L. 114–119, § 6(b), Feb. 8, 2016, 130 Stat. 23.)","seq_in_title":791,"parent_identifier":"/us/usc/t18/ptI/ch109B","ancestors":[{"identifier":"/us/usc/t18","level":"title","num":"Title 18—","heading":"CRIMES AND CRIMINAL PROCEDURE","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI","level":"part","num":"PART I—","heading":"CRIMES","status":null,"is_section":false},{"identifier":"/us/usc/t18/ptI/ch109B","level":"chapter","num":"CHAPTER 109B—","heading":"SEX OFFENDER AND CRIMES AGAINST CHILDREN REGISTRY","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id74f2ed06-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250\"><num value=\"2250\">§ 2250.</num><heading> Failure to register</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74f2ed07-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General</inline>.—</heading><chapeau>Whoever—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed08-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a/1\"><num value=\"1\">(1)</num><content> is required to register under the Sex Offender Registration and Notification Act;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed09-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed0a-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a/2/A\"><num value=\"A\">(A)</num><content> is a sex offender as defined for the purposes of the Sex Offender Registration and Notification Act by reason of a conviction under Federal law (including the Uniform Code of Military Justice), the law of the District of Columbia, Indian tribal law, or the law of any territory or possession of the United States; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed0b-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a/2/B\"><num value=\"B\">(B)</num><content> travels in interstate or foreign commerce, or enters or leaves, or resides in, Indian country; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed0c-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/a/3\"><num value=\"3\">(3)</num><content> knowingly fails to register or update a registration as required by the Sex Offender Registration and Notification Act;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be fined under this title or imprisoned not more than 10 years, or both.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74f2ed0d-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">International Travel Reporting Violations</inline>.—</heading><chapeau>Whoever—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed0e-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/b/1\"><num value=\"1\">(1)</num><content> is required to register under the Sex Offender Registration and Notification Act (<ref href=\"/us/usc/t42/s16901\">42 U.S.C. 16901</ref> et seq.); <ref class=\"footnoteRef\" idref=\"fn002144\">1</ref><note type=\"footnote\" id=\"fn002144\"><num>1</num> See References in Text note below.</note></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed0f-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/b/2\"><num value=\"2\">(2)</num><content> knowingly fails to provide information required by the Sex Offender Registration and Notification Act relating to intended travel in foreign commerce; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f2ed10-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/b/3\"><num value=\"3\">(3)</num><content> engages or attempts to engage in the intended travel in foreign commerce;</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be fined under this title, imprisoned not more than 10 years, or both.</continuation>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74f55e11-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Affirmative Defense</inline>.—</heading><chapeau>In a prosecution for a violation under subsection (a) or (b), it is an affirmative defense that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f55e12-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/c/1\"><num value=\"1\">(1)</num><content> uncontrollable circumstances prevented the individual from complying;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f55e13-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/c/2\"><num value=\"2\">(2)</num><content> the individual did not contribute to the creation of such circumstances in reckless disregard of the requirement to comply; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f55e14-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/c/3\"><num value=\"3\">(3)</num><content> the individual complied as soon as such circumstances ceased to exist.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id74f55e15-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Crime of Violence.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f55e16-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/d/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>An individual described in subsection (a) or (b) who commits a crime of violence under Federal law (including the Uniform Code of Military Justice), the law of the District of Columbia, Indian tribal law, or the law of any territory or possession of the United States shall be imprisoned for not less than 5 years and not more than 30 years.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id74f55e17-3b28-11eb-ad8c-9fba61cd9daf\" identifier=\"/us/usc/t18/s2250/d/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Additional punishment</inline>.—</heading><content>The punishment provided in paragraph (1) shall be in addition and consecutive to the punishment provided for the violation described in subsection (a) or (b).</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id74f55e18-3b28-11eb-ad8c-9fba61cd9daf\">(Added <ref href=\"/us/pl/109/248/tI/s141/a/1\">Pub.
