<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id74f2ecac-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243"><num value="2243">§ 2243.</num><heading> Sexual abuse of a minor or ward</heading><subsection style="-uslm-lc:I11" class="indent0" id="id74f2ecad-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/a"><num value="a">(a)</num><heading> <inline class="small-caps">Of a Minor</inline>.—</heading><chapeau>Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly engages in a sexual act with another person who—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecae-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/a/1"><num value="1">(1)</num><content> has attained the age of 12 years but has not attained the age of 16 years; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecaf-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/a/2"><num value="2">(2)</num><content> is at least four years younger than the person so engaging;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">or attempts to do so, shall be fined under this title, imprisoned not more than 15 years, or both.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74f2ecb0-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/b"><num value="b">(b)</num><heading> <inline class="small-caps">Of a Ward</inline>.—</heading><chapeau>Whoever, in the special maritime and territorial jurisdiction of the United States or in a Federal prison, or in any prison, institution, or facility in which persons are held in custody by direction of or pursuant to a contract or agreement with the head of any Federal department or agency, knowingly engages in a sexual act with another person who is—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecb1-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/b/1"><num value="1">(1)</num><content> in official detention; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecb2-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/b/2"><num value="2">(2)</num><content> under the custodial, supervisory, or disciplinary authority of the person so engaging;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">or attempts to do so, shall be fined under this title, imprisoned not more than 15 years, or both.</continuation>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74f2ecb3-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/c"><num value="c">(c)</num><heading> <inline class="small-caps">Defenses</inline>.—</heading><paragraph style="-uslm-lc:I11" class="indent0" id="id74f2ecb4-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/c/1"><num value="1">(1)</num><content> In a prosecution under subsection (a) of this section, it is a defense, which the defendant must establish by a preponderance of the evidence, that the defendant reasonably believed that the other person had attained the age of 16 years.</content>
</paragraph>
<paragraph style="-uslm-lc:I11" class="indent0" id="id74f2ecb5-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/c/2"><num value="2">(2)</num><content> In a prosecution under this section, it is a defense, which the defendant must establish by a preponderance of the evidence, that the persons engaging in the sexual act were at that time married to each other.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id74f2ecb6-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/d"><num value="d">(d)</num><heading> <inline class="small-caps">State of Mind Proof Requirement</inline>.—</heading><chapeau>In a prosecution under subsection (a) of this section, the Government need not prove that the defendant knew—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecb7-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/d/1"><num value="1">(1)</num><content> the age of the other person engaging in the sexual act; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id74f2ecb8-3b28-11eb-ad8c-9fba61cd9daf" identifier="/us/usc/t18/s2243/d/2"><num value="2">(2)</num><content> that the requisite age difference existed between the persons so engaging.</content>
