">(A)</num><content> the Office of the Comptroller of the Currency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b20-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/B\"><num value=\"B\">(B)</num><content> the Board of Governors of the Federal Reserve System;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b21-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/C\"><num value=\"C\">(C)</num><content> the Federal Deposit Insurance Corporation;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b22-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/D\"><num value=\"D\">(D)</num><content> the Federal Housing Finance Agency;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b23-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/E\"><num value=\"E\">(E)</num><content> the Farm Credit Administration;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b24-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/F\"><num value=\"F\">(F)</num><content> the Farm Credit System Insurance Corporation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b25-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/2/G\"><num value=\"G\">(G)</num><content> the Small Business Administration.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74532b26-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Financial institution</inline>.—</heading><content>The term “financial institution” does not include a credit union, a Federal Reserve Bank, a Federal home loan bank, or a depository institution holding company.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74532b27-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/4\"><num value=\"4\">(4)</num><heading> <inline class=\"small-caps\">Loan</inline>.—</heading><chapeau>The term “loan” does not include any credit card account established under an open end consumer credit plan or a loan secured by residential real property that is the principal residence of the examiner, if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b28-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/4/A\"><num value=\"A\">(A)</num><content> the applicant satisfies any financial requirements for the credit card account or residential real property loan that are generally applicable to all applicants for the same type of credit card account or residential real property loan;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id74532b29-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s212/c/4/B\"><num value=\"B\">(B)</num><content> the terms and conditions applicable with respect to such account or residential real property loan, and any credit extended to the examiner under such account or residential real property loan, are no more favorable generally to the examiner than the terms and conditions that are generally applicable to credit card accounts or residential real property loans offered by the same financial institution to other borrowers cardholders <ref class=\"footnoteRef\" idref=\"fn002029\">1</ref><note type=\"footnote\" id=\"fn002029\"><num>1</num> So in original.</note> in comparable circumstances under open end consumer credit plans or for residential real property loans;
